Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :17\/11\/2009\n\n O R D E R\n              THOTTATHIL B.RADHAKRISHNAN, J.\n                    -------------------------------------\n                    W.P(C).No.32234 OF 2009\n                    -------------------------------------\n            Dated this the 17th day of November, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p>                           ~~~~~~~~~~~~~<\/p>\n<p>     The petitioner a pharmaceutical manufacturer with due licences<\/p>\n<p>under the Drugs and Cosmetics Act, 1940, Medicinal and Toilet<\/p>\n<p>preparations (Excise Duties) Act, 1955 etc. imported rectified spirit in<\/p>\n<p>terms of permit and NOC granted by excise authorities. The permit<\/p>\n<p>was granted to import 20,000\/- bulk litres of absolute alcohol from<\/p>\n<p>Solapur, Maharashtra. The petitioner entrusted an agent for transit<\/p>\n<p>of goods.\n<\/p>\n<\/p>\n<p>     2.    Even going by the submissions on behalf of the<\/p>\n<p>respondents, the driver and certain other persons connived an<\/p>\n<p>attempt of siphoning 280 litres from the vehicle into eight cisterns.<\/p>\n<p>Under such premise, the 2nd respondent vitiated the proceedings for<\/p>\n<p>confiscation under Section 67B of the Abkari Act.<\/p>\n<p>W.P.(C) No.32234\/2009<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>       3.     Taking the aforesaid facts into consideration, it is ordered<\/p>\n<p>that the petitioner would be permitted to move the rectified spirit in<\/p>\n<p>the vehicle to the bonded warehouse of the petitioner and that the<\/p>\n<p>petitioner shall be permitted to utilise the said spirit, in accordance<\/p>\n<p>with law.      The rectified spirit will be released on the petitioner<\/p>\n<p>executes a simple bond without sureties to satisfy any demand that<\/p>\n<p>may ultimately raise beyond the petitioner.
