1.0\t\tPetitioner
\nis the original complainant.  He has challenged an order dated
\n11.09.2008, passed by the learned Judicial Magistrate, First Class,
\nJunagadh, in Criminal Case No. 2051 of 2005, insofar as the same is
\nadverse to him.  He has also challenged an order dated 08.07.2009,
\npassed  by the learned Additional Sessions Judge, Junagadh, in
\nCriminal Appeal No.08 of 2009, confirming the judgment of the learned
\nMagistrate.\n<\/p>\n
2.0\t\tBrief
\nfacts of the case are as follows:\n<\/p>\n
2.1\t\tPetitioner
\nhad instituted a cheque bouncing complaint against respondent No.2
\nherein, alleging that a cheque of Rs.1,00,000\/-(One Lac) given by the
\naccused on 26.04.2005, was dishonoured upon
\npresentation to the Bank.  The accused, therefore, committed the
\noffence punishable under Section 138 of the Negotiable Instruments
\nAct, 1881.  The learned Magistrate tried the case and convicted the
\naccused for the said offence and imposed punishment of simple
\nimprisonment of 9 months.  He also imposed fine of Rs.5,000\/- and
\nsentence of 2 months further simple imprisonment, in case of default
\nin payment of such fine.\n<\/p>\n
2.2\t\tThe
\npetitioner, being aggrieved by non-awarding of compensation, in terms
\nof sub-Section(3) of Section 357 of the Code of Criminal Procedure,
\nfiled appeal before the Sessions Court. The Sessions Court, by the
\nimpugned judgment, dismissed the said appeal, and hence, this
\nrevision application.\n<\/p>\n
3.0\t\tI
\nhave heard learned Advocates appearing for the parties.  I was, prima
\nfacie, of
\nthe opinion that the Courts below committed an error in not awarding
\ncompensation to the petitioner, in case of dishonour of cheque.  In a
\nrecent decision in the case of  K.A.\n<\/p>\n
Abbas H.S.A. Vs. Sabu Joseph and Another
\nreported
\nin (2010) 6 SCC 230, the Apex Court had an occasion to examine the
\nquestion of awarding default sentence, in case
\nof failure to pay compensation, as directed by the criminal Court, as
\nprovided under sub-Section (3) of Section 357 of the Code of Criminal
\nProcedure. In that case, the Apex Court, while holding that
\nimposition of default sentence for non-payment of compensation would
\nbe permissible and legal, observed as under:\n<\/p>\n

\n In
\nthis case, we are not concerned with sub-Section(1).  We are
\nconcerned only with sub-Section (3). It is an important provision but
\nthe courts have seldom invoked it. Perhaps due to ignorance of the
\nobject of it. It empowers the court to award compensation to victims
\nwhile passing judgment of conviction. In addition to conviction, the
\ncourt may order the accused to pay some amount by way of compensation
\nto the victim who has suffered by the action of the accused. It may
\nbe noted that this power of the courts to award compensation is not
\nancillary to other sentences but it is in addition thereto. This
\npower was intended to do something to assure the victim that he or
\nshe is not forgotten in the criminal justice system. It is a measure
\nof responding appropriately to crime as well as of reconciling the
\nvictim with the offender. It is, to some extent, a constructive
\napproach to crimes.  It is indeed a step forward in our criminal
\njustice system. We, therefore, recommend to all the courts to
\nexercise this power liberally so as to meet the ends of justice in a
\nbetter way.\n<\/p>\n
\t\tThe
\nApex Court also referred to some other decisions on the issue.\n<\/p>\n
4.0\t\tUnder
\nthe circumstances and particularly, considering that the offence
\ninvolved is the one, punishable under Section 138 of the Negotiable
\nInstruments Act, 1881, I was of the opinion that the learned
\nMagistrate ought to have awarded appropriate compensation to the
\ncomplainant, upon recording conviction of the accused.\n<\/p>\n
5.0\t\tThe
\nlearned Counsel for the accused, respondent No.2 herein, however,
\npointed out that upon conclusion of the trial, the trial Court
\nimposed fine, and therefore, it was not open for the trial Court to
\nalso award compensation.  In this regard, reliance is placed on a
\ndecision of the Apex Court in the case of  Sivasuriyan
\nVs. Thangavelu
\nreported in (2006) 1 SCC(Cri) 532.\n<\/p>\n
6.0\t\tThis
\ndifficulty, however, could have been resolved by rescinding the order
\nof payment of fine and instead to award suitable compensation, as
\nfound reasonable in the facts of the case. I see no impediment in
\nadopting such a course. However, before the order could be passed, it
\nwas noticed that the accused had already undergone, not only the
\nentire sentence but had also served the
\ndefault sentence, as well.\n<\/p>\n
7.0\t\tUnder
\nthe circumstances, the order of payment of fine cannot be substituted
\nwith an order for payment of compensation. Especially, when the
\naccused has already served the entire sentence, including the default
\nsentence for non-payment of fine.  Thus, the impugned order being
\nexhausted,it is, now, not possible to rescind the order of payment of
\nfine, with the direction to pay compensation.\n<\/p>\n
8.0\t\tIn the
\nresult, this petition fails and is dismissed.\n<\/p>\n
