RAMKUMAR, J.\n                     .................................\n                      W.P.(c).No.27499 of 2009\n                    ....................................\n                           Dated:09.06.2010\n\n                               JUDGMENT\n<\/pre>\n<p>     In this writ petition filed under Article 226 of the Constitution<\/p>\n<p>of India, the petitioners, two in number, seek a direction to call for<\/p>\n<p>the records in Crime No.671\/2009 of Kasaragod Police Station, to<\/p>\n<p>order a judicial probe by a retired High Court Judge, so as to make<\/p>\n<p>an enquiry into the circumstances leading to the registration of the<\/p>\n<p>above crime and to ensure punishment to such Police officers who<\/p>\n<p>are found guilty pursuant to the judicial probe and to direct the<\/p>\n<p>respondents to pay a sum of Rs.3,50,000\/- to the 1st petitioner as<\/p>\n<p>compensation for the damage sustained to his shop and the<\/p>\n<p>movables therein.\n<\/p>\n<p>     2. According to the petitioners they were severely assaulted<\/p>\n<p>and tortured by the Kasaragod Police on the eve of Ramzan on<\/p>\n<p>20.09.2009 and the police was on the rampage.<\/p>\n<p>     3.    The Superintendent of Police, Kasaragod has filed a<\/p>\n<p>statement to the following effect:-\n<\/p>\n<p>        On 20.09.2009 at about 10.30 p.m. in the old bus stand<\/p>\n<p>   Kasaragod the named accused persons and about 500 other<\/p>\n<p>W.P.(c).No.27499 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>   identifiable youngsters formed themselves into          an<\/p>\n<p>   unlawful assembly and busted crackers        on the busy<\/p>\n<p>   public road, drove motor bikes across the road in a rash<\/p>\n<p>   and negligent manner, after dismantling the silencer<\/p>\n<p>   fitted to the two wheelers thereby making terrible sound.<\/p>\n<p>   Notwithstanding the directions by the Dy.S.P., Kasaragod<\/p>\n<p>   the mob did not stop their activities but instead shouted<\/p>\n<p>   against the Police, pelted stones and soda bottles towards<\/p>\n<p>   the Police party causing injuries to four police men and<\/p>\n<p>   causing damage to six police vehicles, a KSRTC bus and<\/p>\n<p>   five more police constables sustained injuries. Kasaragod<\/p>\n<p>   sub division is the most communally sensitive sub division<\/p>\n<p>   of the district mainly falling within the limits of the<\/p>\n<p>   Kasaragod Police Station. The Police also had intelligence<\/p>\n<p>   reports to the effect that on 20.09.2009, the R.S.S. have<\/p>\n<p>   planned        to conduct a road march from Mallikarjuna<\/p>\n<p>   temple through new bus stand, old bus stand, M.G.Road<\/p>\n<p>   etc. On account of the said situation, sufficient Police<\/p>\n<p>   have been deployed in force to control the erupting<\/p>\n<p>   violence. At about 7 p.m. on 20.9.2009 several Muslim<\/p>\n<p>   youths assembled in the old bus stand creating problems<\/p>\n<p>W.P.(c).No.27499 of 2009<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>   to the public by busting crackers and raising motor bikes<\/p>\n<p>   after dismantling the silencers thereon. They ignored the<\/p>\n<p>   lawful directions of the Police and about 500 agitators<\/p>\n<p>   thronged the old bus stand premises. From 8.30 p.m.<\/p>\n<p>   onwards they resorted to various provocative tactics such<\/p>\n<p>   as raising motor bikes, busting crackers etc. Even after<\/p>\n<p>   the closure of the shops in that area around 10 p.m. the<\/p>\n<p>   troublemakers continued their activity against the<\/p>\n<p>   Policemen who were deployed there. All lawful orders<\/p>\n<p>   given by the Police were disobeyed by the agitators. The<\/p>\n<p>   mob started attacking the Police from all sides resulting in<\/p>\n<p>   Policemen sustaining injuries and 6 Police vehicles and<\/p>\n<p>   one KSRTC bus got damaged due to the pelting of stones.<\/p>\n<p>   The situation was brought under control only by 12.00<\/p>\n<p>   midnight. Crime No.679\/2009 was registered in the above<\/p>\n<p>   circumstances.         During the course of investigation A6,<\/p>\n<p>   A11 and A13 to A17 alone were arrested and produced<\/p>\n<p>   before      the      Chief Judicial Magistrate,   Kasaragod.<\/p>\n<p>   Consequent on another group of militant youth causing<\/p>\n<p>   damage to KSRTC bus yet another case was registered as<\/p>\n<p>   Crime No.672\/2009 of Kasaragod Police Station.           The<\/p>\n<p>W.P.(c).No.27499 of 2009<br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>   agitators have damaged a mobile showroom bus owned by<\/p>\n<p>   the Kerala State Handloom Development Corporation<\/p>\n<p>   resulting in Crime No.674\/2009 being registered against<\/p>\n<p>   the militant groups concerned. Unnecessarily throwing<\/p>\n<p>   lighted crackers to a crowd          including women    and<\/p>\n<p>   children, bursting crackers on public road, conducting<\/p>\n<p>   motor cycle race after dismantling the silencer pipes of<\/p>\n<p>   the motor cycle etc. were the acts of vandalism resorted to<\/p>\n<p>   by the Muslim youngsters.\n<\/p>\n<p>           After having unjustifiably caused breach of public<\/p>\n<p>   place by resorting to violence,       the petitioners cannot<\/p>\n<p>   complain of Police atrocities. If at all the Police had hit<\/p>\n<p>   back, it was due to the conduct of the petitioners and the<\/p>\n<p>   other agitators themselves.\n<\/p>\n<p>       I am not inclined to grant any of the reliefs sought for by<\/p>\n<p>the petitioners.
