\nII, Bijapur.\n<\/p>\n

 when the ciaimant was working as a<\/p>\n
C\u00b0”‘*–__V”‘cooiie Oir\ufb02a Tempo bearing No.MA-13\/R-5019 beionging to<\/p>\n
A   respondent, the tempo met with an accident and<\/p>\n
  sustained injuries. Hence, he fiied a ciairn petition on<\/p>\n
if 22.2.2005 seeking compensation before the Labour Officer<\/p>\n
and Commissioner for workmen Compensation, Sub~<\/p>\n

‘Commissioner’ for short.\n<\/p>\n
4. The Commissioner after consideration of ”<\/p>\n
and documentary evidence on record,. has _.a_WVa4ifded_j’y.aVi’~..<\/p>\n
compensation of Rs.69,273\/– Vwith\u00bbu’inte_re’st ffa’t.yAyA’;&,Ly0\/9 <\/p>\n
from 10.1.2006.\n<\/p>\n
5. As there is  facts that
\nthe ciaimant is. of Section
\n2(1)(n) of  Act, hereinafter
\nreferredftov’asfviiitvctiifaiidif’he’-Vsust’a’ine%d injury in an accident
\noccurrediin’ the  of empioyment while he<\/p>\n
was wo_rkind’~as”a. \u00a7QOA3Ai’-3S iifthe tempo beionging to the first<\/p>\n
 ‘-respoffndzeint and infsured with the second respondent.<\/p>\n
”  _  only substantiai question of iaw that arises<\/p>\n
 “-for consideration is:\n<\/p>\n
 “Whether the compensation of Rs.69,273\/– as
\nawarded by the Tribunal by assessing his income at
\nRs.2,200\/-i per month is just and reasonable and<\/p>\n
does it call for interferences?”\n<\/p>\n

7. Learned Counsel appearing for the claimant<\/p>\n
submits the claimant by working as a coolie in the tempo<\/p>\n
belonging to the first respondent was earning wa’g..\u00e9_’s_:’of<\/p>\n
Rs.fl50\/– plus bata of Rs.40\/~ per day. After’it-sus’ta.ii,ji’1i.nfg_.Q”.<\/p>\n
injury, he is not in a position to c_o.nt,i_nue_-hi’s”*co’ol’i’e. worlg <\/p>\n
and the Tribunal is not justified in’\u00bbA.,as{;essinig.,h’i.s”‘wa’g:e.$ <\/p>\n
Rs.2,200\/– per month andggawalrdilng co’r’nVp.e_nsa’_t;io.n.<\/p>\n
Therefore, he prays for allowinl\u00e9gathexappealiby enhancing
\nthe compensation. . A H<\/p>\n
8. _P\u00e9’,r .lel3_rVned:_4’c.oun’sel~’: appearing for the<\/p>\n
Insurance’Cornparl?y””su’brri-its, the– Commissioner has rightly
\nassessed the  claimant at Rs.2,200\/~ per<\/p>\n
month and. there “no scope for enhancement of<\/p>\n
  com;pen..sat.ion and-h.–e~’prays for dismissal of the appeal.<\/p>\n
  is not in dispute that the claimant was<\/p>\n
 worl<i'ng':.as coolie in the Tempo belonging to the first<\/p>\n
 respondent and he has sustained multiple fractures in the<\/p>\n
 accident occurred in the course of and out of his<\/p>\n
employment. The Doctor, who treated him, has stated
\nthat he has sustained disability of 25% to the whole body.<\/p>\n
The Claimant is aged about 29 years at the time of<\/p>\n

year 2604. Even if we disbelieve the statement<\/p>\n
claimant that he was earning wages of Rs.150\/-5: '<\/p>\n
Rs.40\/– per day as claimed by hi:i*-.-1;" ..5a_ge~i.r,,<\/p>\n
and year of accident and nature of aocctupationias–.C0.o|*;g\u00e9~t,\u00a7n"l~:<\/p>\n
