Agarwal, J.\n<\/p>\n<p>     This petition  has been  filed  by\t the  petitioner  in<br \/>\nperson. It  has been described as Election Petition-cum-Writ<br \/>\nPetition. During  the course  of his  submissions before the<br \/>\nCourt it  was pointed  out to  the petitioner  that  such  a<br \/>\ncomposite  petition   is  not\tmaintainable  and  that\t the<br \/>\npetitioner could  choose to  have the petition treated as an<br \/>\nelection petition or a writ petition under Article 32 of the<br \/>\nConstitution. The  petitioner submitted that the petition be<br \/>\ntreated as  a writ  petition and  that the reliefs sought by<br \/>\nhim regarding  setting aside  of the  election of respondent<br \/>\nNo. 1  may be  deleted. As  per the  said statement  of\t the<br \/>\npetitioner this petition has been treated as a writ petition<br \/>\nfiled under  Article 32\t of  the  Constitution\tand  reliefs\n<\/p>\n<p>(a),(d) and  (h) has  been deleted.  The  petition  is\tthus<br \/>\nconfined to  the Challenge to the validity to the provisions<br \/>\nof  Sections  5B  and  5C  of  the  Presidential  and  Vice-<br \/>\nPresidential Elections Act, 1952 [hereinafter referred to as<br \/>\n&#8216;the Act]  as amended  by Presidential and Vice-Presidential<br \/>\nElections [Amendment]  Ordinance, 1997\t[No.  13  of  1997],<br \/>\nhereinafter referred  to as  &#8216;the Ordinance.&#8217; Insofar as the<br \/>\nchallenge to  the validity of Sections 5B and 5C, as amended<br \/>\nby Act 5 of 1974 and as they stood prior to the promulgation<br \/>\nof Ordinance  of 1997, has been upheld by a 7-judge bench of<br \/>\nthis Court  in <a href=\"\/doc\/174974\/\">Charan  Lal Sahu\t vs. Neelam  Sanjeeva Reddy,<\/a><br \/>\n1978 (1)  SCR 1.  The validity\tof Ordinance  was challenged<br \/>\nbefore this Court in\t W.P.(C)   Nos.293\/97\tand   322\/97<br \/>\nwhich have  been dismissed by orders dated June 19, 1997 and<br \/>\nJuly 11,1997  respectively. The\t Ordinance has been replaced<br \/>\nby  the\t  Presidential\t and   Vice-Presidential   Elections<br \/>\n[Amendment] Act,  997 [Act  35 of 1997]. The validity of the<br \/>\nsaid Act  was challenged  in W.P. (C) No. D 13334\/97 and the<br \/>\nsaid writ  petition was dismissed by order dated October 13,<br \/>\n1997.\n<\/p>\n<p>     The petitioner  has submitted that the decision of this<br \/>\n<a href=\"\/doc\/1105313\/\">Court Charan Lal Sahu vs. Neelam Sanjeev Reddy<\/a> [supra] needs<br \/>\nreconsideration. We  do not  find any  substance in the said<br \/>\nsubmission of\tthe  petitioner. There\tis thus\t no merit in<br \/>\nthis writ  petition and\t it is\taccordingly  dismissed.\t The<br \/>\npetitioner has\talso filed  an application seeking exemption<br \/>\nfrom  payment  of  court  fee.\tWe  have  perused  the\tsaid<br \/>\napplication.
