At  the<br \/>\ntime of allowing  his appeal,   Appellate  Authority did not make any<br \/>\norder regarding consequential benefits flowing from the order setting<br \/>\naside removal from service. Upon the respondent approaching the<br \/>\nCentral Administrative Tribunal, it was observed that the Appellate<br \/>\nAuthority ought to have made specific orders  relating to pay and<br \/>\nallowances required to be paid to the respondent herein for the<br \/>\nperiod of his absence from duty  preceding his removal and also in<br \/>\nrespect of the subsequent period. Therefore, relying upon  Rule  1343<br \/>\nof  the Indian Railways Establishment Code (F.R. 54), it is held by<br \/>\nthe  Tribunal that delay in completing the enquiry against the<br \/>\nrespondent having not been  attributed to the respondent,  he was<br \/>\nentitled to full service benefits and prosecuting agency  having<br \/>\nfailed to bring home the charge against the respondent and the<br \/>\nAppellate Authority having decided in favour of the respondent, the<br \/>\ncase of the respondent was required to be considered for payment of<br \/>\nfull salary and service  benefits for both the periods between<br \/>\n12.12.1995 to 21.4.1999 and from 11.02.2000 to 01.03.2001.\n<\/p>\n<p>2.\tLearned<br \/>\ncounsel for the petitioners  submitted that since the respondent had<br \/>\nnot actually worked during the aforesaid period, the principle of &#8216;No<br \/>\nWork No Pay&#8217;  was  required to be applied and the respondent was<br \/>\nrequired to be denied  wages  for the intervening period. Learned<br \/>\ncounsel relied upon  recent  judgment of the  Supreme Court in Baldev<br \/>\nSingh Vs. Union of India and others (AIR 2006 SC 531).  It was,<br \/>\nhowever,  seen  from the record and it was not in dispute that<br \/>\nabsence of the respondent from duty was  attributable to action of<br \/>\nthe authorities in not allowing  him  to resume his duties and the<br \/>\nperiod after the respondent&#8217;s  removal from service  could only be<br \/>\nattributed  to the order of removal, which was set aside by the<br \/>\nAppellate Authority.  Since the issue of wages for the intervening<br \/>\nperiod is squarely  covered by the express provisions of the Rules<br \/>\napplicable  in the facts of the present case, we find no reason to<br \/>\ninterfere with the impugned order of the Tribunal.  The petition is,<br \/>\ntherefore,  dismissed.
