BALAKRISHNAN NAIR &amp; M.L.JOSEPH FRANCIS, JJ.\n                   ---------------------------------\n                 W.P(C).No.15756 OF 2006\n                   ---------------------------------\n           Dated this the 20th day of March, 2009\n\n                        J U D G M E N T\n<\/pre>\n<p>                        ~~~~~~~~~~~<\/p>\n<p>Balakrishnan Nair, J.\n<\/p>\n<\/p>\n<p>      The respondents in O.A.No.440\/2003 before the Central<\/p>\n<p>Administrative Tribunal, Ernakulam Bench, are the writ<\/p>\n<p>petitioners. The 1st respondent was the applicant.<\/p>\n<p>      2.  The brief facts of the case are the following:<\/p>\n<p>      The applicant was appointed as a Bearer on commission<\/p>\n<p>basis under the Railways on 22.1.1981. Later, on 1.12.1983, he<\/p>\n<p>was converted into a salaried Commission Bearer. As per the<\/p>\n<p>direction of the Apex Court in Ext.P1 judgment, the persons like<\/p>\n<p>applicant were absorbed into regular establishment.            The<\/p>\n<p>applicant&#8217;s turn arose for absorption in 1999 and he was<\/p>\n<p>absorbed on 8.7.1999.      On coming to know that the service<\/p>\n<p>rendered by him on contract basis will not be reckoned for<\/p>\n<p>pensionary benefits, the applicant approached the C.A.T. by<\/p>\n<p>filing  the   aforementioned       Original     Application seeking<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.15756\/2006           2<\/span><\/p>\n<p>appropriate reliefs.    During the pendency of the Original<\/p>\n<p>Application, he retired from service on 31.1.2004. The<\/p>\n<p>respondents, who are the writ petitioners herein, resisted the<\/p>\n<p>Original Application contending that the claim of the applicant is<\/p>\n<p>unsustainable in the light of the relevant rules. The Tribunal<\/p>\n<p>after hearing both sides disposed of the Original Application<\/p>\n<p>directing the writ petitioners to count 50% of the service<\/p>\n<p>rendered by him between 22.1.1981 and 8.7.1999 on contract<\/p>\n<p>basis. Aggrieved by the above direction, the respondents in the<\/p>\n<p>Original Application have preferred this writ petition.<\/p>\n<p>     2.     The petitioners relying on rule 14 of the Railway<\/p>\n<p>Services (Pension) Rules 1993 submitted that the service<\/p>\n<p>rendered by the applicant as Bearer on commission basis cannot<\/p>\n<p>be counted for pensionary benefits. Special reference was made<\/p>\n<p>to Clause (v) of Rule 14, which says that employment under a<\/p>\n<p>covenant or a contract which does not specifically provide for<\/p>\n<p>grant of pensionary benefits cannot be counted.     The applicant<\/p>\n<p>was originally engaged on contract basis subject to the<\/p>\n<p>conditions mentioned in Ext.P10.     It is an order engaging a<\/p>\n<p>person similarly placed like the applicant. Since the said order<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.15756\/2006                              3<\/span><\/p>\n<p>does not permit counting the service for pension, the claim of the<\/p>\n<p>applicant is unsustainable, it is submitted.<\/p>\n<p>     3.     The learned counsel for the 1st respondent on the<\/p>\n<p>other hand relied on Clause (xiv) of Rule 14, which says that if an<\/p>\n<p>appointment on contract basis is followed by confirmation, the<\/p>\n<p>service on contract basis can be counted. The learned counsel<\/p>\n<p>also relied on Rule 24 of the aforementioned Pension Rules,<\/p>\n<p>which provides for counting of service on contract also for<\/p>\n<p>pension.    Clause (xiv) of Rule 14 of the Railway Services<\/p>\n<p>(Pension Rules) reads as follows:\n<\/p>\n<blockquote><p>            &#8220;14. Periods which shall not be treated as<br \/>\n            service for pensionary benefits:- Periods of<br \/>\n            employment in any of the following capacities<br \/>\n            shall not constitute service for pensionary<br \/>\n            benefits, namely, &#8211;<\/p>\n<blockquote><p>            (i)    &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;<\/p>\n<\/blockquote>\n<blockquote><p>            (xiv) on contract basis except when followed<br \/>\n            by confirmation.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     Rule 24 reads as follows:\n<\/p><\/blockquote>\n<blockquote><p>     &#8220;24. Counting of service on contract:-<\/p>\n<\/blockquote>\n<blockquote><p>            (1)    A person who is initially engaged by<br \/>\n            the Railways on a contract and is<br \/>\n            subsequently appointed to the same or<br \/>\n            another post in a substantive capacity,<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.15756\/2006             4<\/span><\/p>\n<p>            without a break in service, such contract<br \/>\n            period of service shall be treated like any<br \/>\n            other permanent service, in the railway<br \/>\n            and be taken into account for calculating<br \/>\n            for the pensionary benefits, subject to the<br \/>\n            conditions laid down in these rules,-\n<\/p><\/blockquote>\n<blockquote><p>            (1)    Provided that (i) the period of<br \/>\n            contract    service,  during   which    the<br \/>\n            Contract officer did not subscribe to the<br \/>\n            State      Railway      Provident     Fund<br \/>\n            (Contributory), shall count to the extent<br \/>\n            indicated above, if during such period, the<br \/>\n            railway servant concerned did not receive<br \/>\n            any inflated rates of pay by reason of<br \/>\n            absence of any retirement benefits;\n<\/p><\/blockquote>\n<blockquote><p>                   (ii) if   the    railway    servant<br \/>\n            concerned has subscribed to the State<br \/>\n            Railway Provident Fund (Contributory)<br \/>\n            during a period of contract service, he<br \/>\n            shall have the option either &#8211;\n<\/p><\/blockquote>\n<blockquote><p>                        (a) to refund the Government<br \/>\n            contribution    in  the   Provident   Fund<br \/>\n            together    with  interest  thereon,   and<br \/>\n            Special Contribution to provident Fund, if<br \/>\n            any, for the period in question and to<br \/>\n            count the contract service for pensionary<br \/>\n            benefits to the extent indicated above, or<\/p>\n<\/blockquote>\n<blockquote><p>                        (b)  to retain the Government<br \/>\n            contribution to the Provident Fund with<br \/>\n            interest thereon including any other<br \/>\n            compensation and Special Contribution to<br \/>\n            Provident Fund, if any, and not to count<br \/>\n            the period of contract service in question<br \/>\n            for pensionary benefits.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(C) No.15756\/2006              5<\/span><\/p>\n<blockquote><p>            (2)    The option, referred to in sub-clause\n<\/p><\/blockquote>\n<blockquote><p>            (a) or sub-clause (b) of clause (i) of sub-<br \/>\n            rule (1), shall be exercised within three<br \/>\n            months from the date of issue of the order<br \/>\n            of confirmation of the railway servant<br \/>\n            concerned in a substantive post and if he<br \/>\n            is on leave on that date, within three<br \/>\n            months     of   his   return   from   leave,<br \/>\n            whichever is later.\n<\/p><\/blockquote>\n<blockquote><p>            (3)    If no option is received from the<br \/>\n            railway servant within the period referred<br \/>\n            to in sub-rule (2), he shall be deemed to<br \/>\n            have opted for retention of monetary<br \/>\n            benefits referred to in sub-clause (b) of<br \/>\n            clause (ii) of sub-rule (1).\n<\/p><\/blockquote>\n<blockquote><p>            (4)    Where a railway servant (on contract<br \/>\n            basis ) who was admitted to the State<br \/>\n            Railway Contributory Provident Fund opts<br \/>\n            for the alternative in sub-clause (a) of<br \/>\n            clause (ii) of sub-rule (1) above, the<br \/>\n            amount     of   Government      contribution<br \/>\n            together with interest thereon including<br \/>\n            any other compensation standing to his<br \/>\n            credit in State Railway Provident Fund<br \/>\n            (Contributory)      and     the     Special<br \/>\n            Contribution to the Provident Fund, if<br \/>\n            any, shall be surrendered and such<br \/>\n            amount      shall  be    credited   to   the<br \/>\n            Consolidated Fund of India:\n<\/p><\/blockquote>\n<blockquote><p>                   Provided that in a case where the<br \/>\n            Government contribution and the Special<br \/>\n            Contribution, if any, have been paid to the<br \/>\n            railway servant, he shall be required to<br \/>\n            refund the amount received by him<br \/>\n            together with compound interest on the<br \/>\n            amount actually received from the date(s)<br \/>\n            of payment to the date of final refund, at<br \/>\n            the    rate   which    would    have   been<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.15756\/2006             6<\/span><\/p>\n<p>            applicable     to      the    Government<br \/>\n            contribution, if that amount would have<br \/>\n            remained in the fund and earnest interest.<br \/>\n            In case where the railway servant dies<br \/>\n            before the entire amount is refunded, the<br \/>\n            amount which remains to be refunded<br \/>\n            shall be adjusted against the death<br \/>\n            gratuity which may become payable to the<br \/>\n            family of such railway servant.&#8221;\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>     In this case, we notice that the applicant worked on<\/p>\n<p>contract basis from 22.1.1981 to 8.7.1994. Thereafter, he was<\/p>\n<p>absorbed in regular service. So, going by Rule 14 (xiv) and Rule<\/p>\n<p>24 of the Pension Rules, we find nothing wrong with the<\/p>\n<p>direction of the C.A.T. In the light of the above rules, we uphold<\/p>\n<p>the claim of the applicant to the extent the same was upheld by<\/p>\n<p>the Tribunal.
