\nBy way of present application, the applicants have prayed for
\nfollowing relief\/s:\n<\/p>\n
\t(A)\tYour
\nLordships may be pleased to allow this application and \tstay the
\nimplementation, further execution and operation of order\tdated
\n07.08.2009 passed by the opponent No.2-herein bearing\tNo.
\nNPaNi\/Legal\/Palanpur\/Section-37\/S.R.No. 8\/594\/09 till the\tfinal
\ndisposal of Special Civil Application No. 8670 of 2009.\n<\/p>\n
\t(B)\tDuring
\nthe pendency and final disposal of this application, \tyour Lordships
\nmay be pleased to stay the implementation, further \texecution and
\noperation of order dated 07.08.2009 passed by the \topponent
\nNo.2-herein bearing No. \tNPaNi\/Legal\/Palanpur\/Section-37\/S.R. No.
\n8\/594\/09 till the final\tdisposal of Special Civil Application No.
\n8670 of 2009 on any\tconditions that may be deem fit and proper by
\nthis Court.\n<\/p>\n
\t(C)
\nYour Lordships may be pleased to pass such other and further \torder
\nin the interest of justice which may be deemed fit to this \tHon’ble
\nCourt.\n<\/p>\n
2.0\tThis
\npetition being Special Civil Application No. 8670 of 2009 has been
\npreferred in the year 2009. On 27.11.2009, this Court has passed the
\nfollowing order:\n<\/p>\n
\t 1.\tRULE.\n<\/p>\n
Learned counsel appearing for respondents waive service.\n<\/p>\n
\t2.\tBy
\nway of interim relief, the petitioners have sought stay against
\nimplementation and execution of impugned order dated 07.08.2009,
\nwhereby the petitioners are removed from office of the Councilor and
\nas President of respondent no.4-Municipality. Even as such prayer for
\ninterim relief was pressed and learned senior advocate, Mr. Nanavati
\nwas heard in extenso, it was submitted by learned Additional
\nAdvocate General Mr. Mehta, appearing for the State, that the
\nimpugned order was already implemented and fresh election for filling
\nup the vacant seats was being held and the programme therefor was to
\nbe declared on 30th November,2009. Even otherwise, the
\npetition is admitted for consideration of a few larger issues raised
\nby the petitioners including the issue as to whether the authorities
\nwere required to consider, in the facts and circumstances of each
\ncase, the gravity of the misconduct or any disgraceful conduct of the
\ncouncilor and decide upon the effect which may not necessarily be
\nremoval from office as a councilor but removal from particular
\ncommittee.\n<\/p>\n
\t3.\tHaving
\nheard learned counsel and perused the impugned order, it is found to
\nbe not a fit case in which interim relief with implication of a
\nmandatory nature could be granted. Therefore, the prayer for interim
\nrelief is rejected and the petition is ordered to be listed for final
\nhearing in the third week of January,2010.\n<\/p>\n
3.0\tThe
\naforesaid order dated 27.11.2009 was carried  in Letters Patent
\nAppeal being Letters Patent Appeal No. 2351 of 2009 wherein the
\nHon’ble Division Bench of this Court on 04.12.2009 allowed the appeal
\nand restrained the respondent authorities from holding elections of
\nthe office of Councilors of Palanpur Municipality till final disposal
\nof  Special Civil Application No. 8670 of 2009. Against the order
\ndated 04.12.2009, the respondent authorities approached the  Hon’ble
\nSupreme Court by way of Special Leave to Appeal (Civil) No. CC 7662
\nof 2010. the Hon’ble Supreme Court has passed the following order:\n<\/p>\n
\t Delay
\ncondoned.\n<\/p>\n
\tWe
\nsee from the impugned order that direction had been issued \tby the
\nDivision Bench that the case shall be disposed on on 14th
\n\tDecember, 2009. The learned counsel for the petitioner however
\n\tinformed us that matter is still pending. We accordingly request
\n\tthe Hon’ble Judge before whom the matter is pending to dispose \tof
\nthe writ petition within a period of three months from the date of
\n\tthe receipt of the order.\n<\/p>\n
\tThe
\nSpecial Leave Petition is disposed of.\n<\/p>\n
4.0.\n<\/p>\n
In view of the above, the order of the Division Bench was not
\ndisturbed since matter is fixed on 04.12.2009.  Thereafter Civil
\nApplication was moved on 27.09.2010 in which following order was
\npassed on 30.09.2010.\n<\/p>\n
\t To
\nbe listed along with the main matter on a separate Board on
\n\t01.10.2010.\n<\/p>\n
\tIt
\nis, however, made clear that if the matter could not be taken up \tfor
\nfinal hearing on the fixed date, then it shall be open to the \tCourt
\nto pass an order permitting the applicants to file the forms \tfor
\ncontesting the ensuing elections.\n<\/p>\n
5.0\tThe
\nmatter was adjourned  to today at the  request of learned Additional
\nAdvocate General. Today because of paucity of time,  the matter could
\nnot be taken up for hearing. Now the election programme is produced
\non record.\n<\/p>\n
6.0\tIn
\nthat view of the matter, if no relief is granted at this stage
\nirreversible situation is likely to be arisen inasmuch as the last
\ndate of acceptance of form  for contesting the election  is
\n04.10.2010, the scrutiny is fixed on 06.10.2010 and elections are to
\nbe conducted on 21.10.2010. In that view of the matter, to protect
\nthe interest of both the sides, the petitioner will be allowed to
\nsubmit their form for contesting the election. The Nomination papers
\nwill be accepted and it will be scrutinized.  The nomination papers
\nmay not be rejected on the ground that the petitioners are
\ndisqualified under Section 37 of the Gujarat Municipalities Act or
\nremoved under Section 37 of the Gujarat Municipalities Act. However,
\nit is clarified that acceptance of nominations  will be subject to
\nthe result of the main petition.\n<\/p>\n
7.0\tIt
\nis  also made clear that the even if  nomination papers are accepted
\npursuant to this order, and if ultimately the applicants are not
\neligible to contest the election, the nomination forms will be
\ndeemed to be rejected  and  no  further contention will be accepted
\nby either side. The Civil Application stands disposed of. Direct
\nservice is permitted today.\n<\/p>\n
8.0\tThe
\nmain matter being Special Civil Application No. 8670 of 2009 is
\nperemptorily fixed on 04.10.2010 at 2.30 p.m. <\/p>\n
