KURDUKAR, J.\n<\/p>\n<p>     The appellants-accused  nos. 1  and 2 respectively were<br \/>\nput up\tfor trial before the Judge, Special Court, Ferozepur<br \/>\nfor offences punishable under Sections 302\/34 and 363 of the<br \/>\nIndian Penal  Code., They  were tried  by the Special Court,<br \/>\nunder the Terrorist Affected Areas (Special Courts) Act. The<br \/>\nappellants have\t filed this criminal appeal under Section 14<br \/>\nof the Terrorist Affected Areas (Special Courts) Act.\n<\/p>\n<p>2. The prosecution case may be summarized as under:\n<\/p>\n<p>     Karam Singh  (A-1) is  the father of Piara Singh(PW 2).<br \/>\nSardara Singh  (A-2) was  the employee.\t of A-1. There was a<br \/>\ndispute between\t A-1 and  Piara Singh  (RW 2) as regards the<br \/>\npartition of  the-property. Jagir Singh (since deceased) was<br \/>\nrelated to  them. He  intervened in  the matter and effect a<br \/>\npartition between  A-1 and Piara Singh (PW 2). A-1 felt that<br \/>\nthe said  partition was\t totally inequitable and Jagir Singh<br \/>\nhad shown  favour to Piara Singh (PW 2) being related to him<br \/>\nthrough his  wife A-1  and Piara  Singh\t (PW  2)  reside  in<br \/>\nvillage Badhini Kalan.\tPiara Singh  (PW 2) owned a saw mill<br \/>\nSukhdial Singh\t(PW 3)\tused to\t work in  the saw mill it is<br \/>\nalleged by  the prosecution  that on  April 13,\t 1984 in the<br \/>\nevening, Jagir\tsingh had come to the saw mill of Pira Singh<br \/>\n(PW 2).\t At that time Sukhdial Singh (PW 3) was also present<br \/>\nin the saw mill. At about 8.00 p.m., Piara Singh (PW 2) left<br \/>\nhis saw\t mill to  bring food  from his\thouse.\tA-1  at\t the<br \/>\nrelevant time  was also\t having a  shop adjacent  to the saw<br \/>\nmill and  used to  sell fuel wood. A-1 in the mean time came<br \/>\nto the\tsaw mil\t with naked kirpan alongwith A-2. A-1 raised<br \/>\nlalkara that  they would  teach Jagir  Singh  a\t lesson\t for<br \/>\nfavouring  Piara  Singh\t while\teffecting    the  partition.<br \/>\nSuddenly A-1  and A-2  not to  do so.  Noticed the incident,<br \/>\nrequested A-1  and A-2,\t Sukhdial singh\t (PW 3)\t went to the<br \/>\nahata of  A-1 and  knocked the\tdoor put  nobody  responded.<br \/>\nRealizing danger  to the life of Jagir Singh forcibly to the<br \/>\nahata of A-1. Sukhdial Singh (PW 3) went to the ahata of A-1<br \/>\nand knocked  the door put nobody responded. Realising danger<br \/>\nto the\tlife of\t Jagir Singh,  Sukhdial singh (PW 3) went to<br \/>\ninform Piara Singh (PW 2) about the incident. Piara Singh(PW\n<\/p>\n<p>2) then went to the police station, Badhani Kalan and lodged<br \/>\nthe FIR\t 9 Ex.P2  at about  9.00 p.m. The special report was<br \/>\nthen   despatched to  the Illaqa  Magistrate at\t about 11.30<br \/>\np.m. Hans Raj, ASI (PW 5) accompanied by Piara Singh (PW 2)<br \/>\nand other  police officials  went to  the spot. A-1 was then<br \/>\nfound looking  his ahata  and A-2 standing by the side. Both<br \/>\nthe accused  care to  be arrested.  The\t police\t party\tthen<br \/>\nnoticed the  dead body of Jagir Singh which was lying in the<br \/>\nahata. Crime  was then\taltered to  one under Section 302 of<br \/>\nthe Indian  Penal Code-\t Hans Raj,  ASI( PW 5) commenced the<br \/>\ninvestigation. During  the investigation,  parna Ex.M\/O\/5 of<br \/>\nA-2 was\t seized\t since\tit  was\t stained  with\tblood.\tDano<br \/>\nEx.M\/O\/4 which\twas then  with A-2  was also seized. Seizure<br \/>\npanchnama was  then effected. After completing the necessary<br \/>\ninvestigation, both  the accused  were put  up for trial and<br \/>\nthey came  to be  charge sheeted  for of offences punishable<br \/>\nunder Sections 302\/34 and 363 of the Indian Penal Code.\n<\/p>\n<p>3.   Both the  accused denied  the charge  and according  to<br \/>\nthem, they  have been  falsely\timplicated  in\tthe  present<br \/>\ncrime. They  pleaded that  they are  innocent\tand they  be<br \/>\nacquitted\n<\/p>\n<p>4.   It is  not and  cannot be disputed that Jagir Singh met<br \/>\nwith a\thomicidal death.  Dr. Jawahar  Lal, medical officer,<br \/>\nCivil Hospital, Moga, performed the autopsy on the dead body<br \/>\nof Jagir  Singh and  noted as many as twelve injuries out of<br \/>\nwhich three were incised wounds and three were lacerated. In<br \/>\naddition to  that there was a ligature mark around the neck.<br \/>\nDr. Jawahar  Lal (PW 1) has opined that the death was due to<br \/>\nasphyxia as  a result  of strangulation\t and the injuries to<br \/>\nthe head. We see no hesitation in accepting the opinion of<br \/>\nDr. Jawahar Lal (PW 1).\n<\/p>\n<p>5.   The prosecution  in order\tto bring  home the  guilt of<br \/>\nboth the  accused principally  relied upon  the evidence  of<br \/>\nSukhdial Singh\t(PW 3) who witnessed a part of the incident,<br \/>\nnamely, that  both A-1 and A-2 came to the saw mill of Piara<br \/>\nSingh (PW  2) and  forcibly dragged Jagir Singh to the ahata<br \/>\nof A-1.\t Piara Singh  (PW 2)  was examined  to prove that on<br \/>\ngetting the information from Sukhdial Singh (PW 3) about the<br \/>\nincident, went\tto the\tpolice station\tand lodged  the\t FIR<br \/>\nEx.P3 at  about 9.00   p.m. in the same evening. In addition<br \/>\nto the\tformal\t  witnesses,  the  prosecution\trelied\tupon<br \/>\ncertain circumstances  namely recovery\tof parna   and\tdang<br \/>\nfrom the  person of  A-2. Prosecution  also relied  upon the<br \/>\nseizure\t of turban of A-1 Ex.M\/O\/10 which was found lying at<br \/>\nthe entrance of the saw mill of Piara Singh ( PW 2).\n<\/p>\n<p>6.   The learned Trial Judge after appraisal of the oral and<br \/>\ndocumentary evidence  on record\t vide his  impugned judgment<br \/>\ndated 20th  February, 1985  found both the accused guilty of<br \/>\nmurder of  Jagir Singh\tand convicted  them for\t an  offence<br \/>\npunishable under  Section 302  read with  34 of\t the  Indian<br \/>\nPenal Code.  In view of the above finding, the learned Trial<br \/>\nJudge, however,\t did not  record any  conviction against the<br \/>\naccused under  Section 363  of the  India  Penal  Code.\t The<br \/>\nlearned Trial  Judge sentenced\tboth the  accused to  suffer<br \/>\nlife imprisonment.  It\tis  this  order\t of  conviction\t and<br \/>\nsentence passed\t by learned Trial Judge which is the subject<br \/>\nmatter of challenge in this criminal appeal.\n<\/p>\n<p>7.   Mr.Bagga, the  learned Senior  Advocate   appearing  in<br \/>\nsupport of  this appeal\t urged that  there  is\t  no  direct<br \/>\nevidence as regards the fact of murder of Jagir Singh by any<br \/>\nof the\taccused. According to learned  counsel assuming that<br \/>\nJagir Singh  was dragged  by both   the accused from the saw<br \/>\nmill to\t the Ahata of A-1, there is no material on record to<br \/>\nindicate  that\tthey  were  responsible\t for  the  murderous<br \/>\nassault on  Jagir Singh.  He also urged that in the ahata of<br \/>\nA-1, a Transport  Union was also running its office and many<br \/>\ntruck drivers  used to\tpark their vehicles in that area. It<br \/>\nwas, therefore,\t urged that  Jagir  Singh  might  have\tbeen<br \/>\nassaulted by  some unknown  persons, but  the  accused\twere<br \/>\nimplicated in this crime on mere suspicion.\n<\/p>\n<p>     We find  no substance  in any  of\tthese\t contentions<br \/>\nraised on  behalf of  the appellants.  Piara Singh (PW 2) in<br \/>\nhis evidence  has stated  that A-1 was having a grievance as<br \/>\nregards the  partition which was effected by Jagir Singh and<br \/>\nit is  this grouse which was prompted A-1 to lay a murderous<br \/>\nassault on  Jagir singh.  As regards  the presence  of Jagir<br \/>\nSingh on  13th April  1984 in  the evening  at the saw mill,<br \/>\nPiara Singh  (PW 2)  as well  as Sukhdial  Singh (PW 3) have<br \/>\nstated that  Jagir Singh  had come  there and he was sitting<br \/>\nuntil Piara  Singh (PW\t2) left\t for his house at about 8.00<br \/>\np.m. to bring his food. What happened thereafter us narrated<br \/>\nby Sukhdial  Singh(PW 3). He stated that A-1 came to the saw<br \/>\nmill with  naked kirpan\t alongwith Sardara  Singh (A-2)\t and<br \/>\nforcibly dragged  Jagir Singh  from the\t compound of the saw<br \/>\nmill to\t the ahata owned by A-1 He further stated that after<br \/>\ntaking Jagir  Singh into  ahata they  closed the  door.\t The<br \/>\nwitness then  went to  the ahata of A-1 and knocked the door<br \/>\nbut, nobody  opened it.\t He then  went to inform Piara Singh<br \/>\n(PW 2) about this incident who (PW 2) thereafter went to the<br \/>\npolice station\tand lodged  FIR Ex.  P3 at  about 9.00\tp.m.<br \/>\nAfter recording the First Information Report, Hans Raj ASI<br \/>\n(PW S)\taccompanied by\tPiara Singh  (PW 2)  and same police<br \/>\nofficials came to the ahata of A-1.\n<\/p>\n<p>8. Piara  Singh (PW 2) and Sukhdial Singh (PW 3) have stated<br \/>\nthat when  the police  party came  to the ahata of A-1, they<br \/>\nsaw A-1\t was standing  with the blood stained kirpan  in his<br \/>\nhand at\t that place. A-2 was also standing by his side. Both<br \/>\nthe witnesses  further stated  that the\t dead body  of Jagir<br \/>\nSingh was  lying in  that ahata. It needs to be mentioned at<br \/>\nthis stage that at about 8.00 p.m., Jagir Singh was forcibly<br \/>\ndragged by A-1 and A-2 and he was then taken to the ahata of<br \/>\nA-1. The  door of  the ahata was closed and despite knocking<br \/>\nthe said  door by  Sukhdial Singh  (PW 3)  nobody responded.<br \/>\nWithin an  hour, the  police party alongwith Piara Singh (PW\n<\/p>\n<p>2) reached  the ahata  of A-1 and they noticed the dead body<br \/>\nof Jagir  Singh at  that ahata and A-1 and A-2 were standing<br \/>\nnear the  dead body. The only legitimate inference that must<br \/>\nfollow from  the aforementioned evidence is that Jagir Singh<br \/>\nwas done  away with by both the accused in the ahata of A-1.<br \/>\nThere was hardly any time for Piara Singh (PW 2) or Sukhdial<br \/>\nSingh (PW  3) to  concoct a false story against the accused.<br \/>\nWe have carefully gone through the evidence of PW 2 and PW 3<br \/>\nand we\tsee no hesitation in accepting the same as reliable.<br \/>\nThere is  nothing in  their  cross-examination\twhich  would<br \/>\ndiscredit their testimony.\n<\/p>\n<p>9. In  addition to  the\t evidence  that\t we  have  discussed<br \/>\nhereinabove, there  are two other very telling circumstances<br \/>\nwhich are  pointer to  the  guilt  of  the  accused.  During<br \/>\ninvestigation, a turban of A-1 found in the saw mill. It was<br \/>\nseized and  marked as Ex.M\/O\/10. On this turban, name of A-1<br \/>\n(Karam Singh)  was printed.  Seizure of\t this turban  in the<br \/>\ncompound of  saw mill of Piara Singh (PW 2) corroborates the<br \/>\nstory narrated\tby Sukhdial  Singh (PW\t3) that both accused<br \/>\nhad come  to saw  mill\tand  forcibly  dragged\tJagir  Singh<br \/>\ntherefrom. No  exploration whatsoever  is coming from A-1 as<br \/>\nto how\this turban  was found  in the  compound saw  mill of<br \/>\nPiara Singh  (PW 2).  Mr. Bagga,  learnad counsel,  however.<br \/>\nurged that  the seizure of turban Ex.M\/O\/10 is nothing but a<br \/>\nbogus seizure. He urged that such a recovery and seizure has<br \/>\ngot to\tbe rejected because no names are printed on turbans.<br \/>\nWe are\tagain not  impressed by this argument because infact<br \/>\nsuch a\tseizure was  made and  it was  proved  by  the\tPach<br \/>\nwitnesses and the Investigating Officer.\n<\/p>\n<p>10.  The next  connecting circumstance\tis  the\t seizure  of<br \/>\nEx.M\/O\/5 from  the said\t of A-2.  The said  was stained with<br \/>\nhuman blood and the Serologist reported it to be human blood<br \/>\n(Ex. P20).  No explanation whatsoever was given by A-2 as to<br \/>\nhow his\t parna was  stained with human blood. The serologist<br \/>\nin his\treport Ex.P20  also found  that the  earth from\t the<br \/>\nahata of  A-1 and  kirpan seized  from A-1 were stained with<br \/>\nHuman blood. All these circumstance clearly and conclusively<br \/>\nestablish that\tboth the accused were responsible for murder<br \/>\nof Jagir Singh.\n<\/p>\n<p>     It was  then urged\t by Mr.\t Bagga that  it is    highly<br \/>\nimprobable that\t A-1 and A-2 would stand in the ahata with a<br \/>\nnaked kirpan  for more\tthan one hour. The prosecution story<br \/>\nis highly  improbable  and  could  not\tbe  made  basis\t for<br \/>\nconviction. We\tsee no\tmerit in this contention since there<br \/>\nis direct  evidence of Piara Singh (PW 2) and Sukhdial Singh<br \/>\n(PW 3) as also the investigating officer Hans Raj ASI (PW 5)<br \/>\nto establish this fact.\n<\/p>\n<p>12.  In the  result, the  appeal falls\tand  the  same\t  is<br \/>\ndismissed.
