3. Brief facts of the case   <\/p>\n

under its owner, the lorry  acciderjit and he

injuries sustained_    thin the accident<\/p>\n

\ncleaneryving the  registration No. KA– 16\/A-2598<\/p>\n
and the iiahtiiity offthe Insurance Co., the only substantial<\/p>\n

it  _  of  cfairnant at Rs.3,000\/– per month and<\/p>\n

4. I have heard the learned Counsel appearing for<\/p>\n
the parties and perused the judgment and award” of the<\/p>\n
Commissioner.\n<\/p>\n
5. Sri. Pradeep, learned Counsel__ga’r)pearingl’<\/p>\n
Sri. Krishna Swamy, learned   it<\/p>\n
insurance Co. submits that _although- thecgclairnantg <\/p>\n
sustaining injuries in the accident wasltreated in the Govt.
\nHospital, he examined.4_._only–‘_;thieA Vllpirijvate doctor, and even
\naccording to thesaid prixrate doctorfhe’ sustained 60%
\ndisability to the  and the Ciornniissioner is not justified
\nin taking -loss ‘”::ap’acity as 60% and awarding<\/p>\n
compensation oft\/~– and therefore, he prays for<\/p>\n
 , A al1ovw5inlgi’this ai)peal__and reducing the compensation.<\/p>\n
   contra, Sri. Mahesh R.Uppin, the learned<\/p>\n
Counsel’  for the claimant submits that the<\/p>\n
 drawing salary of Rs.4,0{}0\/~ per month<\/p>\n
V’  ‘bata’ of Rs.50\/– per day while working as<\/p>\n
cleaner in the lorry and the salary taken by the<\/p>\n

Commissioner at Rs.3,000\/– is on the lower side. He
\nsubmits, the claimant was initially treated in Govt.
\nHospital, i.e. KJMS, Hubli and thereafter he has””‘tgaken<\/p>\n
treatment in the CG. private hospital and <\/p>\n
in the private hospital was examined  rightiyggl <\/p>\n
assessed the disability to  :at__  if<\/p>\n
Commissioner is justified in riassessing the did-ssyoil earning”,<\/p>\n
capacity at 60% and awarding’vcornperisation.  further
\nsubmits that Commiss_io–ner–fVl is  in awarding
\ninterest from thecdate of ginsteald’ from the date of<\/p>\n
claim petition\ufb01fr _ “ff.\n<\/p>\n
 The  sustained compound fracture<\/p>\n
of left .f_erriur}* I\ufb01leiw.asA”working as a cleaner in a lorry. But<\/p>\n
 “his “eor1’t,ention  was drawing Rs\/1,000\/- excluding<\/p>\n
bata day is not established by examining<\/p>\n
  the the lorry or by producing documentary<\/p>\n

  19 years at the time of accident, nature of job as<\/p>\n

cleaner in the lorry and year of accident is of 2006, the
\nsalary assessed by the Commissioner at Rs.3,000\/- is<\/p>\n
almost equivalent to one prescribed under the <\/p>\n
Wages Act. However, in this appeal \ufb01led by <\/p>\n
Co. I cannot disturb the said \ufb01nding of  <\/p>\n

  claimant, the nature of injuries sustained by him and the<\/p>\n

\nloss of earning capacity of the claimant can be fixed at<\/p>\n
40%. The question of law is answered accordingly.<\/p>\n
