It\u00a0is\u00a0claimed\u00a0that\u00a0the\u00a0petitioner\u00a0was\u00a0appointed\u00a0as\u00a0Assistant\u00a0<br \/>\nTeacher\u00a0(Mathematics)\u00a0on\u00a016.08.1973\u00a0possessing\u00a0the\u00a0qualification\u00a0<br \/>\nof\u00a0B.Sc.\u00a0and\u00a0B.Ed.\u00a0However,\u00a0subsequently\u00a0the\u00a0management\u00a0made\u00a0<br \/>\ncomplaint \u00a0 to \u00a0 the \u00a0 DIOS \u00a0 on \u00a0 30.12.1999 \u00a0 that \u00a0 despite \u00a0 of \u00a0 repeated\u00a0<br \/>\nrequests\u00a0the\u00a0petitioner\u00a0has\u00a0not\u00a0made\u00a0available\u00a0the\u00a0degree\u00a0of\u00a0B.Sc.\u00a0<br \/>\nand\u00a0B.Ed.\u00a0to\u00a0show\u00a0that\u00a0his\u00a0appointment\u00a0of\u00a0Assistant\u00a0Teacher\u00a0was\u00a0<br \/>\nvalid.\u00a0Thereafter\u00a0the\u00a0DIOS\u00a0on\u00a013.01.2000\u00a0directed\u00a0the\u00a0petitioner\u00a0to\u00a0<br \/>\nproduce \u00a0 the \u00a0 said \u00a0 educational \u00a0 documents. \u00a0 The \u00a0 same \u00a0 were \u00a0 not\u00a0<br \/>\nproduced\u00a0by\u00a0the\u00a0petitioner\u00a0despite\u00a0of\u00a0repeated\u00a0opportunity\u00a0granted\u00a0<br \/>\nto\u00a0him.\u00a0Even\u00a0before\u00a0this\u00a0Court\u00a0the\u00a0said\u00a0documents\u00a0have\u00a0not\u00a0been\u00a0<br \/>\nproduced.\u00a0\n<\/p>\n<p>3.    Learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioner \u00a0 said \u00a0 that \u00a0 the \u00a0 original\u00a0<br \/>\ncertificates\/degrees\u00a0were\u00a0handed\u00a0over\u00a0to\u00a0the\u00a0then\u00a0Manager\u00a0in\u00a01990\u00a0<br \/>\npursuant\u00a0to\u00a0an\u00a0audit\u00a0objection\u00a0in\u00a01987\u00ad88\u00a0and\u00a0thereafter\u00a0the\u00a0said\u00a0<br \/>\ndocuments\u00a0were\u00a0not\u00a0returned\u00a0by\u00a0the\u00a0Manager.\u00a0\n<\/p>\n<p>4.    The\u00a0defence\u00a0is\u00a0really\u00a0surprising\u00a0and\u00a0strange\u00a0inasmuch\u00a0as\u00a0the\u00a0<br \/>\n<span class=\"hidden_text\">                                                                                     2<\/span><\/p>\n<p>original\u00a0educational\u00a0certificates\/degrees,\u00a0if\u00a0have\u00a0lost,\u00a0it\u00a0was\u00a0open\u00a0<br \/>\nto \u00a0 the \u00a0 petitioner \u00a0 to \u00a0 obtain \u00a0 duplicate \u00a0 copies \u00a0 thereof \u00a0 from \u00a0 the\u00a0<br \/>\nconcerned \u00a0 University \u00a0 but \u00a0 for \u00a0 the \u00a0 last \u00a0 more \u00a0 than \u00a0 10 \u00a0 years \u00a0 the\u00a0<br \/>\npetitioner \u00a0 could \u00a0 not \u00a0 produce \u00a0 the \u00a0 same \u00a0 which \u00a0 shows \u00a0 that \u00a0 the\u00a0<br \/>\nfinding\u00a0of\u00a0fact\u00a0recorded\u00a0the\u00a0the\u00a0DIOS\u00a0cannot\u00a0be\u00a0said\u00a0to\u00a0be\u00a0perverse.\u00a0<br \/>\nIf \u00a0 the \u00a0 very \u00a0 appointment \u00a0 of \u00a0 the \u00a0 petitioner \u00a0 made \u00a0 on \u00a0 the \u00a0 post \u00a0 of\u00a0<br \/>\nAssistant\u00a0Teacher\u00a0in\u00a01973\u00a0was\u00a0not\u00a0valid\u00a0since\u00a0he\u00a0did\u00a0not\u00a0possess\u00a0<br \/>\nrequisite\u00a0educational\u00a0qualification\u00a0the\u00a0question\u00a0of\u00a0promotion\u00a0to\u00a0the\u00a0<br \/>\npost \u00a0 of \u00a0 Lecturer \u00a0 later \u00a0 on \u00a0 on \u00a0 the \u00a0 basis \u00a0 of \u00a0 qualification \u00a0 of \u00a0 M.A.\u00a0<br \/>\n(History)\u00a0obtained\u00a0by\u00a0him\u00a0subsequently\u00a0would\u00a0not\u00a0arise.\u00a0\n<\/p>\n<p>5.     At \u00a0 this \u00a0 stage, \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioner \u00a0 further\u00a0<br \/>\nsubmitted \u00a0 that \u00a0 after \u00a0 such \u00a0 a \u00a0 long \u00a0 time \u00a0 the \u00a0 validity \u00a0 of \u00a0 the\u00a0<br \/>\nappointment \u00a0 of \u00a0 petitioner \u00a0 as \u00a0 Assistant \u00a0 Teacher \u00a0 cannot \u00a0 be\u00a0<br \/>\nconsidered\u00a0by\u00a0the\u00a0DIOS\u00a0and\u00a0he\u00a0has\u00a0erred\u00a0in\u00a0law\u00a0by\u00a0passing\u00a0the\u00a0<br \/>\nimpugned\u00a0order.\u00a0\n<\/p>\n<p>6.     I \u00a0 find \u00a0 no \u00a0 merit \u00a0 in \u00a0 the \u00a0 submission \u00a0 for \u00a0 the \u00a0 reason \u00a0 that \u00a0 the\u00a0<br \/>\nappointment\u00a0appears\u00a0to\u00a0have\u00a0been\u00a0made\u00a0on\u00a0account\u00a0of\u00a0fraud\u00a0or\u00a0<br \/>\nmisrepresentation. \u00a0Fraud\u00a0 or\u00a0 misrepresentation \u00a0vitiates \u00a0everything\u00a0<br \/>\nand\u00a0the\u00a0consequences\u00a0thereof\u00a0can\u00a0be\u00a0looked\u00a0into\u00a0at\u00a0any\u00a0stage.\u00a0I,\u00a0<br \/>\ntherefore,\u00a0find\u00a0no\u00a0merit\u00a0in\u00a0the\u00a0writ\u00a0petition.\u00a0Dismissed.\u00a0\u00a0<br \/>\nDt.\u00a025.01.2010<br \/>\nAK\u00ad3149\/10\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Uma Nath Dubey vs State Of U.P. &amp;
