        The Board of Management of the Janardan Rai Nagar<\/p>\n
Rajasthan Vidyapeeth (Deemed) University, Udaipur framed<\/p>\n
regulations of the University as per that admission to Master of<\/p>\n
Physiotherapy Course is required to be made by holding an<\/p>\n
entrance examination and by including 25% marks of under-<\/p>\n
graduation examinations and 25% marks from the personal<\/p>\n
interview.\n<\/p>\n<\/p>\n
        For the educational session of 2007-2008 entrance<\/p>\n
examination was conducted and regular admissions were given<\/p>\n
to selected students. The petitioners who were working with the<\/p>\n
University as     Lecturers in the College of Physiotherapy were<\/p>\n
admitted in the course of Master of Physiotherapy under an<\/p>\n
order dated 21.2.2008, though, they did not face the entrance
\n                                  2<\/span><\/p>\n
test.   The petitioners also qualified Ist year examination of the<\/p>\n
Course concerned, however, on 28.5.2009 vice-chancellor of the<\/p>\n
University cancelled their admission provisionally and that was<\/p>\n
made absolute by another order dated 2.3.2010 passed by the<\/p>\n
Registrar. Being aggrieved by the orders dated 2.3.2010 and<\/p>\n
28.5.2010 these petitions for writ are preferred.<\/p>\n
         It is contended by the learned counsel for the petitioners<\/p>\n
that the petitioners were admitted to the course concerned by<\/p>\n
the University in the year 2008 and thereafter, the petitioners<\/p>\n
have undergone the entire course and qualified Ist year<\/p>\n
examination, as such, there is no just reason to cancel their<\/p>\n
admissions. It is also asserted that after making regular<\/p>\n
admissions to the course concerned, the principle of estoppal<\/p>\n
warrants to stop the University from taking the action impugned.<\/p>\n
To substantiate the contentions reliance is placed by the learned<\/p>\n
counsel for the petitioner upon the judgment of      Apex Court in<\/p>\n
Sanatan Gauda Vs. Berhampur University and Ors. (AIR 1990 SC<\/p>\n
1075).\n<\/p>\n<\/p>\n
         A reply to the writ petition has been filed on behalf of<\/p>\n
the respondent University stating therein that the petitioners in<\/p>\n
view of regulations for the Master of Physiotherapy         degree<\/p>\n
course with the University are not at all eligible to continue as
\n                                 3<\/span><\/p>\n
such. The petitioners never faced the selection process and they<\/p>\n
were not at all selected for admission to Master of Physiotherapy<\/p>\n
course, therefore, cancellation of their admission, suffer from no<\/p>\n
error.\n<\/p>\n<\/p>\n
         It is also pointed out that on 6.12.2007, a decision was<\/p>\n
taken by the competent committee of the University not to<\/p>\n
permit any employee of the University for admission in the<\/p>\n
course of Master of Physiotherapy. In the decision aforesaid,<\/p>\n
Principal of the Institution Shri Shailendra Mehta was also a<\/p>\n
party. Despite that, alongwith the petitioners, he too was<\/p>\n
admitted with the post-graduation course in Physiotherapy.<\/p>\n
         Learned counsel for the respondent University urged<\/p>\n
that admission was given to the petitioner in view of a note<\/p>\n
made by the Registrar of the University under the instructions of<\/p>\n
the then Vice-chancellor to the fact that the teachers, who have<\/p>\n
already been admitted to the course be allowed to continue as<\/p>\n
such. The note aforesaid is dated 13.12.2008 and as such, the<\/p>\n
admission to the petitioners subsequent thereto is illegal. Certain<\/p>\n
facts are also stated in the reply to the writ petition regarding<\/p>\n
the wrongs made in wholesome by some officers of the<\/p>\n
University while making admissions in the course of Master of<\/p>\n
Physiotherapy.\n<\/p>\n
                                       4<\/span><\/p>\n
          No rejoinder to the reply has been filed by the<\/p>\n
respondents.\n<\/p>\n<\/p>\n
          Heard learned counsel for the parties.\n<\/p>\n
          During the course of arguments, learned counsel for the<\/p>\n
petitioners accepted the position that the petitioners did not face<\/p>\n
the process of selection as prescribed under the regulations,<\/p>\n
meaning     thereby,   that    they       did   not   face   the   entrance<\/p>\n
examination. The fact that the petitioners are in employment of<\/p>\n
the respondent is also not in dispute. It is really strange that the<\/p>\n
petitioners, who were part of teaching staff             of the University,<\/p>\n
knowing it well that they have not participated in entrance test<\/p>\n
applied    for   admission    in   the     course     concerned    and   got<\/p>\n
themselves admitted. While making admission to public courses,<\/p>\n
the Universities created under or by a statute are suppose to act<\/p>\n
fairly and in just manner, but in the instant matter, the benefit<\/p>\n
extended to the petitioners is same thing extra being absolutely<\/p>\n
in contravention of the regulations for admission. It is pertinent<\/p>\n
to note that the Board of Management of the University decided<\/p>\n
for not admitting its employees for post-graduation course in<\/p>\n
Physiotherapy, despite of that the Vice-chancellor made a note<\/p>\n
contrary and granted admission to the petitioners against the<\/p>\n
policy applicable for making such admissions. Counsel for the
\n                                           5<\/span><\/p>\n
      petitioner failed to point out availability of any such power to the<\/p>\n
      Vice-chancellor. It is further relevant to mention here that the<\/p>\n
      note made by the Registrar in pursuant to certain instructions<\/p>\n
      given by the Vice-chancellor dated 3.12.2007 is and to the effect<\/p>\n
      that   the    admission     now   made     be     cancelled.   In   such<\/p>\n
      circumstances, even if it is assumed that the Vice-chancellor is<\/p>\n
      having some power to take a decision contrary to the resolution<\/p>\n
      of the Board of Management,              then too admission of the<\/p>\n
      petitioners is not valid.\n<\/p>\n<\/p>\n
              So far as the arguments of the learned counsel for the<\/p>\n
      petitioners   that   the    University   should   be   estopped     from<\/p>\n
      cancelling the admission is concerned, suffice it to mention that<\/p>\n
      the petitioners knowing it well that they were not eligible for<\/p>\n
      admission to the concerned course, obtained admission by<\/p>\n
      adopting wrong means, thus, the doctrine of estoppal cannot be<\/p>\n
      extended to the petitioners who themselves are part of a fraud<\/p>\n
      played while getting admission in the course.<\/p>\n
              In view of whatever said above, the petitions for writ<\/p>\n
      fail, thus are dismissed.\n<\/p>\n
