It was further<br \/>\nsubmitted that Section 56(b) of the Bombay Police Act does not<br \/>\nempower the Sub-Divisional Magistrate to direct payment of surety for<br \/>\ngood behaviour.\n<\/p>\n<p>3.\t\tIt<br \/>\nwas accordingly submitted that the impugned order, being in breach of<br \/>\nthe principles of natural justice as well as being beyond the powers<br \/>\nof the Sub-Divisional Magistrate under Section 56(b) of the Bombay<br \/>\nPolice Act, is required to be quashed and set aside.\n<\/p>\n<p>4.\t\tFrom<br \/>\nthe facts of the case, it is apparent that by the show-cause notice<br \/>\ndated 21st January, 2008, the petitioner was called upon<br \/>\nto show cause, in the context of four offences registered against<br \/>\nhim, as to why he should not be externed from the limits of the<br \/>\ndistricts noted hereinabove.  Pursuant to the reply given by the<br \/>\npetitioner, the Sub-Divisional Magistrate did not find it necessary<br \/>\nto extern the petitioner.  However, vide the impugned order dated<br \/>\n31st May, 2008, the Sub-Divisional Magistrate has directed<br \/>\nthe petitioner to deposit Rs.20,000\/-  towards surety for good<br \/>\nbehaviour for a period of two years.\n<\/p>\n<p>5.\t\tAn<br \/>\norder passed under Section 56(b) of the Bombay Police Act is amenable<br \/>\nto appeal under Section 60 of the Act.  However, as held by this<br \/>\ncourt in the case of <a href=\"\/doc\/113698700\/\">Hasmukhbhai C. Brahmbhatt vs. Sub<br \/>\nDivisional Magistrate<\/a><br \/>\nrendered on 05th April, 2002 in Special Criminal<br \/>\nApplication No.4 of 2002, when no order of externment has been<br \/>\npassed, there is no order passed in the exercise of powers under<br \/>\nSections 55, 56 and 57 of the Act.  When there is no order under<br \/>\nthose provisions of the Bombay Police Act, the question of filing<br \/>\nappeal under Section 60 of the said Act does not arise.  The Court,<br \/>\nin a similar set of facts, found that  in view of the fact that the<br \/>\nproceedings were started for externment of the petitioner and the<br \/>\nlearned Executive Magistrate was satisfied that there was no ground<br \/>\nto extern the petitioner, the Executive Magistrate could not have<br \/>\npassed the order requiring the petitioner to furnish a surety, as has<br \/>\nbeen done by him.\n<\/p>\n<p>6.\t\tThe<br \/>\naforesaid decision would apply on all fours to the facts of the<br \/>\npresent case.  In the present case also, the petitioner had been<br \/>\ncalled upon to show cause as to why he should not be externed, in<br \/>\nexercise of powers under Section 56(b) of the Act.  The show-cause<br \/>\nnotice does not call upon the petitioner to show cause as to why he<br \/>\nshould not be directed to furnish surety.  In the circumstances, the<br \/>\norder directing the petitioner to furnish surety for good behaviour<br \/>\nis violative of the principles of natural justice and as such, cannot<br \/>\nbe sustained.\n<\/p>\n<p>7.\t\tFor<br \/>\nthe foregoing reasons, the petition is allowed.  The impugned order<br \/>\ndated 31st May, 2008 passed by the learned Sub-Divisional<br \/>\nMagistrate, Mahuva in Externment Case No.11 of 2007 is hereby quashed<br \/>\nand set aside.
