Justice S.S.SATHEESACHANDRAN\n\n Dated :15\/09\/2009\n\n O R D E R\n              S.S.SATHEESACHANDRAN, J.\n                  -------------------------------\n                 C.R.P.NO.501 OF 2009 ()\n                -----------------------------------\n      Dated this the 15th day of September, 2009\n\n                          O R D E R\n<\/pre>\n<p>      Revision is directed against the order passed by the<\/p>\n<p>learned    Munsiff-Magistrate    Court,    Sasthamcotta  in  an<\/p>\n<p>application moved under Order XXI Rule 32 of the Code of<\/p>\n<p>Civil Procedure by the respondents\/decree holders.         The<\/p>\n<p>respondents moved the above application alleging that the<\/p>\n<p>decree passed in the above suit, which was one for injunction,<\/p>\n<p>was violated by the petitioner\/judgment debtor.       The court<\/p>\n<p>below, on the evidence tendered in the application holding<\/p>\n<p>that the judgment debtor has not obeyed the decree, ordered<\/p>\n<p>for issuing warrant to arrest and produce him for the purpose<\/p>\n<p>of committing to prison. Propriety and correctness of that<\/p>\n<p>order is challenged in the revision.\n<\/p>\n<\/p>\n<p>      2. I heard the learned counsel for the petitioner. Having<\/p>\n<p>regard to the submissions made and taking note of the facts<\/p>\n<p><span class=\"hidden_text\">CRP.501\/09                      2<\/span><\/p>\n<p>and circumstances presented with reference to the order<\/p>\n<p>impugned, I find no notice to the respondents is necessary,<\/p>\n<p>and, hence, it is dispensed with.           Perusing the order<\/p>\n<p>challenged in the revision, I find it is patently erroneous and<\/p>\n<p>unsustainable under law. The court below has not adverted to<\/p>\n<p>the evidence let in the case nor entered any specific finding in<\/p>\n<p>what manner the petitioner\/judgment debtor violated the<\/p>\n<p>decree of injunction. In an enquiry under Order XXI Rule 32<\/p>\n<p>of the Code of Civil Procedure it is incumbent upon the court<\/p>\n<p>to enter a   definite finding that the judgment debtor had<\/p>\n<p>violated the decree. It is not sufficient to show that he had not<\/p>\n<p>obeyed the decree. To proceed under the above rule, it must<\/p>\n<p>be satisfactorily established that the judgment debtor flouted<\/p>\n<p>and violated the decree. More than that, it is also seen, under<\/p>\n<p>the impugned order, the learned Munsiff has directed for<\/p>\n<p>issuing warrant to the petitioner directing his production to<\/p>\n<p>commit him to prison without ordering what is the term of<\/p>\n<p>detention.   Such orders cannot be passed by a court of law.<\/p>\n<p>The court has to pass orders, if it is satisfied that there is<\/p>\n<p>violation of the decree, as contemplated under Order XXI<\/p>\n<p><span class=\"hidden_text\">CRP.501\/09                    3<\/span><\/p>\n<p>Rule 32 of the CPC.     Setting aside the impugned order, I<\/p>\n<p>direct the court below to consider the matter afresh and pass<\/p>\n<p>appropriate orders in accordance with law taking note of the<\/p>\n<p>observations made above.
