The material facts of the prosecution case disclosed that,
\none Madhusudhan (deceased) is a boy aged about 12 years
\nstudying in Adichunchangiri Boarding School at Belliir. One<\/p>\n
Smt.Sujatha — PW6 is the mother of the deceased. Thiexdselceased<\/p>\n
is deserted by a husband PW9 about seven years’ <\/p>\n
incident. The deceased is the child born-to  ‘ . <\/p>\n
with ewe. The accused developed iel:meey\u00bbi'[iiii-ad<\/p>\n
live–in relationship with hers ‘\ufb01Li}.\ufb01 accused the’<\/p>\n
deceased was found to be impedim;en_t”for his”1<elatl(:\u20acI1ship with
\nPW6. Therefore, he Went "to   school, took the
\ndeceased with him Vfromi'l'Belliirl toju\ufb01otel  Srirangapatna on<\/p>\n
16.9.20f}3. -He l rlooi:rr–~.i11 -the lodge giving his name as<\/p>\n
K.Raju, resid_encel'of Bangalore, signed the hotel<\/p>\n
 register in. the said name. The deceased and accused lived in<\/p>\n
 roor;_1li%'o:1A2..4Et–..vis stated that, accused administered a poison<\/p>\n
  who after consuming the food died. The<\/p>\n
is _ accus~ed.Wentl"'out of the hotel around 10.30 p.m. On the next<\/p>\n
is  Vlpdayyimorning at 7.30 a.m. PW1 found through window the child<\/p>\n
   the \ufb02oor. PW} lodged the complaint. The police break<\/p>\n
is  * open the door and found the child lying dead.<\/p>\n
2. The post mortem report disclosed that, the death is on<\/p>\n
account of respiratory failure on account of consumption of zinc<\/p>\n

\nphosphate \u00ab~ poison. The death is homicidal. The accused is
\narrested on 5.11.2003. The accused is identified by PW} in the
\nTest Identi\ufb01cation Parade conducted by PW13. The statements
\nof the schooi children PW3 and PW-4 is recorded. It shogwsggthat,<\/p>\n
accused had come and took the deceased with <\/p>\n
on the date of the incident. The accused__” <\/p>\n
committing the offence under Section.stA3(\u00a72,’    _g  <\/p>\n
3. PW1 supports the prosccutioncase anci.vhas’ deposed  u<\/p>\n

\nstating his name as  ofiRaj’ai_inagar, Bangalore.<\/p>\n

accused and\u00e9ainote’boo1:\u00bb–co’ntaining the admitted handwriting of<\/p>\n
 accusedtvwere seizedand sent to handwriting expert. The report<\/p>\n
  tha_t,.:4A’admitted handwriting in the note book, the<\/p>\n
 \ufb01aindjxrriting in the hotel register are of the same<\/p>\n
V — Derson. v–i5W’1:”‘ has also identified the accused in the Test<\/p>\n
 .Vident_ification Parade conducted by PW13. The schooi children<\/p>\n
  and PW4 testified to the fact that, on 16.9.2003 around<\/p>\n
it   p.II1. the accused had come and took the deceased with<\/p>\n
” him. They have identi\ufb01ed the accused in the Court. The accused<\/p>\n
in the examination under Section 313 Cr.P.C. does not deny the<\/p>\n
seizure of notebook — EX.P21 and his admitted signatures. The<\/p>\n

evidence clinchingly establish the guilt of
