SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/11\/2008 \n\n \n\n \n \n\n\n \n\n \n \n\n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent Appeal from Order  is filed by the appellant-original<br \/>\nplaintiff under Order 43 Rule 1(r) of the Code of Civil Procedure<br \/>\nchallenging the order passed by the learned 7th Additional<br \/>\nSenior Civil Judge and Judicial Magistrate First Class,  Surat dated<br \/>\n24\/01\/2008 below Exh. 5 in Special Civil Suit No. 243\/2007 by which<br \/>\nthe learned trial Court has dismissed the application, Exh. 5, which<br \/>\nwas submitted by the appellant-original plaintiff for interim<br \/>\ninjunction restraining the respondents-original defendants  from<br \/>\ntransferring, alienating and\/or selling the property in question.\n<\/p>\n<p>2.\tThe<br \/>\nappellant-original plaintiff had filed Special Civil Suit No.<br \/>\n243\/2007 for partition of the properties described in the plaint<br \/>\nalongwith the schedule contending interalia that the suit properties<br \/>\nin question are the ancestral HUF properties and in view of the<br \/>\namendment in the Hindu Succession (Amendment) Act, 2005, she has got<br \/>\nequal right in the ancestral property.  The application, Exh. 5 was<br \/>\nopposed by the respondents-original defendants by submitting that in<br \/>\nfact the properties in question have been disposed of and\/or<br \/>\ntransferred by will executed by their grandfather, Purshotambhai<br \/>\nHirabhai Patel, which was executed in 1989 and, therefore, respondent<br \/>\nno. 1-original defendant no. 1 has become<br \/>\nthe owner and the parties have acted as per the same.  It was the<br \/>\ncontention on behalf of the appellant-original plaintiff that the so<br \/>\ncalled will cannot be termed as a will but at the most it can be said<br \/>\nto be a family arrangement.  Considering the fact that  some of the<br \/>\nproperties were already sold much prior to filing of the suit and<br \/>\nafter considering the submissions made on behalf of the parties, the<br \/>\nlearned trial Court dismissed the application, Exh. 5 by the impugned<br \/>\norder.  Hence, the appellant-original plaintiff has preferred the<br \/>\npresent Appeal from Order.\n<\/p>\n<p>3.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and assuming for the sake of argument that the documents,<br \/>\nwhich has been relied upon by the respondents-original defendants,<br \/>\nwhich according to them, was a will can be termed as a family<br \/>\narrangement then in that case also the said family arrangement was in<br \/>\nthe year 1989 and the parties were required to act as per the same<br \/>\nsince 1989.  Considering the facts and circumstances of the case,<br \/>\nmore particularly, when some of the properties have already been sold<br \/>\nprior to filing of the suit and considering the documents on record,<br \/>\nwhen the suit has been filed in the year 2007, in the facts and<br \/>\ncircumstances, it cannot be said that the learned trial Court has<br \/>\ncommitted an error.    However,   while disposing of the present<br \/>\nAppeal from Order, it is observed that any transfer to be made,<br \/>\nexpect the properties, which are sold prior to filing of the suit,<br \/>\nwill be subject to ultimate outcome of the suit and after informing<br \/>\nthe learned trial Court by purshis with  respect to such a transfer.\n<\/p>\n<p>4.<br \/>\n For the reasons stated hereinabove and without further expressing<br \/>\nany opinion on merits, the present Appeal from Order is dismissed<br \/>\nwith the above observation that any transfer herein made, except the<br \/>\nproperties which are sold prior to filing of the suit, will be<br \/>\nsubject to the ultimate outcome of the suit and as and when the<br \/>\nproperties are transferred, the respondents-original defendants shall<br \/>\ninform the learned trial Court by purshis with respect to such a<br \/>\ntransfer.  If the pleadings are completed, the learned trial Court is<br \/>\ndirected to  decide and dispose of the suit as expeditiously as<br \/>\npossible.  All the parties concerned are directed to cooperate with<br \/>\nthe learned Judge  for early disposal of the suit.  If the pleadings<br \/>\nare not completed, the parties are directed to complete the pleadings<br \/>\nwithin a period of four months from today.
