JAYACHANDRA (J)\n\nCITATION:\n 1992 AIR 1553\t\t  1992 SCR  (2) 307\n 1992 SCC  (2) 721\t  JT 1992 (2)\t374\n 1992 SCALE  (1)740\n\n\nACT:\n     Kerala Agriculturists Debt Relief Act, 1970-Section 20-\nDebt Relief Petition under-Requirement for  maintainability-\nObject\t of   Legislation-Inter-pretation   beneficial\t  to\npeasantry  to  be accepted-Cost of  Improvements  and  mesne\nprofits whether payable.\n\n\n\nHEADNOTE:\n     In\t execution  of\ta money decree,\t a  court-sale\ttook\nplace.\t Three pieces of agricultural land of the  judgment-\ndebtor-respondent  were put to auction.\t The  decree-holder-\nappellant purchased the same.\n     Item Nos.1 and 2 of the auctioned property remained  in\npossession  of the respondent, but item no. 3 went into\t the\npossession of the appellant.\n     The respondent approached the executing court filing  a\npetition u\/s. 20 of the Kerala Agriculturists Act, 1970, for\nretrieval  of the entire property on the basis that  he\t had\ncontinued to be in possession of a part of it.\n     The  appellant  contested\tthe  Debt  Relief   Petition\ncontending  that as the respondent was not in possession  of\nthe entire property, Section 20 of the Act was\tinapplicable\nand that in case it was then before possession of  property,\nitem no. 3 could be asked to be given, cost of\timprovements\nhad to be paid under sub-section (5) of Section 20.\n     All the courts below decided against the appellant.\n     This appeal by special leave was confined to a claim to\nproperty Item No. 3 of the Debt Relief Petition.\n     Dismissing the appeal of the decree-holder, this Court,\n     HELD : 1.01. The Kerala Agriculturists Debt Relief\t Act\nis a local legislation and had come to give some succour  to\nthe  indebted agriculturists.  The conditions which  led  to\nthe passing of such legislation\n\t\t\t\t\t\t  308\npresumably  were well known to the Kerala State\t Legislature\nand the pulse of it was felt by the High Court Kerala in its\nInterpretive role. [309D]\n     1.02. The sale conceived of under Section 20 is one and\nindivisible  and when it is required to be set aside only  a\nportion\t of the property  sold need be in possession of\t the\njudgment-debtor\t to make him eligible to maintain  the\tDebt\nRelief Petition. [309E]\n     1.03.  An\tinterpretation, beneficial as it is  to\t the\nindebted peasantry is approved.\t The courts below as well as\nthe  High Court let the respondent maintain his Debt  Relief\nPetition.   Such  a  course  is\t concurred  with.   Sequally\nproperty item no. 3 has also to be retrieved from the  hands\nof the appellant. [309F]\n     1.04.  In\tthe  interests of justice,  neither  is\t the\nappellant  held\t entitled to any cost  of  improvements\t nor\nwould he be liable for payment of any mesne profits for\t the\npreceding three years. Nair for the Respondent.\n<\/p>\n<p>     The Order of the Court was delivered:\n<\/p>\n<p>     The  appeal by special leave is confined to a claim  to<br \/>\nproperty  Item\tNo.  3 of the Debt  Relief  Petition,  which<br \/>\nsucceeded in th courts below.\n<\/p>\n<p>     In execution of a money decree a court-sale took  place<br \/>\nin which three pieces of agricultural land of the  judgment-<br \/>\ndebtor, respondent herein, was put to auction and  purchased<br \/>\nby  the decree-holder, the appellant herein.  On  the  facts<br \/>\nfound by the courts below item Nos. 1 and 2 of the auctioned<br \/>\nproperty remained in possession of the respondent, but\titem<br \/>\nNo.  3\twent  into the possession  of  the  appellant.\t The<br \/>\nrespondent taking the aid of<br \/>\n<span class=\"hidden_text\">\t\t\t\t\t\t  309<\/span><br \/>\nSection\t 20  of the Kerala Agriculturists Debt\tRelief\tAct,<br \/>\n1970,  approached the executing court for retrieval  of\t the<br \/>\nentire property on the basis that he had continued to be  in<br \/>\npossession of atleast a part of it, i.e., two survey numbers<br \/>\nas itemized.  The Debt Relief Petition was contested by\t the<br \/>\nappellant  herein  on the ground that  since  the  judgment-<br \/>\ndebtor-respondent  was\tnot  in\t possession  of\t the  entire<br \/>\nproperty,  Section 20 of the aforesaid Act was\tinapplicable<br \/>\nand  in case it was then before possession of property\titem<br \/>\nNo. 3 could be asked to be given cost of improvements had to<br \/>\nbe  paid  under\t sub-section (5) of Section  20,  which\t the<br \/>\nappellant  assessed  at\t Rs. 2,000.  All  the  courts  below<br \/>\ninclusive of the High Court have gone against the  appellant<br \/>\nand  the  dispute  herein, as said before,  is\tconfined  to<br \/>\nproperty item No. 3.\n<\/p>\n<p>     The above-named Act is a local legislation and had come<br \/>\nto  give some succour to the indebted  agriculturists.\t The<br \/>\nconditions  which  led to the passing  of  such\t legislation<br \/>\npresumably  were well known to the Kerala State\t Legislature<br \/>\nand the pulse of it was felt by the High Court of Kerala  in<br \/>\nits  interpretive  role.  There are two\t decisions  of\tthat<br \/>\nCourt in support of the claim of the respondent.  The  first<br \/>\none  is by a Division Bench, i.e., 1960 KLT 163 titled\tSyed<br \/>\nMohammed  Beevi Amma v. Mathai Devasia followed by a  single<br \/>\nbench  in  1963\t KLT 886 titled\t Ramasuppa  Iyer  v.  Daveed<br \/>\nChristudas  (even  though  passed on  the  earlier  statute)<br \/>\nwherein\t it has been held that the sale conceived  of  under<br \/>\nSection 20 is one and indivisible and when it is required to<br \/>\nbe set aside only a portion of the property sold need be  in<br \/>\npossession  of the judgment-debtor to make him\teligible  to<br \/>\nmaintain the Debt Relief Petition.  These two decisions have<br \/>\ngoverned  the  field  without any discordant  note  in\tthat<br \/>\nState.\t We  will  rather frown on  setting  aside  such  an<br \/>\ninterpretation,\t  beneficial  as  it  is  to  the   indebted<br \/>\npeasantry.   The  courts  below as well as  the\t High  Court<br \/>\nfollowed these decisions in letting the respondent  maintain<br \/>\nhis  Debt  Relief petition.  We concur with such  a  course.<br \/>\nSequally  property item No. 3 has also to be retrieved\tfrom<br \/>\nthe   hands   of  the  appellant.   We\t order\t accordingly<br \/>\nmaintaining the judgment and orders of the courts below.\n<\/p>\n<p>     The   appellant   laid  a\tclaim  of  Rs.\t 2,000\t for<br \/>\nimprovements wayback in the year 1970.\tA period of over  20<br \/>\nyears  has passed by.  It would be fair to presume that\t the<br \/>\nappellant  has\tderived the fruits of  the  improvements  in<br \/>\nthese past years.  It would also be fair correspondingly  to<br \/>\nassume\tthat on the maintenance of the orders of the  courts<br \/>\nbelow he would be liable to<br \/>\n<span class=\"hidden_text\">\t\t\t\t\t\t  310<\/span><br \/>\npay  mesne profits for the preceding three years  on  having<br \/>\nremained  in  possession  of the property item\tNo.  3.\t  We<br \/>\nsquare\tthese  two claims in the interests  of\tjustice\t and<br \/>\nclose the matter.  Neither is the appellant held entitled to<br \/>\nany cost of improvements nor would he be liable for  payment<br \/>\nof any mesne profits for the preceding\tthree years.
