PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 31\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\t\tRULE.\n<\/p>\n<p>Learned APP, waives service of notice of rule on behalf of the<br \/>\nrespondent-State.\n<\/p>\n<p>1.\t\tLearned<br \/>\nCounsel for the petitioner submitted that the investigation is over<br \/>\nand the charge-sheet is also filed. He, further, submitted that,<br \/>\ninsofar as the present case is concerned, the main allegation is that<br \/>\nthe petitioner had produced false details of his address etc., for<br \/>\nsecuring a residential premises on rent.\n<\/p>\n<p>2.\t\tConsidering<br \/>\nthe above prima facie<br \/>\naspects of the matter and considering<br \/>\nthat the trial is unlikely to complete shortly and since<br \/>\ncharge-sheet is also filed,<br \/>\nI find this is a fit case for granting bail. Under the circumstances,<br \/>\nthe petitioner is ordered to be released on bail in connection with<br \/>\nC.R. NO. I-392\/2010,<br \/>\nregistered with NAVRANGPURA<br \/>\nPOLICE STATION,<br \/>\nDistrict : Ahmedabad, for the offences punishable under Sections-406,<br \/>\n420, 467, 468 and 471 of the Indian Penal Code, on his furnishing<br \/>\nbond of Rs.25,000\/-(Rupees Twenty Five Thousand), with one surety of<br \/>\nthe like amount to the satisfaction of the lower Court and subject to<br \/>\nthe conditions that, he shall:\n<\/p>\n<p>(1).\t\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>(2).\t\tnot act in a<br \/>\nmanner injurious to the interest of the prosecution;\n<\/p>\n<p>(3).\t\tmaintain law and<br \/>\norder;\n<\/p>\n<p>(4).\t\tmark his presence<br \/>\nbefore the concerned Police Station on every 1st and 15th<br \/>\nday of English Calendar month between 11:00 a.m. to 2:00 p.m.;\n<\/p>\n<p>(5).\t\tnot leave the<br \/>\nState of Gujarat without prior permission of the Sessions  Judge<br \/>\nconcerned;\n<\/p>\n<p>(6).\t\tfurnish the<br \/>\naddress of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of  this<br \/>\nCourt;\n<\/p>\n<p>(7).\t\tsurrender his<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>3.\t\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>4.\t\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>5.\t\tRule<br \/>\nis made absolute.
