2.      In\u00a0this\u00a0case,\u00a0the\u00a0Appellant\u00a0had,\u00a0in\u00a0his\u00a0application\u00a0dated\u00a024\u00a0November\u00a0<\/p>\n
2008, \u00a0 raised \u00a0 a \u00a0 large \u00a0 number \u00a0 of \u00a0 queries \u00a0 regarding \u00a0 the \u00a0 cash \u00a0 credit \u00a0 limit\u00a0<\/p>\n
sanctioned\u00a0to\u00a0M\/s\u00a0Pelican\u00a0Corporation.\u00a0In\u00a0his\u00a0reply\u00a0dated\u00a012\u00a0January\u00a02009,\u00a0the\u00a0<\/p>\n
CPIO\u00a0observed\u00a0that\u00a0the\u00a0information\u00a0fell\u00a0in\u00a0the\u00a0exempted\u00a0category\u00a0under\u00a0Section\u00a0<\/p>\n
8(1) \u00a0 (d) \u00a0 of \u00a0 the \u00a0 Right \u00a0 to \u00a0 Information \u00a0 (RTI) \u00a0 Act \u00a0 and, \u00a0 therefore, \u00a0 could \u00a0 not \u00a0 be\u00a0<\/p>\n
disclosed.\u00a0Against\u00a0this\u00a0decision\u00a0of\u00a0the\u00a0CPIO,\u00a0the\u00a0Appellant\u00a0preferred\u00a0an\u00a0appeal\u00a0<\/p>\n
on\u00a01\u00a0February\u00a02009.\u00a0The\u00a0Appellate\u00a0Authority\u00a0disposed\u00a0of\u00a0the\u00a0appeal\u00a0in\u00a0his\u00a0order\u00a0<\/p>\n
dated\u00a019\u00a0March\u00a02009\u00a0by\u00a0endorsing\u00a0the\u00a0decision\u00a0of\u00a0the\u00a0CPIO.\u00a0It\u00a0is\u00a0against\u00a0this\u00a0<\/p>\n
order\u00a0that\u00a0the\u00a0Appellant\u00a0has\u00a0come\u00a0to\u00a0the\u00a0CIC\u00a0in\u00a0second\u00a0appeal.<\/p>\n

 3.      We \u00a0 heard \u00a0 this \u00a0 case \u00a0 through \u00a0 video \u00a0 conferencing. \u00a0 The \u00a0 Appellant \u00a0 was\u00a0<\/p>\n
present\u00a0in\u00a0the\u00a0Vadodara\u00a0studio\u00a0of\u00a0the\u00a0NIC.\u00a0The\u00a0Respondents\u00a0were\u00a0present\u00a0in\u00a0<\/p>\n
both\u00a0the\u00a0the\u00a0Vadodara\u00a0and\u00a0the\u00a0Mumbai\u00a0studios.\u00a0We\u00a0heard\u00a0their\u00a0submissions.\u00a0<\/p>\n
Admittedly,\u00a0the\u00a0Appellant\u00a0has\u00a0no\u00a0direct\u00a0relationship\u00a0with\u00a0the\u00a0above\u00a0borrower\u00a0<\/p>\n
and\u00a0his\u00a0CC\u00a0account\u00a0and,\u00a0to\u00a0that\u00a0extent,\u00a0the\u00a0denial\u00a0of\u00a0information\u00a0by\u00a0the\u00a0CPIO\u00a0is\u00a0<\/p>\n
understandable.\u00a0However,\u00a0during\u00a0the\u00a0hearing,\u00a0the\u00a0Appellant\u00a0submitted\u00a0that\u00a0the\u00a0<\/p>\n
Bank\u00a0had\u00a0since\u00a0started\u00a0recovery\u00a0proceedings\u00a0against\u00a0the\u00a0borrower\u00a0and,\u00a0in\u00a0the\u00a0<\/p>\n
process, \u00a0 had \u00a0 included \u00a0 a \u00a0 plot \u00a0 of \u00a0 land \u00a0 belonging \u00a0 to \u00a0 the \u00a0 Appellant \u00a0 himself,\u00a0<\/p>\n
although \u00a0 the \u00a0 borrower \u00a0 had \u00a0 no \u00a0 claim \u00a0 on \u00a0 his \u00a0 land \u00a0 he \u00a0 having \u00a0 bought \u00a0 it \u00a0 from\u00a0<\/p>\n
someone \u00a0 else. \u00a0 Since \u00a0 this \u00a0 plot \u00a0 of \u00a0 land \u00a0 is \u00a0 now \u00a0 implicated \u00a0 in \u00a0 the \u00a0 recovery\u00a0<\/p>\n
proceedings,\u00a0he\u00a0submitted\u00a0that\u00a0he\u00a0had\u00a0a\u00a0right\u00a0to\u00a0get\u00a0the\u00a0information\u00a0about\u00a0this\u00a0<\/p>\n
CC\u00a0account.\u00a0Keeping\u00a0this\u00a0background\u00a0in\u00a0mind,\u00a0we\u00a0think\u00a0that\u00a0it\u00a0would\u00a0be\u00a0proper\u00a0<\/p>\n
if\u00a0the\u00a0Appellant\u00a0would\u00a0produce\u00a0any\u00a0documentary\u00a0proof\u00a0before\u00a0the\u00a0CPIO\u00a0about\u00a0<\/p>\n
his\u00a0ownership\u00a0of\u00a0the\u00a0said\u00a0plot\u00a0of\u00a0land\u00a0against\u00a0which\u00a0the\u00a0recovery\u00a0proceedings\u00a0<\/p>\n
have\u00a0been\u00a0initiated\u00a0in\u00a0this\u00a0case\u00a0and,\u00a0thereafter,\u00a0the\u00a0CPIO\u00a0should\u00a0provide\u00a0the\u00a0<\/p>\n
desired \u00a0 information \u00a0 about \u00a0 the \u00a0 CC \u00a0 account. \u00a0 We \u00a0 direct \u00a0 that \u00a0 the \u00a0 CPIO \u00a0 shall\u00a0<\/p>\n
provide \u00a0 the \u00a0 desired \u00a0 information \u00a0 within \u00a0 10 \u00a0 working \u00a0 days \u00a0 of \u00a0 the \u00a0 Appellant\u00a0<\/p>\n
producing\u00a0before\u00a0him\u00a0the\u00a0documentary\u00a0evidence\u00a0about\u00a0his\u00a0ownership\u00a0of\u00a0the\u00a0<\/p>\n
said\u00a0plot\u00a0of\u00a0land\u00a0which\u00a0is\u00a0implicated\u00a0in\u00a0the\u00a0recovery\u00a0proceedings\u00a0against\u00a0M\/s\u00a0<\/p>\n
Pelican\u00a0Corporation.\n<\/p>\n<\/p>\n
4.      The\u00a0case\u00a0is,\u00a0thus,\u00a0disposed\u00a0off.\n<\/p>\n
