It is the case of the appellants that<br \/>\noriginally the said land along with few other parcels of land were<br \/>\nunder the ownership of their late grandfather Bhatibhai who came into<br \/>\nownership of the said land by way of tenancy rights.  Bhatibhai and<br \/>\nhis wife Ramiben had  a female child name Jivatben who died in the<br \/>\nyear 1973.  Since then the two appellants being appellant no.2 &amp;<br \/>\n3 were living with Bhatibhai and Ramiben.  Bhatibhai died in the year<br \/>\n1983.  It is the case of the appellants that thereafter, on<br \/>\n23.12.1987, Ramiben by way of a registered will had bequeathed all<br \/>\nher properties including the disputed properties in favour of four of<br \/>\nher grandsons i.e. the present appellants wherein it is mentioned<br \/>\nthat the appellants are living with Ramiben and looking after her.<br \/>\nRamiben died in the year 1993.  After her death, when the appellants<br \/>\nstarted proceedings for mutating their names in the revenue record,<br \/>\nthe present respondent had raised a dispute interalia contending that<br \/>\nRamiben had executed another will on 25.12.1988 bequeathing the<br \/>\npresent disputed parcel of land to the respondent.\n<\/p>\n<p>3.2<br \/>\nThe present respondent, initiated the suit being Regular Civil Suit<br \/>\nNo. 202 of 1995 interalia contending that he had become the owner of<br \/>\nthe suit property by virtue of the subsequent will and therefore the<br \/>\ndefendants i.e. the present appellants may be permanently injuncted<br \/>\nfrom entering into the said property and disturbing the possession of<br \/>\nthe plaintiff therein with regard to the said property.      The suit<br \/>\nwas allowed by the trial court which was carried in appeal by the<br \/>\npresent appellants.  The appellate court dismissed the said appeal<br \/>\nand therefore the present second appeal.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>Nikhil Kariel, learned advocate appearing for the appellant has<br \/>\nsubmitted the substantial question of law that whether the learned<br \/>\nlower courts have failed to appreciate the most vital issue in this<br \/>\ndispute i.e. the second will could not gain any credence or priority<br \/>\nover the first will since it was registered after the life time of<br \/>\nthe Testator whereas the first will was registered by the Testator<br \/>\nduring her life time and that whether the statements of person<br \/>\nidentifying the thumb impression of the Testator in the will and<br \/>\nwitnesses in the will would be enough to prove the genuineness of the<br \/>\nsecond will in absence of any other sufficient evidence.\n<\/p>\n<p>4.1\tMr.\n<\/p>\n<p>Kariel has submitted that the order passed by the trial court is<br \/>\nerroneous and that the trial court failed to take into consideration<br \/>\nthe fact that the second will produced by the original<br \/>\nplaintiff-present respondent is suspicious as there was no reason for<br \/>\nRamiben to have bequeathed the piece of property to the present<br \/>\nrespondent-original plaintiff.\n<\/p>\n<p>5.\tAs<br \/>\na result of hearing and perusal of records, it is quite evident that<br \/>\nthe trial court has gone into the evidence in detail and more<br \/>\nparticularly ex. and has found sufficient reasons to allow the suit.<br \/>\nThe courts below have taken into consideration the relevant<br \/>\nprovisions of law in order to come to a conclusion whether the second<br \/>\nwill executed by Ramiben is suspicious or not inasmuch as the court<br \/>\nhas observed that as per the relevant provisions of law all the<br \/>\nrequirements of the execution of will are proved by the plaintiff.<br \/>\nBy virtue of the said will, the plaintiff has become the owner of the<br \/>\nproperty bearing survey no. 1360.  Registration of a will is not<br \/>\nnecessary and merely because the will was registered subsequent to<br \/>\nthe death of Ramiben cannot go to show that it is a bogus one.  The<br \/>\nwill of the plaintiff is supported by the witnesses of the plaintiff.<br \/>\n No other evidence is placed on record to take a view contrary to the<br \/>\none taken by the courts below.  I am in complete agreement with the<br \/>\nconcurrent findings of both the courts below.  No substantial<br \/>\nquestion of law is raised in the present appeal for consideration.<br \/>\nIn that view of the matter, this Court has no option but to dismiss<br \/>\nthe appeal.\n<\/p>\n<p>6.\tAccordingly,<br \/>\nthis appeal is dismissed.
