Justice V.GIRI\n\n Dated :14\/09\/2007\n\n O R D E R\n                               V.GIRI,J.\n                -----------------------------------------\n                     W.P.(C) NO.27413 of 2007\n                -----------------------------------------\n\n            Dated this the 14th day of September, 2007\n\n                              JUDGMENT\n<\/pre>\n<p>      Petitioners are working as Live Stock Inspectors Grade II, having<\/p>\n<p>been appointed on a provisional basis as per Ext.P1 order of<\/p>\n<p>appointment and similar orders stated to have been issued.<\/p>\n<p>Admittedly, appointments are provisional under Rule 9(a)(i) of Part II<\/p>\n<p>of KS &amp; SSR. Petitioners were appointed for a period of one year from<\/p>\n<p>the date of joining duty or till PSC hands report whichever is earlier.<\/p>\n<p>Petitioners contend that there are no qualified hands to be sponsored<\/p>\n<p>by the Employment Exchange and therefore they should be permitted<\/p>\n<p>to continue in service till regular hands were available for duty.<\/p>\n<p>Learned counsel for the petitioners points out that Ext.P4 which is the<\/p>\n<p>communication issued by an Information Officer of the Town<\/p>\n<p>Employment Exchange, Koilandy indicates that there are no qualified<\/p>\n<p>hands in this regard in the registers of the Employment Exchange of<\/p>\n<p>Koilandy.\n<\/p>\n<p>      2. The claim similar to that raised by the petitioners herein came<\/p>\n<p>up for consideration before the Division Bench in Writ Appeal<\/p>\n<p><span class=\"hidden_text\"> W.P.(C)No.27413\/2007                : 2:<\/span><\/p>\n<p>No.434\/2002 and connected cases and it was disposed of by Ext.P7<\/p>\n<p>judgment.     Part-2 of the directions issued by the Division Bench is<\/p>\n<p>extracted hereunder.\n<\/p>\n<blockquote><p>           &#8220;If candidates who have got their names<br \/>\n           registered in the Employment Exchange are<br \/>\n           waiting for temporary appointment, they<br \/>\n           would also have a right to get appointment as<br \/>\n           Livestock Inspector Grade II for a limited<br \/>\n           period. Writ Petitioners cannot take away their<br \/>\n           rights on the basis of interpetrary judgments<br \/>\n           referred to by some of the writ petitioners. We<br \/>\n           make it clear in case vacancies are available<br \/>\n           and there is necessity of filling up of those<br \/>\n           vacancies it is always open to the department<br \/>\n           or State Government to fill up those vacancies<br \/>\n           with the petitioners if candidates from the<br \/>\n           Employment Exchange are available.&#8221;<\/p><\/blockquote>\n<p>      3. The Division Bench found that provisional hands have no right<\/p>\n<p>to claim retainment      beyond the period for which they have been<\/p>\n<p>appointed. Now can they claim a right to be retained till regular PSC<\/p>\n<p>hands join for duty. The Division Bench made it clear that if there are<\/p>\n<p>necessities of filling up of those vacancies, it is open to the department<\/p>\n<p>or State Government to fill up those vacancies with the petitioners<\/p>\n<p>therein, if the candidates from the Employment Exchange are not<\/p>\n<p>available.
