Delay in filing the<br \/>\nsaid applications has occurred due to the fact that the applicant did<br \/>\nnot know that said respondent Minaben Vikrambhai Chavda had died and<br \/>\nit came to know when the above matters were listed for final hearing.<br \/>\nLearned advocate for the applicant has then submitted that there is<br \/>\nno abatement but if there is there any abatement, the same may be set<br \/>\naside.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above, the submission made by the learned advocate for<br \/>\nthe applicant appears to be genuine and accordingly, these Civil<br \/>\nApplications are allowed. Delay caused in filing the present<br \/>\napplications is condoned. The abatement of First Appeal against<br \/>\ndeceased Minaben Vikrambhai Chavda, if any, is set aside. The<br \/>\napplicant as well as the office is permitted to carry out the<br \/>\nnecessary amendment in the cause title of the First Appeals, as<br \/>\nprayed for in para 7(B) and 7(C) of the applications.
