No. 1236 of 2005\n                ------------------------------------------\n            Dated this the 9th day of June, 2008\n\n                            O R D E R\n<\/pre>\n<p>      Petitioner is the plaintiff and respondebts the<\/p>\n<p>defendants in O.S. 139 of 2001. Suit was for injunction.<\/p>\n<p>Suit was settled and a compromise petition was passed.<\/p>\n<p>Ext.A1, compromise petition, shows that as per terms of<\/p>\n<p>the compromise plaintiff has to provide a way having a<\/p>\n<p>width of 8 feet to the defendants and at the time of<\/p>\n<p>construction of the road, including the portion where a<\/p>\n<p>Thondu lies, at the expense of the defendants a compound<\/p>\n<p>wall separating the road from the plaint schedule property<\/p>\n<p>is to be constructed.            Accepting Ext.A1 compromise<\/p>\n<p>petition, Ext.A2 decree, under which Ext.A1 forms part of<\/p>\n<p>the decree was passed. Contending that plaintiff did not<\/p>\n<p>comply with the compromise decree, respondents filed EP<\/p>\n<p>158 of 2004.     Though         petitioner appeared before the<\/p>\n<p>Executing Court he did not file any written objection or<\/p>\n<p>cross-examined the 5th decree holder and 5th petitioner in<\/p>\n<p>the execution petition, who was examined as PW1.<\/p>\n<p>Executing Court, therafter, passed an order on 6.12.2005<\/p>\n<p><span class=\"hidden_text\">CRP1236\/05                      2<\/span><\/p>\n<p>appointing an Advocate Commissioner, under whose superviison<\/p>\n<p>construction of the way having a width of 8 feet as provided in<\/p>\n<p>the compromise decree was directed to be carried out.<\/p>\n<p>Respondents    were    directed   to   pay   Rs.1,000\/-   to  the<\/p>\n<p>commissioner as batta. It was provided that they are entitled to<\/p>\n<p>realize the cost from the petitioner. The order is challenged in<\/p>\n<p>this revision petition filed under Section 151 of Code of Civil<\/p>\n<p>Procedure.\n<\/p>\n<p>     2.    Learned    counsel   appearing    for  petitioner  and<\/p>\n<p>respondents were heard.       Ext.A2 decree only provides that<\/p>\n<p>respondents are entitled to use 8 feet width of way inclusive of<\/p>\n<p>the Thondu portion, through the plaint schedule property and<\/p>\n<p>they are entitled to construct a road through that way. It also<\/p>\n<p>provide that at the time of construction of the road, they have to<\/p>\n<p>construct a wall separating that road portion from the remaining<\/p>\n<p>property of the petitioner. Though the Executing Court under<\/p>\n<p>order dated 6.12.2005 appointed the commissioner to supervise<\/p>\n<p>the construction of the way, there was no direction to construct a<\/p>\n<p>compound wall separating the way from the remaining portion of<\/p>\n<p>the decree schedule property as provided under the decree.<\/p>\n<p>Therefore, to that extent the order passed by the Executing<\/p>\n<p>Court warrants interference. Similarly, when the wall is to be<\/p>\n<p><span class=\"hidden_text\">CRP1236\/05                       3<\/span><\/p>\n<p>constructed at the expense of the respondents and they did not<\/p>\n<p>mention anything about it in the execution petition, Executing<\/p>\n<p>Court was not justified in directing petitioner to pay the cost in<\/p>\n<p>the execution petition to the respondents.<\/p>\n<p>     3.    Revision is allowed in part, the order passed by the<\/p>\n<p>Executing Court is modified as follows:-<\/p>\n<blockquote><p>           The Advocate Commissioner is appointed at the<\/p>\n<p>     expense of the petitioners in the execution petition to<\/p>\n<p>     supervise the construction of the way having a width<\/p>\n<p>     of 8 feet as provided under the compromise decree<\/p>\n<p>     and also the construction of the compound wall<\/p>\n<p>     separating the way from the remaining portion of the<\/p>\n<p>     decree schedule property at the expense of the<\/p>\n<p>     petitioners in the execution petition. Respondent in<\/p>\n<p>     the execution petition (plaintiff) is not liable for the<\/p>\n<p>     cost in the execution petition.<\/p><\/blockquote>\n<p>                                M.
