Justice P.S.GOPINATHAN\n\n Dated :30\/09\/2010\n\n O R D E R\n         PIUS C.KURIAKOSE &amp; P.S.GOPINATHAN, JJ.\n                      ------------------------\n                     R.C.R.No. 292 OF 2010\n                      ------------------------\n\n         Dated this the 30th day of September , 2010\n\n                            O R D E R\n<\/pre>\n<p>Pius C.Kuriakose, J.\n<\/p>\n<\/p>\n<p>     Under challenge in this revision filed under Section 20 by<\/p>\n<p>the tenant is the order of eviction passed by the Rent Control<\/p>\n<p>Court on the grounds of arrears of rent and bona fide need for<\/p>\n<p>own occupation and confirmed by the Appellate Authority under<\/p>\n<p>the impugned judgment.\n<\/p>\n<p>     2.   Even though apparently serious grounds are raised in<\/p>\n<p>the memorandum of revision and Sri.T.A.Unnikrishnan, learned<\/p>\n<p>counsel   for the    revision  petitioner,   addressed  strenuous<\/p>\n<p>arguments before us on the basis of those grounds, having<\/p>\n<p>scanned the judgment of the Appellate Authority and the order of<\/p>\n<p>the Rent Control Court, we do not find any warrant for invocation<\/p>\n<p>of the present jurisdiction under Section 20 of Act 2 of 1965.<\/p>\n<p>We notice that the finding that the need is bona fide and that the<\/p>\n<p>tenant is not entitled for the protection of the second proviso to<\/p>\n<p>Section 11(3), has been entered by the statutory authorities on<\/p>\n<p><span class=\"hidden_text\">RCR.No.292\/2010                   2<\/span><\/p>\n<p>the basis of evidence which was actually available on record.<\/p>\n<p>The oral evidence adduced by the landlady, who was examined as<\/p>\n<p>PW1, inspired the Rent Control Court as well as the learned<\/p>\n<p>Appellate Authority. The needy person, daughter of the landlady,<\/p>\n<p>also gave evidence as PW2 and her evidence also inspired the<\/p>\n<p>statutory authorities.     We find that the judgment of the Full<\/p>\n<p>Bench of this Court in <a href=\"\/doc\/418143\/\">Francis v. Sreedevi Varassiar<\/a> (2003 (2)<\/p>\n<p>KLT 230) was kept in mind by the statutory authorities while<\/p>\n<p>appreciating the evidence adduced by the parties in the context<\/p>\n<p>of second proviso to Section 11(3).\n<\/p>\n<p>      3. As for the ground of arrears of rent also, the learned<\/p>\n<p>counsel for the revision petitioner was unable to make any dent<\/p>\n<p>on the findings entered by the statutory authorities which again<\/p>\n<p>are on the basis of evidence on record.   The revision necessarily<\/p>\n<p>has to fail and will stand dismissed.\n<\/p>\n<p>      4. The learned counsel for the revision petitioner made a<\/p>\n<p>last plea that at least one year&#8217;s time be granted to the revision<\/p>\n<p>petitioner for surrendering the premises.       According to the<\/p>\n<p>learned counsel, the revision petitioner has reached the evening<\/p>\n<p>period of his life and he may be allowed to continue in the<\/p>\n<p><span class=\"hidden_text\">RCR.No.292\/2010                   3<\/span><\/p>\n<p>building for one year.
