Balaghat in Civil Suit<br \/>\nNo.35-A\/2009 by which the trial Court rejected an application filed<br \/>\nby the petitioners seeking amendment in the plaint on the ground<br \/>\nthat it will change the nature of the suit and after allowing the<br \/>\namendment, the suit will be beyond the pecuniary jurisdiction of<br \/>\nthe trial Court..\n<\/p>\n<p>       The     learned   counsel   appearing   for   the   petitioners<br \/>\nsubmitted that claim of damages was raised because of<br \/>\nsubsequent events occurred in the case. The defendants took the<br \/>\ncrops of the petitioners and for recovery of the price of such<br \/>\ncrops,the plaint was sought to be amended, but the trial Court<br \/>\nerred in rejecting the application filed by the petitioners. It is<br \/>\nsubmitted that the aforesaid cause of action arose after filing of<br \/>\nthe suit and the amendment was necessary for the just decision<br \/>\nof the case.\n<\/p>\n<p>       The learned counsel for the respondents submitted that<br \/>\nafter allowing the amendment, the trial Court would not have<br \/>\npecuniary jurisdiction. In such exigency, the recourse available to<br \/>\nthe trial Court was to return the plaint along the amendment<br \/>\napplication. Reliance is placed to a Division Bench judgment of<br \/>\nNagpur High Court in Lalji Banchhoddas vs. Narottam<br \/>\nRanchhoddas :AIR 1953 Nagpur 273 and two Single Bench<br \/>\njudgments of this Court in Indori Lal Vs. Indore Municipal<br \/>\nCorporation in C.R.No.538\/72 decided on 1.10.1975 reported in<br \/>\n1976 MPLJ SN 5 and another judgment of Single Bench in<br \/>\nTrilokchand vs. Jabbar Khan 1967 MPLJ SN 78 and submitted<br \/>\nthat the recourse available to the trial Court was to return the<br \/>\nplaint along with application for filing it before the competent court<br \/>\n                             W.P.No.7785\/2010<\/p>\n<p>Avinash Pandey and another           Doman Singh and others.\n<\/p>\n<p>of jurisdiction and submitted that he has no objection if the plaint<br \/>\nalong with application seeking amendment is returned to the<br \/>\npetitioners so that they may file it before the competent Court of<br \/>\njurisdiction.\n<\/p>\n<p>         The Division Bench of Nagpur High Court considered this<br \/>\nquestion and held in para 5 of the judgment thus:\n<\/p>\n<blockquote><p>          &#8220;(5)     The second leg of the difficulty is clearly<br \/>\n         brought into relief when we view the matter from<br \/>\n         another angle. When the Court is faced with the<br \/>\n         question of allowing an amendment which taken<br \/>\n         together with the original claim exceeds its pecuniary<br \/>\n         jurisdiction, it is in effect trying a suit beyond its<br \/>\n         pecuniary jurisdiction. By adding the new relief which<br \/>\n         the plaintiff claims, the Court in effect amends the<br \/>\n         plaint as presented, because it is also well settled that<br \/>\n         all amendments relate back to the presentation of the<br \/>\n         plaint. This clears the difficulty because the Court is<br \/>\n         thereby rendered incompetent to entertain the claim<br \/>\n         for amendment at all. In such a situation, because the<br \/>\n         plaintiff cannot ask for the return of the plaint, nor can<br \/>\n         the Court cause the amendment, the logical<br \/>\n         procedure to follow would be to return the plaint<br \/>\n         together with the application for amendment for the<br \/>\n         consideration of that Court which has jurisdiction to<br \/>\n         consider the original claim and the claim sought by<br \/>\n         the amendment not taken separately but together.&#8221;<\/p><\/blockquote>\n<p>         The similar view was reiterated by the two Single Bench<br \/>\njudgments in Indori Lal and Trilokchand (supra).\n<\/p>\n<p>         In view of the aforesaid, the prayer made in this petition is<br \/>\nallowed.
