(J)\n\nCITATION:\n 1987 AIR  737\t\t  1987 SCR  (1) 979\n 1987 SCC  (1) 466\t  JT 1987 (1)\t141\n 1987 SCALE  (1)66\n\n\nACT:\n    Code  of Criminal Procedure,  1973:\t s.438--Anticipatory\nbail--When not to be granted.\n\n\n\nHEADNOTE:\n    While  the matter regarding the unnatural death  of\t the\ndaughter in-law at the house of her father-in-law was  still\nunder investigation the High Court grunted anticipatory bail\nto the accused in disregard of the magnitude and seriousness\nof the matter.\n    Subsequent to the filing of the appeal by special  leave\nby  the\t father of the deceased the investigation  had\tbeen\nconcluded  by the police and challan filed, and the  accused\nwere released on bail by the Chief Judicial Magistrate.\nDismissing the appeal as infructuous, the Court,\n    HELD: The High Court was under no compulsion to exercise\nits  jurisdiction to grant anticipatory bail in a matter  of\nthis nature. [980D]\n    The\t appropriate course to adopt was to allow  the\tcon-\ncerned Magistrate to deal with the case on the basis of\t the\nmaterial before him at the point of time of accused's arrest\nin  case  they\twere arrested. It  was,\t therefore,  neither\nprudent nor proper for the High Court to have granted antic-\nipatory bail which order was very likely to occasion  preju-\ndice by its very nature and timing. [980B-D]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>    CRIMINAL\tAPPELLATE   JURISDICTION:   Criminal  Appeal<br \/>\nNo. 22 of 1987.\n<\/p>\n<p>    From  the  Judgment and Order dated\t 29.10.1986  of\t the<br \/>\nRajasthan High Court in Crl. M.B.A. No. 1395\/86<br \/>\n    Gopal  Subramaniam, A.M. Garg and R.  Venkataramani\t for<br \/>\nthe Petitioner.\n<\/p>\n<p>Dalveer Bhandari for the Respondents.\n<\/p>\n<p><span class=\"hidden_text\">980<\/span><\/p>\n<p>The Judgment of the Court was delivered by<br \/>\n    THAKKAR, J. The widespread belief that dowry deaths\t are<br \/>\neven now treated with some casualness at all levels seems to<br \/>\nbe  well grounded. The High Court has  granted\tanticipatory<br \/>\nbail  in such a matter. We are of the opinion that the\tHigh<br \/>\nCourt should not have exercised its jurisdiction to  release<br \/>\nthe accused on anticipatory bail in disregard of the  magni-<br \/>\ntude and seriousness of the matter. The matter regarding the<br \/>\nunnatural  death of the daughter-in-law at the house of\t her<br \/>\nfather-in-law  was still under investigation and the  appro-<br \/>\npriate course to adopt was to allow the concerned Magistrate<br \/>\nto  deal with the same on the basis of the  material  before<br \/>\nthe Court at the point of time of their arrest in case\tthey<br \/>\nwere  arrested.\t It was neither prudent nor proper  for\t the<br \/>\nHigh Court to have granted anticipatory bail which order was<br \/>\nvery  likely  to occasion prejudice by its very\t nature\t and<br \/>\ntiming. We therefore consider it essential to sound a  seri-<br \/>\nous  note of caution for future. The High Court is under  no<br \/>\ncompulsion to exercise its jurisdiction to grant anticipato-<br \/>\nry  bail in a matter of this nature. So far as\tthe  present<br \/>\nmatter is concerned, since it has become infructuous, we  do<br \/>\nnot  propose  to pass any order.
