SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/09\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, petitioner has prayed for an appropriate writ, direction or<br \/>\norder quashing and setting aside the impugned order dated 25.08.2009<br \/>\npassed by the Controlling Authority in Gratuity Application<br \/>\nNo.25\/2009 as well as the order dated 31.03.2010 passed by the<br \/>\nAppellate Authority confirming the order passed by the Controlling<br \/>\nAuthority by which the petitioner is directed to pay gratuity of<br \/>\nRs.16,754\/-  with 10% interest from 01.05.2009.\n<\/p>\n<p>2.\tHaving<br \/>\nheard Shri Supehia, learned advocate appearing on behalf of the<br \/>\npetitioner and considering the orders passed by both the Authorities<br \/>\nbelow and having found that the respondent worked with the petitioner<br \/>\nfor the period between 01.10.2001 to 31.03.2009 without break and<br \/>\nwhen the petitioner failed to prove that the respondent was appointed<br \/>\non season basis, it cannot be said that both the authorities below<br \/>\nhave committed any error in directing the petitioner to pay the<br \/>\namount of gratuity to the respondent.
