No.697 of 2007\n                    YUGESHWAR THAKUR &amp; ORS\n                              Versus\n                      GHURAN THAKUR &amp; ORS\n                             -----------\n<\/pre>\n<p>2   15.7.2008         Heard Counsel for the petitioner.<\/p>\n<p>                      The petitioner seems to be aggrieved by an order dated<\/p>\n<p>                13.1.2007 whereby and whereunder the Court below has<\/p>\n<p>                rejected the application filed by the petitioner for acceptance<\/p>\n<p>                of their written statement on the ground that it was filed<\/p>\n<p>                beyond the period of ninety days of their service of summons<\/p>\n<p>                and in fact after the Court had already debarred them from<\/p>\n<p>                filing written statement by an order dated 7.11.2006.<\/p>\n<p>                      Counsel for the petitioner with reference to the<\/p>\n<p>                pleadings in civil revision application as also stated in the<\/p>\n<p>                impugned order submits that in a partition suit where the<\/p>\n<p>                entire right of the petitioners were to be adjudicated, their<\/p>\n<p>                being debarred from filing of the written statement, would<\/p>\n<p>                virtually rob them off of their valid right to contest the case<\/p>\n<p>                on merit. In this regard, he also submits that as a matter of<\/p>\n<p>                fact summons were not served validly on the petitioners and<\/p>\n<p>                therefore when this question was raised before the Court<\/p>\n<p>                below it ought to have recorded the findings in this regard.<\/p>\n<p>                He further submits that the spirit of the judgment of the<\/p>\n<p>                Apex Court in the case of Kailash Vs. Nanhaku reported in<\/p>\n<p>                AIR 2005 SC 2441 while laying down the law with regard to<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>the provision of order 8 rule 1 is that the same is directory<\/p>\n<p>and therefore the reasons for such delay have to be looked<\/p>\n<p>into even while considering the question of debarring the<\/p>\n<p>defendants from filing of the written statement.<\/p>\n<p>      On the other hand, Counsel appearing on behalf of the<\/p>\n<p>opposite parties has stated that true it is that the provision<\/p>\n<p>of Order VIII Rule 1 has been held to be directory but then<\/p>\n<p>that does not mean that in each and every case the<\/p>\n<p>defendants can be given a liberty of delaying the disposal of<\/p>\n<p>the suit by choosing not to file their written statement for an<\/p>\n<p>unexplained period. He further submits that the Court below<\/p>\n<p>has committed no error in passing the impugned order by<\/p>\n<p>applying the ratio of the judgment of the Apex Court in the<\/p>\n<p>case of Salem Bar Association reported in AIR 2005 SC 3353<\/p>\n<p>while passing the impugned order.\n<\/p>\n<p>      In the opinion of this Court, the impugned order is not<\/p>\n<p>sustainable as the facts of this case for causing delay in filing<\/p>\n<p>written statement by the petitioners have not been carefully<\/p>\n<p>considered and analyzed by the Court which appear to have<\/p>\n<p>been missed altogether in its over enthusiasm to rely on the<\/p>\n<p>judgment of Apex Court in Salem Bar Association (supra). In<\/p>\n<p>fact the Court below was under obligation to first look into<\/p>\n<p>the reasons for not filing of the written statement as<\/p>\n<p>disclosed by the petitioners in their application. Such reason<\/p>\n<p>for not filing of such written statement by the petitioners<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>      being that notices\/summons were not allegedly served on<\/p>\n<p>      them ought to have been at least considered with greater<\/p>\n<p>      detail by the Court below. This having been not done, this<\/p>\n<p>      Court taking into consideration the ends of justice as also<\/p>\n<p>      the right of the parties in the partition suit, would set aside<\/p>\n<p>      the impugned order and direct the Court below to accept the<\/p>\n<p>      written statement already filed by the petitioners subject to<\/p>\n<p>      the payment of cost of Rs. 7,500\/- to the plaintiff opposite<\/p>\n<p>      parties no.1 within a period of three months of the date of<\/p>\n<p>      receipt\/production of a copy of this order.\n<\/p>\n<p>            With the aforementioned observations\/directions, this<\/p>\n<p>      civil revision application is allowed.\n<\/p>\n<\/p>\n<pre>Rsh                                            (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Yugeshwar Thakur &amp;Amp; Ors vs Ghuran Thakur &amp;Amp; Ors on 15 July, 2008 IN THE HIGH COURT OF JUDICATURE AT PATNA C.R.
