Bind, Distt-Nalanda\n                                                             ---------Respondents\n                                          -------------\n<\/pre>\n<p>2.   09.09.2010                 Heard learned counsel for the petitioner.<\/p>\n<p>                   Learned counsel for the respondents submits that he<\/p>\n<p>                   is not ready with the case and he has got no<\/p>\n<p>                   instruction in this regard, as the case has been filed<\/p>\n<p>                   on 08.09.2010, hence the case be adjourned for 16th<\/p>\n<p>                   September, 2010.\n<\/p>\n<p>                                However,     learned     counsel     for   the<\/p>\n<p>                   petitioner submits that Annexure-1 to the writ<\/p>\n<p>                   petition is a notice dated 02.09.2010 in which the<\/p>\n<p>                   date of special meeting for consideration of No<\/p>\n<p>                   Confidence     Motion      against    the    Up-Pramukh<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>            (petitioner) has been fixed on 10.09.2010 and if the<\/p>\n<p>            case is adjourned for 16.09.2010 the said special<\/p>\n<p>            meeting will take effect and the writ petition will<\/p>\n<p>            become infructuous.\n<\/p>\n<p>                       It is quite apparent from the said notice<\/p>\n<p>            that it is issued to the petitioner without mentioning<\/p>\n<p>            the charges leveled by the members in requisition.<\/p>\n<p>            Hence prima facie it appears to be in the teeth of the<\/p>\n<p>            provision of Section 44 (3) (v) of the Bihar Panchyati<\/p>\n<p>            Raj Act, 2006.\n<\/p>\n<p>                       In the said circumstances, let this case<\/p>\n<p>            be listed on 16.09.2010 as prayed for by learned<\/p>\n<p>            counsel for the respondents under the same heading<\/p>\n<p>            within top five cases.\n<\/p>\n<p>                        In the meantime, the operation of the<\/p>\n<p>            impugned notice dated 02.09.2010 (Annexure-1)<\/p>\n<p>            issued by the Executive Officer, Panchayat Samiti<\/p>\n<p>            Bind (respondent no. 5) shall remain stayed.<\/p>\n<p>                       This interim order shall continue till the<\/p>\n<p>            next date on which the case would be taken up.<\/p>\n<pre>Anand Kr.
