SHAH\n\t\t\n\t\n\n \n\nDate\n: 11\/04\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tAs<br \/>\ncommon question of law and facts arise in both these petitions and<br \/>\nthey arise out of common order dated 18\/11\/2010 passed by the<br \/>\nSecretary,  (Appeals), Revenue Department, State of Gujarat in<br \/>\nRevision Application Nos. 1-2\/2009, both these petitions are being<br \/>\ndisposed of by this common order.\n<\/p>\n<p>2.\t\tAs<br \/>\nboth these petitions can be disposed of on the broad consensus<br \/>\nbetween learned advocates appearing on behalf of the respective<br \/>\nparties with respect to mutation entries in question, further facts<br \/>\nare not narrated.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard learned advocates appearing on behalf of the respective<br \/>\nparties, it appears that the dispute is with respect to mutation<br \/>\nentry Nos.168, 207, 484, 528 and 557 and mutation entry that might<br \/>\nhave been made subsequently pursuant to the order dated 13\/03\/2006<br \/>\npassed by the Deputy Collector, Vyara, District: Surat in RTS Appeal<br \/>\nNos.33 &amp; 68\/2004. As per settled proposition of law laid down by<br \/>\nthe Hon&#8217;ble Supreme Court as well as this Court in catena of<br \/>\ndecisions that mutation entry in the revenue record does not confer<br \/>\nany right, title and interest in favour of the person, whose name is<br \/>\nmutated in the revenue record solely on the ground that his name is<br \/>\nmutated in the revenue record. If there is any dispute with respect<br \/>\nto partition, right and title of the properties, the same is to be<br \/>\nresolved by approaching the concerned Civil Court and necessary entry<br \/>\nbe made in the revenue record on the basis of the decision, that may<br \/>\nbe rendered by the concerned Civil Court.\n<\/p>\n<p>4.\t\tLearned<br \/>\nadvocates appearing on behalf of the respective parties are not in<br \/>\nposition to dispute the same. It is reported that one Civil Suit is<br \/>\ninstituted by the petitioner for permanent injunction. In view of<br \/>\nrival claims between the parties, it will be open for either of the<br \/>\nparties  to institute the Civil Suit\/Suits in the concerned Civil<br \/>\nCourt for establishing their rights in the property in question and<br \/>\nnecessary entry be made on the basis of the decision that may be<br \/>\npassed by the concerned Civil Court. However, in the meantime, all<br \/>\nthe mutation entry Nos.168, 207, 484, 528 and 557 and even mutation<br \/>\nentry that might have been made\/ to be made subsequently pursuant to<br \/>\nthe order dated 13\/03\/2006  passed by the Deputy Collector, Vyara,<br \/>\nDistrict: Surat in RTS Appeal Nos.33 &amp; 68\/2004, to be continued<br \/>\nwithout prejudice to the rights and contentions of the respective<br \/>\nparties in the pending  Civil Suit and\/or in the Suit that may be<br \/>\ninstituted by either of the parties and necessary mutation entries be<br \/>\nmade on the basis of the decision that may be passed by the concerned<br \/>\nCivil Court. Merely on the basis of the mutation entries in their<br \/>\nfavour, the respective parties may not claim any right, title and\/or<br \/>\ninterest in the property in question solely on the basis of the<br \/>\naforesaid mutation entries.\n<\/p>\n<p>5.\t\tIt<br \/>\nis ultimately for the concerned Civil Court to pass appropriate order<br \/>\nin the pending Civil Suit and\/or in the Suit that may be instituted<br \/>\nby either of the parties, in accordance with law and on merits and on<br \/>\nthe basis of the evidence, that may be led by the respective parties<br \/>\nand ignoring the aforesaid mutation entries in question. It goes<br \/>\nwithout saying that the observations made by the Deputy Collector<br \/>\nand\/or the Collector and\/or the Revisional Authority may not be<br \/>\nconstrued as determining the rights between the parties and as stated<br \/>\nhereinabove, the concerned Civil Court to  decide and dispose of the<br \/>\nsame in accordance with law and on merits and on the basis of the<br \/>\nevidence that may be led by the respective parties and independently.\n<\/p>\n<p>6.\t\tWith<br \/>\nthese, both these petitions are disposed of. Notice is discharged in<br \/>\nboth these petitions.
