Bhave, learned Senior Counsel along with Shri\nB.P. Yadav, Advocate for the respondents No.3 to 5.<\/pre>\n<p>       We have perused the record.\n<\/p>\n<p>       In the instant writ petition filed as a public interest litigation<br \/>\nthe petitioner has alleged that the inhabitants of New Anand Nagar<br \/>\nHousing Board Colony situated at Adhartal within the city of<br \/>\nJabalpur are facing serious inconvenience due to lack of basic<br \/>\namenities such as constant supply of electricity, pure drinking<br \/>\nwater, drainage, sewerage and poor condition of roads etc..\n<\/p>\n<p>       The petitioner claims to be the President of New Anand<br \/>\nNagar Kalyan Samiti formed by the residents of the locality. It has<br \/>\nfurther been stated that the New Anand Nagar Housing Board<br \/>\nColony, Adhartal was developed by the M.P. Housing Board,<br \/>\nJabalpur. It has been alleged that basic amenities such as proper<br \/>\nsupply of pure drinking water, electricity, drainage and roads etc.<br \/>\nhave not been provided in the aforesaid Colony, which causes a lot<br \/>\nof inconvenience to the residents of the Colony.               In these<br \/>\ncircumstances the petitioner has prayed for issuance of directions<br \/>\ncommanding the respondents to supply pure drinking water and<br \/>\nelectricity, and also to maintain drainage, sewerage and roads etc.<br \/>\nof the Colony so that the people of the locality can lead a decent<br \/>\nand healthy life.\n<\/p>\n<p>       The respondents No.3 to 5 have filed common return<br \/>\nwherein it has been stated that steps have already been taken for<br \/>\nproviding regular supply of drinking water to the inhabitants of the<br \/>\nColony. It has further been stated that the road conditions are<br \/>\n being improved. Steps to remove encroachments over the roads<br \/>\nhave also been initiated. It has been stated in the return that the<br \/>\nrespondents to the best of their ability and resources are doing all<br \/>\nthe needful to provide basic amenities to the residents of the<br \/>\nColony for more than 20 years. It has further been stated that six<br \/>\nemployees are looking after the maintenance of sewer lines,<br \/>\nmanhole chamber and septic tanks and four persons are deputed<br \/>\nto look after the supply of water. It has further been stated that the<br \/>\nrespondents have constructed cement roads and have also dug<br \/>\nthree bore-wells 500 ft. deep to provide good quality of water to the<br \/>\nresidents of the Colony regularly. It has also been stated in the<br \/>\nreturn that tube-well water is being checked regularly in the District<br \/>\nLaboratory and it is found fit for drinking purpose. A copy of the<br \/>\nreport, dated 27-8-2004 is enclosed as Annexure-R-3\/1 in the<br \/>\nreturn. It has further been disclosed in the return that about 150<br \/>\npersons have made encroachment upon the premises in question<br \/>\nand for that purpose notices have been issued to the encroachers<br \/>\nand steps have been taken to remove the encroachment. It has<br \/>\nalso been stated that a complaint register is made available in the<br \/>\noffice.    Whenever any complaint is received, employees of the<br \/>\nrespondents No.3 to 5 immediately visit the spot and take steps for<br \/>\nnecessary repair and to remove defects.\n<\/p>\n<p>          On the other hand, the petitioner has not filed any rejoinder<br \/>\ncontroverting those statements made in the return.\n<\/p>\n<p>          Shri P.R. Bhave, learned senior counsel, appearing for the<br \/>\nrespondents No.3 to 5, however, stated before us that all<br \/>\nnecessary steps have been taken to provide necessary basic<br \/>\namenities to the residents of the Colony. He further assured the<br \/>\nCourt that in future too, the respondents shall make all endeavour<br \/>\nto maintain the supply of pure drinking water to the residents of the<br \/>\n Colony and other basic amenities such as roads, sewerage and<br \/>\nsanitation etc. so that they can lead a decent healthy life.\n<\/p>\n<p>       Admittedly, the aforesaid Colony was developed by the M.P.<br \/>\nHousing Board and, therefore, it is the duty of the respondents<br \/>\nNo.3 to 5 to provide basic amenities to the residents of the area.\n<\/p>\n<p>       <a href=\"\/doc\/1657323\/\">In Consumer Education and Research Centre vs. Union<br \/>\nof India,<\/a> (1995) 3 SCC 42 the Apex Court in paragraph 22 has<br \/>\nobserved that expression `life&#8217; assured in Article 21 of the<br \/>\nConstitution does not connote mere animal existence or continued<br \/>\ndrudgery through life but it includes the quality of life as understood<br \/>\nin its richness and fullness by the ambit of the Constitution. The<br \/>\nApex Court while taking note of the expression of the word `life&#8217;<br \/>\nunder Article 21 of the Constitution of India further observed that it<br \/>\nhas much wider meaning which includes right to livelihood, better<br \/>\nstandard of living, hygienic conditions in the workplace and leisure.<br \/>\nTherefore, non-providing of basic amenities in the residential<br \/>\ncolony by the concerned authority or the agency would be violative<br \/>\nof Article 21 of the Constitution of India.\n<\/p>\n<p>       In State of Himanchal Pradesh and another vs. Umed<br \/>\nRam Sharma and others, (1986) 2 SCC 68 the Apex Court in<br \/>\nparagraph    11     observed    that   there   should    be     road   for<br \/>\ncommunication       in   reasonable    conditions   in   view    of    our<br \/>\nconstitutional imperative and denial of that right would be denial of<br \/>\nthe life as understood in its richness and fullness by the ambit of<br \/>\nthe Constitution.\n<\/p>\n<p>       In view of the enunciation of law by the Apex Court the basic<br \/>\namenities to the residents of the area are to be provided, otherwise<br \/>\nit would be violative of the rights enshrined in Article 21 of the<br \/>\nConstitution of India. However, in view of the assurance given on<br \/>\nbehalf of the respondents No.3 to 5 through their learned Senior<br \/>\n Counsel that all possible basic facilities\/amenities are being<br \/>\nprovided and respondents shall continue to provide in future also to<br \/>\nthe residents of the Colony, we are of the view, that no purpose<br \/>\nwould be served by keeping this matter further pending and it<br \/>\nwould be appropriate to dispose of the instant writ petition at this<br \/>\nstage with the direction to the respondents to provide all necessary<br \/>\nbasic amenities to the residents of the area in question, and they<br \/>\nshall maintain roads, drainage and sewerage etc. including supply<br \/>\nof potable water.\n<\/p>\n<p>      With the above directions, the writ petition stands finally<br \/>\ndisposed of.\n<\/p>\n<pre>      (S.R.
