No. 2104 of 2008\n            ==========================\n             Dated this the 27th day of June, 2008.\n\n                            ORDER\n<\/pre>\n<p>     The petitioner, who is the accused in C.C. No. 606 of 2005<\/p>\n<p>on the file of the   Judicial First Class Magistrate -III (Forest<\/p>\n<p>Offences), Punalur, which is a prosecution under Section 138 of<\/p>\n<p>the Negotiable Instruments Act, 1881, involving a cheque for<\/p>\n<p>Rs.1 lakh, challenges the order dated 18.03.2008 passed by the<\/p>\n<p>Magistrate rejecting his application filed as Crl. M.P. No. 899 of<\/p>\n<p>2008 requesting the forwarding of the cheque in question for<\/p>\n<p>expert opinion.\n<\/p>\n<p>     2. The revision petitioner has admitted his signature in the<\/p>\n<p>cheque in question. According to him, it was offered as security<\/p>\n<p>to one Shibu Varghese and the complainant Mathai Thomas<\/p>\n<p>somehow managed to get possession of the cheque from Shibu<\/p>\n<p>Varghese. If the petitioner had given the cheque in question in<\/p>\n<p>the form of a signed blank cheque as a security to Shibu<\/p>\n<p>Varghese towards whom he admittedly owe liability, then the<\/p>\n<p>natural presumption is that it was intended to be used as a<\/p>\n<p><span class=\"hidden_text\">CRL.R.P. NO. 2104\/2008            : 2:<\/span><\/p>\n<p>negotiable instrument in the event of the petitioner committed<\/p>\n<p>default in paying amounts due to Shibu Varghese. After receipt<\/p>\n<p>of the statutory notice in this case from Mathai Thomas, the<\/p>\n<p>petitioner does not appear to have taken any steps against Shibu<\/p>\n<p>Varghese in the year 2005 itself for unauthorisedly parting with<\/p>\n<p>his possession of the cheque. For resolving the dispute raised by<\/p>\n<p>the petitioner,     the other writings in the cheque in question<\/p>\n<p>including the age of those writings need not be examined by<\/p>\n<p>sending the cheque for expert opinion. The learned Magistrate<\/p>\n<p>was right in rejecting the prayer of the petitioner. I am fortified<\/p>\n<p>in this conclusion by the decision in <a href=\"\/doc\/849578\/\">Francis v. Pradeep<\/a> (2004<\/p>\n<p>(2) KLT 1080) and <a href=\"\/doc\/1971050\/\">Baby Thomas v. T.T Paul and<\/a> another<\/p>\n<p>(2007(3) KHC 732).\n<\/p>\n<p>      This revision is accordingly dismissed.\n<\/p>\n<p>Dated this the 27th day of June, 2008.\n<\/p>\n<\/p>\n<p>                                       V.
