Justice A.K.BASHEER\n\n Dated :24\/05\/2007\n\n O R D E R\n                             A.K.BASHEER, J.\n\n                      -------------------------------------------\n\n                        W.P.(C)No.12750 of 2007\n\n                      -------------------------------------------\n\n                   Dated this the 24th day of May, 2007\n\n\n                                 JUDGMENT\n<\/pre>\n<p>      Petitioner   is   stated   to   be   the   Corporate   Manager   of   a<\/p>\n<p>Lower   Primary   School,   High   School   and   Vocational   Higher<\/p>\n<p>Secondary School run by a trust known in the name and style<\/p>\n<p>of Mujahideen Trust, Kochi.   Petitioner claims that the above<\/p>\n<p>schools are entitled to be recognised and declared as minority<\/p>\n<p>institutions.\n<\/p>\n<\/p>\n<p>      2.     It   is   on   record   that   petitioner   had   made   an   attempt<\/p>\n<p>for such a declaration from the Director of Public Instruction<\/p>\n<p>on   an   earlier   occasion.     In   response   to   the   application<\/p>\n<p>submitted by the petitioner, the Director of Public Instruction<\/p>\n<p>had informed the petitioner that in view of Ext.P3 order of the<\/p>\n<p>Government,   there   was   no   necessity   for   the   Government   to<\/p>\n<p>grant such a declaration.  Petitioner was however advised that<\/p>\n<p>he   may   claim   the   benefit   of   the   above   status   before   the<\/p>\n<p>educational   authority,   if   necessary,   while   considering   the<\/p>\n<p>request for approval of appointment of headmaster.<\/p>\n<p>W.P.(C)No.12750 of 2007<\/p>\n<p>                                    ::  2  ::\n<\/p>\n<\/p>\n<p>      3.        Learned   counsel   submits   that   petitioner   had<\/p>\n<p>preferred   Ext.P4   application   for   a   formal   declaration   yet<\/p>\n<p>again,   in   view   of   the   dictum   laid   down   by   this   court   in<\/p>\n<p><a href=\"\/doc\/94772\/\">Evan&#8217;s   U.P.   School   v.   State   of   Kerala<\/a>  [2001   (1)   KLT<\/p>\n<p>849].     The   said   application   is   still   pending   consideration<\/p>\n<p>before the Government.\n<\/p>\n<\/p>\n<p>      4.     I   have   heard   learned   Government   Pleader   also.     He<\/p>\n<p>submits  that  he   has  been  informed   that  the   Government   has<\/p>\n<p>constituted   a   high   level   Committee   to   formulate   principles<\/p>\n<p>and   guidelines   for   grant   of   declaration   of   minority   status   to<\/p>\n<p>certain institutions in the state.   The Government is awaiting<\/p>\n<p>the  report from the Committee.    He  further  submits  that the<\/p>\n<p>Government   will   take   a   decision   on   Ext.P4,   as   soon   as   the<\/p>\n<p>report   of   the   committee   is   received,   and   a   policy   decision   is<\/p>\n<p>taken.     He   prays   for   granting   reasonable   time   to   the<\/p>\n<p>Government   to   do   so.       Learned   counsel   for   the   petitioner<\/p>\n<p>submits   that   petitioner   will   be   satisfied,   if   an   appropriate<\/p>\n<p>direction in this regard is issued, stipulating a time frame.<\/p>\n<p>W.P.(C)No.12750 of 2007<\/p>\n<p>                                     ::  3  ::\n<\/p>\n<\/p>\n<p>       5.     In   the   above   facts   and   circumstances,   the   writ<\/p>\n<p>petition   is   disposed   of   with   a   direction   to   the   respondent   to<\/p>\n<p>take   a   decision   on   Ext.P4   strictly   on   its   merit   and   in<\/p>\n<p>accordance with law as expeditiously as possible, at any rate,<\/p>\n<p>within   six   months   from   the   date   of   receipt   of   a   copy   of   this<\/p>\n<p>judgment.  It will be open to the respondent to take a decision<\/p>\n<p>in   the   matter   after   calling   for   the   report   of   the   high   level<\/p>\n<p>committee.
