The appellants have<br \/>\nalso been convicted for an offence punishable under Section 498-A of<br \/>\nthe Indian Penal Code and sentenced to undergo rigorous imprisonment<br \/>\nfor two years and to pay a fine of Rs.1,000\/-, in case of default,<br \/>\nfurther simple imprisonment for three months has been awarded.<br \/>\nAgainst this judgement and order, the present appeal has been<br \/>\npreferred by the appellants.\n<\/p>\n<p>2.\t\tThe<br \/>\nappellants are facing charge of committing murder of Sunanda ?  wife<br \/>\nof accused No.1. Deceased was forced to bring money from her parental<br \/>\nhouse. Likewise, on 4th November,1996, when appellant no.1<br \/>\ntold her to prepare break-fast, deceased replied that it will take<br \/>\nsome time and, therefore, appellants set the deceased to fire. This<br \/>\nis a charge, which they are facing in Sessions Case No.15 of 1997.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel for the appellants submitted that appellant No.1 is<br \/>\nabsconding, as per report dated 23rd April,2002 given by<br \/>\nInspector General of Police and also as per the report dated 28th<br \/>\nApril,2008 recently received from Baroda Central Jail. It is also<br \/>\nsubmitted by learned counsel for the appellants that appellant No.2<br \/>\nhas expired on 12nd October,2003. Learned Additional<br \/>\nPublic Prosecutor has produced death certificate of appellant no.2<br \/>\nand submitted that death of appellant no.2 has been registered at<br \/>\nVillage: Mangrul, Taluka: Parola, District: Jalgaon, Maharashtra. A<br \/>\nphotocopy of the same is taken on the record of the case.\n<\/p>\n<p>4.\t\tLooking<br \/>\nto the aforesaid submission and looking to the fact that appellant<br \/>\nNo.2 has expired, appeal qua appellant no.2 is abated.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the judgement delivered by this Court vide order dated 17th<br \/>\nNovember,2008 passed in Criminal Appeal No.1375 of 1993 read with<br \/>\njudgement dated 23rd October,2008 delivered by this<br \/>\nDivision Bench in Criminal Appeal No.1131 of 1997, as the appellant<br \/>\nNo.1 is absconding, appeal qua appellant No.1 deserves to be<br \/>\ndismissed.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe decision dated 23rd October,2008 rendered by<br \/>\nthis Division Bench in Criminal Appeal No.1131 of 1997, it has<br \/>\nbeen observed in para-8(vi) and 8(vii), as under:\n<\/p>\n<p>?S8.\t(vi)\t&#8230;&#8230;.\n<\/p>\n<p>\t Thus,<br \/>\ndeliberate action or positive action reveals the intention of the<br \/>\nappellant which shows that he has no respect to the Constitution of<br \/>\nIndia and he has committed breach of the fundamental duty enshrined<br \/>\nunder Sub-article (a) of Article 51-A of the Constitution of India or<br \/>\nit also reveals intention of the appellant that he has no faith in<br \/>\njustice delivery system. &#8230;&#8230;&#8230; &#8230;&#8230;.. \t Those,<br \/>\nwho are expecting their criminal appeals against conviction, to be<br \/>\nheard on merits, cannot remain absconding. &#8230;..\n<\/p>\n<p>\t(vii)\t&#8230;..  This<br \/>\nappeal is hereby dismissed only on the ground that the<br \/>\nappellant-accused is absconding and is not available to the Court,<br \/>\nnor is present in the Court. As and when he surrenders or is arrested<br \/>\nby the police, he may prefer an application for restoration of the<br \/>\nappeal. We do not want to encourage the absconding accused for<br \/>\nremaining absconding by hearing his criminal appeal on merits. It<br \/>\nalso encourages, who are in jail to jump the bail or furlough.<br \/>\nLeniency shown towards criminals is a threat to innocent<br \/>\npersons&#8230;&#8230;??\n<\/p>\n<p>\t\t\t\t\t\t(Emphasis<br \/>\nsupplied)<\/p>\n<p>7.\t\tIn<br \/>\nview of the aforesaid decision and also keeping in mind the fact that<br \/>\nthe appellant No.1- original accused No.1 is absconding, the present<br \/>\nappeal qua appellant No.1 is dismissed only on this ground. As and<br \/>\nwhen appellant No.1 -original accused No.1 surrenders to the jail<br \/>\nauthority or is arrested by the police, he is at liberty to prefer an<br \/>\napplication for revival of this appeal and if such application is not<br \/>\nunreasonably excessively time-barred as stated in the aforesaid<br \/>\njudgement, then, this Criminal Appeal will be revived or restored.\n<\/p>\n<p>8.\t\tFor<br \/>\nthe aforesaid reasons, as appellant No.1 ?  original accused no.1 is<br \/>\nabsconding, appeal qua appellant no.1 is dismissed. So far as<br \/>\nappellant No.2 is concerned, as appellant No.2 has expired, the<br \/>\nappeal qua appellant No.2 is treated as abated.
