(J)\n\nCITATION:\n 1994 SCC  (4) 687\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t   ORDER\n<\/p>\n<p>1.We  have heard Shri R.K. Jain, learned  Senior  Counsel<br \/>\nfor the petitioner and Shri Yogeshwar Prasad, learned Senior<br \/>\nCounsel for the State of Uttar Pradesh.\t This writ  petition<br \/>\nraises\tcertain\t serious  and important\t issues\t as  to\t the<br \/>\nmeaning of judicial independence in relation to the judicial<br \/>\nservices  and  the means by which it should be\tensured\t and<br \/>\nprotected.   Incidental\t to the requirement  of\t maintaining<br \/>\nsuch independence of the judiciary, it is of importance that<br \/>\nmembers\t of  the  judicial services should  not\t work  under<br \/>\napprehensions  of retaliatory action by the Police  and\t the<br \/>\nExecutive whatever form such action might assume.\n<\/p>\n<p>2.We make an interim order that no crime or criminal case<br \/>\nshall be registered against a judicial officer in respect of<br \/>\nanything  allegedly  done  or purported to be  done  in\t the<br \/>\ndischarge  of his duty or in his capacity as holder of\tsuch<br \/>\njudicial  office without the prior permission of  the  Chief<br \/>\nJustice of the High Court concerned.  In making this interim<br \/>\norder,\twe take into account the observations of this  Court<br \/>\nin <a href=\"\/doc\/1269046\/\">K. Veeraswami v. Union of India&#8217;<\/a> where, in the context of<br \/>\nJudges\tof the superior courts, it was observed :  (SCC\t pp.<br \/>\n707-09, paras 59 and 60)<br \/>\n\t      &#8220;59.  There is, however, apprehension that the<br \/>\n\t      executive being the largest litigant is likely<br \/>\n\t      to  misuse the power to prosecute the  Judges.<br \/>\n\t      That   apprehension  in\tour   over-litigious<br \/>\n\t      society\tseems  to  be  not  unjustified\t  or<br \/>\n\t      unfounded.  The Act no doubt provides  certain<br \/>\n\t      safeguards.   Section  6 providing  for  prior<br \/>\n\t      sanction\tfrom  the  competent  authority\t and<br \/>\n\t      directing that no court shall take  cognisance<br \/>\n\t      of the offence under Section 5(1) without such<br \/>\n\t      prior  sanction  is indeed  a  protection\t for<br \/>\n\t      Judges\tfrom   frivolous    and\t   malicious<br \/>\n\t      prosecution.   It\t is a settled law  that\t the<br \/>\n\t      authority\t entitled  to  grant  sanction\tmust<br \/>\n\t      apply  its mind to the facts of the  case\t and<br \/>\n\t      all  the evidence collected before forming  an<br \/>\n\t      opinion  whether\tto grant  sanction  or\tnot.<br \/>\n\t      Secondly,\t the trial is by the court which  is<br \/>\n\t      independent  of  the  executive.\t But   these<br \/>\n\t      safeguards may not be adequate.  Any complaint<br \/>\n\t      against  a Judge and its investigation by\t the<br \/>\n\t      CBI,  if\tgiven  publicity will  have  a\tfar-<br \/>\n\t      reaching impact on the Judge and the  litigant<br \/>\n\t      public.\tThe need therefore, is\ta  judicious<br \/>\n\t      use  of  taking action under  the\t Act.\tCare<br \/>\n\t      should  be  taken\t that  honest  and  fearless<br \/>\n\t      judges  are  not\tharassed.   They  should  be<br \/>\n\t      protected.\n<\/p>\n<p>\t      60&#8230;.   We  therefore,  direct\tthat   no<br \/>\n\t      criminal\t case  shall  be  registered   under<br \/>\n\t      Section  154 CrPC against a Judge of the\tHigh<br \/>\n\t      Court, Chief Justice of High Court or Judge of<br \/>\n\t      the Supreme Court unless the Chief Justice of<br \/>\n\t      1\t    (1991) 3 SCC 655<br \/>\n<span class=\"hidden_text\">\t      689<\/span><br \/>\n\t      India is consulted in the matter.\t Due  regard<br \/>\n\t      must be given by the Government to the opinion<br \/>\n\t      expressed by the Chief Justice.  If the  Chief<br \/>\n\t      Justice  is  of opinion that it is not  a\t fit<br \/>\n\t      case  for proceeding under the Act,  the\tcase<br \/>\n\t      shall not be registered.&#8221;\n<\/p>\n<p>\t      3.In Delhi Judicial Service Association v.<br \/>\n\t      State  of\t Gujarat2  this\t Court\tissued\t the<br \/>\n\t      following guidelines : (SCC pp. 411-12)<br \/>\n\t      &#8220;(A) A Judicial Officer should be arrested for<br \/>\n\t      any offence under intimation to District Judge<br \/>\n\t      or the High Court as the case may be.<br \/>\n\t      (B) In case of  necessity for immediate arrest<br \/>\n\t      of  a  Judicial Officer only  a  technical  or<br \/>\n\t      formal arrest may be effected.\n<\/p>\n<p>\t      (C)The  fact  of\tsuch  arrest  should   be<br \/>\n\t      immediately  communicated to the District\t and<br \/>\n\t      Sessions\tJudge of the concerned District\t and<br \/>\n\t      the Chief Justice of the High Court.<br \/>\n\t      (D)The  Judicial Officer so arrested  shall<br \/>\n\t      not be taken to a police station, without\t the<br \/>\n\t      prior order or directions of the District\t and<br \/>\n\t      Sessions\tJudge of the concerned district,  if<br \/>\n\t      available.\n<\/p>\n<p>\t      (E)Immediate  facilities shall be\t provided<br \/>\n\t      to the Judicial Officer for communication with<br \/>\n\t      his   family  members,  legal   advisers\t and<br \/>\n\t      Judicial Officers, including the District\t and<br \/>\n\t      Sessions Judge.\n<\/p>\n<p>\t      (F)No  statement of a Judicial Officer who  is<br \/>\n\t      under arrest be recorded nor any panchnama  be<br \/>\n\t      drawn  up nor any medical tests  be  conducted<br \/>\n\t      except in the presence of the Legal Adviser of<br \/>\n\t      the  Judicial  Officer  concerned\t or  another<br \/>\n\t      Judicial\tOfficer of equal or higher rank,  if<br \/>\n\t      available.\n<\/p>\n<p>\t      (G) Ordinarily there should be no\t handcuffing<br \/>\n\t      of a Judicial Officer.\n<\/p>\n<p>\t      The  above guidelines are not  exhaustive\t but<br \/>\n\t      these  are  minimum safeguards which  must  be<br \/>\n\t      observed\tin  case  of arrest  of\t a  Judicial<br \/>\n\t      Officer.\t   These   guidelines\tshould\t  be<br \/>\n\t      implemented by the State Government as well as<br \/>\n\t      by the High Courts.&#8221;\n<\/p>\n<p>The  aforesaid\tguidelines were in regard  to  all  offences<br \/>\ngenerally; but when any criminal conduct is attributed to  a<br \/>\nJudicial Officer in discharge of his duties or in  purported<br \/>\nexercise  or  discharge of his duties, we  direct  that,  in<br \/>\naddition,  no crime for investigation should  be  registered<br \/>\npursuant  to  any FIR without the permission  of  the  Chief<br \/>\nJustice of the High Court concerned.\n<\/p>\n<p>4.
