DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/04\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>It<br \/>\n\tis submitted that the Applicant No.1 is a Sarpanch and Applicant<br \/>\n\tNo.2 is serving as Primary Teacher in the District at Banaskantha<br \/>\n\tand Applicant No.3 is agriculturist.\n<\/p>\n<p>Initially,<br \/>\n\twhen the injured was referred to the Medical Officer at Satlasana,<br \/>\n\tin a history given by himself, none of the Applicants&#8217; name was<br \/>\n\treferred.  One of the main injury alleged to have been inflicted by<br \/>\n\tone Vanraj Singh by a dharia blow<br \/>\n\tand other injuries are about contusion, abrasion, and fracture of<br \/>\n\tAlna. It is further submitted that the Applicants are available for<br \/>\n\tinvestigation and they have deep roots in the society. It is<br \/>\n\ttherefore submitted that in view of the above, the Applicants may be<br \/>\n\tgranted anticipatory bail.\n<\/p>\n<p>\tHeard<br \/>\n\tlearned APP for the Respondent &#8211; State.\n<\/p>\n<p>\tHaving<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the Applicants and punishment<br \/>\n\tprescribed for the alleged offences, without discussing the evidence<br \/>\n\tin detail at this stage, I am inclined to grant anticipatory bail to<br \/>\n\tthe Applicants.\n<\/p>\n<p>This<br \/>\n\tCourt has also taken into consideration the law laid down by the<br \/>\n\tApex Court in the case of <a href=\"\/doc\/1108032\/\">Siddharam<br \/>\n\tSatlingappa Mhetre v. State of Maharashtra &amp; Ors.,<\/a><br \/>\n\treported in (2011)1<br \/>\n\tSCC 694,<br \/>\n\twherein the Apex Court reiterated the law laid down by the<br \/>\n\tConstitutional Bench in the case of Shri<br \/>\n\tGurubaksh Singh Sibbia &amp; Ors.,<br \/>\n\treported in (1980)<br \/>\n\t2 SCC 565.\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>\tIn<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of Applicants herein being arrested pursuant to FIR being I-CR<br \/>\n\tNo. 14 of 2011 registered with Satlasana Police Station for the<br \/>\n\toffences punishable under Sections 147, 148, 149, 324, 323 and 504<br \/>\n\tof the Indian Penal Cod3, the Applicants shall be released on bail<br \/>\n\ton furnishing a bond of Rs.10,000\/- (Rupees Ten thousand only) each<br \/>\n\twith one surety of the like amount on following conditions:\n<\/p>\n<p>\t(a)\tshall<br \/>\n\tcooperate with the investigation and make themselves available for<br \/>\n\tinterrogation whenever required.\n<\/p>\n<p>\t(b)\tshall<br \/>\n\tremain present at concerned Police Station on 19.4.2011 between<br \/>\n\t11:00 am to 2:00 pm.  <\/p>\n<p>\t(c)\tshall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them from disclosing such facts to the Court or to<br \/>\n\tany Police Officer.\n<\/p>\n<p>\t(d)\tshall<br \/>\n\tat the time of execution of bond, furnish the address to the<br \/>\n\tInvestigating Officer and the Court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case or till further<br \/>\n\torders.\n<\/p>\n<p>\t(e)\twill<br \/>\n\tnot leave India without the permission of the Court, and if are<br \/>\n\tholding a Passports, shall surrender the same before the trial Court<br \/>\n\timmediately.\n<\/p>\n<p>\t(f)\tIt<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits.\n<\/p>\n<p>\t(g)\tDespite<br \/>\n\tthis order, it would be open for the Investigating Agency to apply<br \/>\n\tto the competent Magistrate, for police remand of the Applicants.<br \/>\n\tThe Applicants shall remain present before the learned Magistrate on<br \/>\n\tthe first date of hearing of such application and on all subsequent<br \/>\n\toccasions, as may be directed by the learned Magistrate.  This would<br \/>\n\tbe sufficient to treat the accused in judicial custody for the<br \/>\n\tpurpose of entertaining application of the prosecution for police<br \/>\n\tremand.  This is, however, without prejudice to the right of the<br \/>\n\taccused to seek stay against an order of remand, if ultimately<br \/>\n\tgranted, and the power of the learned Magistrate to consider such a<br \/>\n\trequest in accordance with law.  It is clarified that the<br \/>\n\tApplicants, even if, remanded to the police custody, upon completion<br \/>\n\tof such period of police remand, shall be set free immediately,<br \/>\n\tsubject to other conditions of this anticipatory bail order.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute.  Application is disposed of accordingly.\n<\/p>\n<p>\tDirect<br \/>\n\tservice is permitted.\n<\/p>\n<p>(Anant<br \/>\nS.
