Kuriakose, J.\n<\/p>\n<p>     These are appeals by the Government and under<\/p>\n<p>challenge is the common judgment of the Land Acquisition<\/p>\n<p>Reference Court, Manjeri in as many as ten cases. The<\/p>\n<p>acquisition was of property in Manjeri Village and was for<\/p>\n<p>the purpose of construction of Manjeri Bye-pass.              The<\/p>\n<p>relevant section 4(1) notification was published on 9-9-<\/p>\n<p>1997. The land acquisition officer awarded land value at the<\/p>\n<p>rate of Rs.4255\/- per cent. The reference court tried all the<\/p>\n<p>ten LARs jointly and the evidence consisted of oral evidence<\/p>\n<p>of Aws. 1 to 4 and        RW-1,    Exts.A1 to A5, Ext.R1 and<\/p>\n<p>Commissioners&#8217; reports X-1 (series). Exts.A1 and A5 were<\/p>\n<p>two documents which were relied on by the claimants in<\/p>\n<p>support of their claim for enhanced land value. The learned<\/p>\n<p>Subordinate Judge did not become inclined to place reliance<\/p>\n<p>LAA. Nos. 216 &amp; 436 of 2008<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>on Ext.A5 on reasons which we also feel are good.<\/p>\n<p>Commissioners&#8217; reports certainly reveal that the properties<\/p>\n<p>under acquisition had locational advantages and that the<\/p>\n<p>properties had the potentialities of having developed as<\/p>\n<p>building sites. What we notice from the judgment is that<\/p>\n<p>after rejecting Exts.A1 and A5 on good reasons the court<\/p>\n<p>below has granted enhancement by Rs.12,000\/-. Thus the<\/p>\n<p>land value was enhanced by three times of what was<\/p>\n<p>awarded by the L.A. Officer solely on the basis of the<\/p>\n<p>Commissioners&#8217; reports and on a guess work which was<\/p>\n<p>done by the learned Sub Judge based on the oral evidence<\/p>\n<p>adduced by the parties. It is certainly correct to say that<\/p>\n<p>determination of market value in land acquisition cases will<\/p>\n<p>involve guess work and evaluation of imponderables. But<\/p>\n<p>we are unable to approve the action of the learned<\/p>\n<p>Subordinate Judge in having awarded enhancement by this<\/p>\n<p>LAA. Nos. 216 &amp; 436 of 2008<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>extent relying solely on guess work. There is another well<\/p>\n<p>settled principle that in order that guess work done by a<\/p>\n<p>Land Acquisition Court is a good guess work, the guess<\/p>\n<p>should have some nexus to the evidence on record. In this<\/p>\n<p>batch of cases, the two tangible items of evidence were A1<\/p>\n<p>and A5, which were rejected by the reference court.<\/p>\n<p>Therefore in our opinion it is not a good guess that has been<\/p>\n<p>done by the learned Subordinate Judge regarding the<\/p>\n<p>market value of the property.\n<\/p>\n<p>     2. Sri. S.A. Saju, learned counsel for the respondents<\/p>\n<p>claimants sought for an opportunity to adduce further<\/p>\n<p>evidence in these cases and requested that the cases be<\/p>\n<p>remanded. Mr.Basant Balaji, learned senior Govt. Pleader<\/p>\n<p>submits that in case this court is being inclined to accept the<\/p>\n<p>above request the interest of the State should be protected<\/p>\n<p>and it should be provided in the judgment that the claimants<\/p>\n<p>LAA. Nos. 216 &amp; 436 of 2008<br \/>\n<span class=\"hidden_text\">                               -4-<\/span><\/p>\n<p>who are responsible for the order of remand will not gain by<\/p>\n<p>way of statutory interest under section 28. We find force in<\/p>\n<p>the above submission of the learned Govt. Pleader.<\/p>\n<p>     3. The result of the above discussion therefore is as<\/p>\n<p>follows:\n<\/p>\n<p>     4. The judgments and decrees under appeals are set<\/p>\n<p>aside.    LAR. Nos. 74 &amp; 57 of 2001 are remanded to the<\/p>\n<p>Subordinate Judge&#8217;s Court, Manjeri. That Court is directed<\/p>\n<p>to give one opportunity each to the claimants and also to<\/p>\n<p>the Government for adducing evidence.       That Court will<\/p>\n<p>complete the further enquiry within three months of parties<\/p>\n<p>entering appearance before the Court below and pass<\/p>\n<p>revised judgment within one month thereafter. It is made<\/p>\n<p>clear that in case under the revised judgment the appellants<\/p>\n<p>become eligible for more than cent per cent of the value<\/p>\n<p>awarded by the L.A. Officer, such excess compensation<\/p>\n<p>LAA. Nos. 216 &amp; 436 of 2008<br \/>\n<span class=\"hidden_text\">                                -5-<\/span><\/p>\n<p>exceeding the cent per cent will not carry interest otherwise<\/p>\n<p>admissible under section 28 during the period from 28-2-<\/p>\n<p>2007 till the date of the revised judgments to be passed in<\/p>\n<p>these cases.\n<\/p>\n<p>     Appeals are allowed by way of remand.
