Niharika is the slaughter of\n\n  Rcsoondcnt No.2 is the mother of the\n\n  n;k\"\"'.\";I. Petitioner No.1 H.B.Manjunatb. is the\n\n\":uiIO'\u00a3Vh.2tIrV Gowda and Petitioner No.2 H.L.S1:1arath\n\nZ  is thAe---gOn_'vOf a\ufb01oihcr bmther Of Late.Narayana Gowda. Both the\n\n\" \" 'TT'-.$2\u20ac\u00a7i\ufb01.Q}3.C2'\u00a73,_.'\u00e9OI1fE11d that the permission granted to $631 or alienate\n\n2'   ';mi1jI.o1\"s share in the undivided property is iilcgal.\n\n3. The petition. seeking permission to alienate the minofs\n\n  \"Interest was \ufb02ied under Section 29 of the Guardian and Waxtis\n\n%\n\n\n\n3\nAct readwith Section 8 of the Hindu. Minority and Gualxiianship\n\nAct contending that in View of the needs of the mine; \n\nxequimmem: to discharge the loan incurred by   'bf; \n\nmm.\" or girl, Late Narayaua gowda, itihiiiiaxi \"1   \n\nseek permission of the Court to  of {he  intexest\nof the minor girl in the   ii\n\n4. The objections raised\n\nby theA.;_setitioi:i\u00a7e1:e hereiii gigs to the effect that the petiiionere\n\n iii:-.v\u00abe    right over the property as the 21\"'\n\n of the minor girl had agreed to seli the\n\ni    in  It was further contended by them that\n\n wasiio necessity for the property to be sold md the\n\n   could be managed effectively with the help and support\n\n  {he pe\ufb01tionexs herein. It was also aliegm that the sak was not\n\n   the interest of the miner girl. The petitioners further urged\n\nthat they had already instituted a suit in O.S.No.-40\/200? on the\n\nkw\n\n\n\n\ufb01le of the Additional Civii Judge (Jr.Dn.) \n\ndirection to defendants 1 and 2 to ca\ufb02   \n\npurchase the plaint schedule   the :4\n\nageement dated 10. 10.2005.\n\n5. The Court below  the entire\nmaterials on record hae who sought\npermission to sell'  minofe  other than the\nmother and tlrze   of  The Court below\nhas also  admittedly there were\n of khata between the petitioners\n\nand the xeepondente  the death of Narayana Gowda. It\n\n has  taicen  of the important fact that there were\n\n   Eoblitga\ufb01ons  debts to be discharged by the family\n\neonsietingev\u00e9bfV.pv_th:e'-:t1other and the minor girl. As there was no\n\n _a}ternative'  the natmai guaztiian except to dispose of the\n\niizoperties, so as to meet the requirements of\n\n  the loan and also to ensure proper education and\n\n  wsheilter for the minor, the Court below found it necessary to gent\n\n\" \u00ab * 'permission as sought for.\n\nFe\"\n\n\n\n5\n6. In so far as the contention urged by the petitionexs\n\nherein Iegaxding their right of preemption, them 'has\n\nobserved that it is for the petitioners to establish   \n\nthe suit \ufb01led by them.
