GOVERNMENT PLEADER for\nRespondents.\n \n\n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\nDate\n: 16\/07\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>\t\tLeave<br \/>\nto Amend.\n<\/p>\n<p>1.0\t\tBy<br \/>\nway of<br \/>\nthis petition, the detenu has challenged the order of detention dated<br \/>\n21.11.2007 passed by District Magistrate, Valsad under the provisions<br \/>\nof sub-Section (2) of Section 3 of the Gujarat Prevention of<br \/>\nAnti-social Activities Act, 1985 (hereinafter referred to as the<br \/>\n&#8216;PASA Act&#8217;).\n<\/p>\n<p>2.0\t\tLearned<br \/>\nAdvocate for the detenu has invited my attention to the order of<br \/>\ndetention dated 21.11.2007 by which detenu was arrested and sent to<br \/>\nRajkot Jail as well as to the grounds supplied therein. As per the<br \/>\ngrounds of detention, two criminal cases are shown as registered<br \/>\nagainst the detenu which pertains to &#8216;Prohibition&#8217;.\n<\/p>\n<p>2.1\t\tHe<br \/>\nhas further submitted that in the order of detention it was stated<br \/>\nthat the detenu is carrying on anti-social activities and on the<br \/>\nbasis of aforesaid offences of &#8216;bootlegging&#8217; registered against the<br \/>\ndetenu, he was termed as &#8216;Bootlegger&#8217; within the meaning of Section<br \/>\n2(b)of the P.A.S.A. Act. It was also stated in the impugned order<br \/>\nthat as the said bootlegging activities of the detenu are dangerous<br \/>\nand affecting maintenance of &#8216;public order&#8217; and &#8216;public health&#8217;,<br \/>\norder of detention has been passed against him.\n<\/p>\n<p>2.2\t\tHe<br \/>\nhas submitted that on the basis of aforesaid criminal cases<br \/>\nregistered against the detenu, it cannot be said that the activities<br \/>\nof the detenu has become prejudicial to the maintenance of &#8216;Public<br \/>\nOrder&#8217;. In support of his case he has placed reliance<br \/>\non a decision of the Hon&#8217;ble Apex<br \/>\nCourt in the case of \u00fdSArun Ghosh Vs. State of West<br \/>\nBengal\u00fd\u00fd 1970(1)SCC 98<br \/>\nwherein the Hon&#8217;ble Apex Court at Para-3 held as under,<\/p>\n<p>\u00fdS&#8230;that<br \/>\ndisturbance of public order is to be distinguished from acts directed<br \/>\nagainst individuals which do not disturb the society to the extent of<br \/>\ncausing a general disturbance of public tranquility.  It is the<br \/>\ndegree of disturbance and its effect upon the life of the community<br \/>\nin a locality which determines whether the disturbance amounts only<br \/>\nto a breach of law and order. The question whether a man has only<br \/>\ncommitted a breach of law and order or has acted in a manner likely<br \/>\nto cause a disturbance of the public order is a question of degree<br \/>\nand the extent of the reach of the act upon the society.  There is no<br \/>\nformula by which one case can be distinguished from another.\u00fd\u00fd<\/p>\n<p>2.3\t\tSimilar<br \/>\nprinciple has been followed by the Hon&#8217;ble Apex Court in the case of<br \/>\n\u00fdSDarpan @ Dharban Kumar Sharma Vs. State of Tamil Nadu and<br \/>\nOrs.\u00fd\u00fd reported in (2003)2 SCC 313 and by this Court in the<br \/>\ncase of \u00fdSSurajsinh @ Suru @ Suresh Lallusinh Rajput Vs. State<br \/>\nof Gujarat and Ors.\u00fd\u00fd reported in 2004(1)GLH 454.\n<\/p>\n<p>3.0\t\tThe<br \/>\nlearned A.G.P. for respondent-detaining Authority has supported the<br \/>\norder of detention as well as grounds stated therein and has<br \/>\ncontended that the Authority has passed the impugned order after<br \/>\ntaking into consideration all the facts and circumstances of the<br \/>\ncase, and hence, no case is made out calling for interference of this<br \/>\nCourt.\n<\/p>\n<p>4.0\t\tAs<br \/>\na result of hearing and perusal of the record it appears that in this<br \/>\ncase the only material is aforesaid criminal cases registered against<br \/>\nthe detenu and on the basis of that it cannot be said that the<br \/>\nactivity of the detenu has become a threat to the maintenance of<br \/>\n&#8216;public order&#8217; and &#8216;public health&#8217;.  The offences registered against<br \/>\nthe detenu pertains to prohibition to which I have already made<br \/>\nreference in my earlier part of the judgment. Mere involvement of<br \/>\ndetenu in bootlegging activities may not amount to dangerous activity<br \/>\nby detenu and mere mention of them unless supported by any evidence<br \/>\ncannot be said to be material and germane for the purpose of arriving<br \/>\nat subjective satisfaction that the activity of the detenu is<br \/>\nprejudicial to the maintenance of &#8216;public order&#8217; and &#8216;public health&#8217;.\n<\/p>\n<p>4.1<br \/>\nI am, therefore, of the view that the detaining authority has passed<br \/>\nthe order of detention without there being any credible or cogent<br \/>\nmaterial on record in this behalf.  I have  considered factual and<br \/>\nlegal aspects emerging from the record and also considered the rival<br \/>\nsubmissions and the facts of the case and also considered the<br \/>\njudgment of the Hon&#8217;ble Apex Court in the case of \u00fdSArun<br \/>\nGhosh\u00fd\u00fd(Supra) as well as<br \/>\n\u00fdSDarpan @ Dharban Kumar Sharma\u00fd\u00fd(Supra)<br \/>\nand the<br \/>\njudgment of this Court in the case of \u00fdSSurajsinh<br \/>\n@ Suru @ Suresh Lallusinh Rajput\u00fd\u00fd (Supra).<br \/>\nIn view of the facts and circumstances of the present case and in<br \/>\nview of the ratio laid down in the decision mentioned above, the<br \/>\norder of detention cannot be sustained and it deserves to be quashed<br \/>\nand set aside.\n<\/p>\n<p>5.0\t\tIn<br \/>\nthe result, this petition is allowed. The order of detention dated<br \/>\n21.11.2007 passed by Police Commissioner, Ahmedabad is hereby quashed<br \/>\nand set aside.  The detenu is, therefore, ordered to be set at<br \/>\nliberty forthwith, if he is not required in connection with any other<br \/>\ncase by the Authority. Rule is made absolute.
