Bihpur,\n                    District-Bhagalpur.\n                                                        ----Petitioner\n                                                Versus\n                                        STATE OF BIHAR.\n                                              -----------\n<\/pre>\n<p>2.   11.10.2010                   Heard the learned counsel for the petitioner<\/p>\n<p>                   and the State.\n<\/p>\n<p>                                  The petitioner is apprehending his arrest in<\/p>\n<p>                   Complaint Case No.58C\/2009 for the alleged offences<\/p>\n<p>                   registered under sections 498A and 406 of the Indian<\/p>\n<p>                   Penal Code and section 3\/4 of the Dowry Prohibition Act.<\/p>\n<p>                   However, cognizance has been taken under section<\/p>\n<p>                   323\/406 of the Indian Penal Code.\n<\/p>\n<p>                                  It is submitted that the complaint has been<\/p>\n<p>                   filed for ulterior purposes. However, no cognizance has<\/p>\n<p>                   been taken under section 498A of the Indian Penal Code.<\/p>\n<p>                   There is no allegation of breach of trust.<\/p>\n<p>                             Considering the facts and circumstances of the<\/p>\n<p>                   case, let the petitioner above named, in the event of his<\/p>\n<p>                   arrest or surrender in connection with Complaint Case<\/p>\n<p>                   No58(c)\/2009 within a period of six weeks from today, be<\/p>\n<p>                   enlarged on bail on furnishing bail bond of Rs.10,000\/-<br \/>\n<span class=\"hidden_text\">                      -2-<\/span><\/p>\n<p>      (Ten thousand) with two sureties of the like amount each<\/p>\n<p>      to the satisfaction of the Sub-Divisional Judicial<\/p>\n<p>      Magistrate, Khagaria, in connection with the aforesaid<\/p>\n<p>      case, on the conditions mentioned in sub-section (2) of<\/p>\n<p>      section 438 of the Code of Criminal Procedure.<\/p>\n<pre>PNM                            (Shailesh Kumar Sinha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.Riyajuddin vs State Of Bihar on 11 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
