(ORAL)\n<\/pre>\n<p>             Result of the departmental test has been produced in Court in<\/p>\n<p>a sealed cover by the counsel for respondent No. 3 and the same is taken<\/p>\n<p>on record.\n<\/p>\n<p>             By this order I propose to dispose of CWP Nos. 2439 and<\/p>\n<p>3305 of 2011.\n<\/p>\n<p><span class=\"hidden_text\"> CWP No. 2439 of 2011                                            2<\/span><\/p>\n<p>            Both the petitioners in these writ petitions did take the<\/p>\n<p>departmental test but did not qualify the test but thereafter, one more test<\/p>\n<p>was held by giving them another chance to clear the departmental<\/p>\n<p>examination, in which they could not appear because of medical grounds.<\/p>\n<p>            As per the interim directions issued by this Court, the<\/p>\n<p>petitioners in these writ petitions were allowed to take the departmental<\/p>\n<p>test. In compliance with the order passed by this Court, the departmental<\/p>\n<p>test has been held by the respondents and counsel for respondent No. 3<\/p>\n<p>has produced a sealed cover containing the result of these two petitioners.<\/p>\n<p>            On opening the same, it transpires that Anupam Kaushal, who<\/p>\n<p>is the petitioner in CWP No. 2439 of 2011, belongs to the General<\/p>\n<p>Category has obtained 43 marks while the pass marks for this category<\/p>\n<p>were 35.    Renu Kumari, who is petitioner in CWP No. 3305 of 2011,<\/p>\n<p>belongs to the B.C. Category and has obtained 51 marks and for this<\/p>\n<p>category, the pass marks were 20. Both the petitioners, therefore, qualified<\/p>\n<p>the departmental examination.\n<\/p>\n<p>            The result of the petitioners is taken on record and marked as<\/p>\n<p>&#8216;A&#8217;.\n<\/p>\n<p>            In view of the above and in the light of the fact that the<\/p>\n<p>petitioners have passed the departmental test,        they shall continue in<\/p>\n<p>service as per the terms of contract.\n<\/p>\n<p>            Accordingly, both the writ petitions are allowed.
