    Petitioner filed C.M.P.896\/2009 before    Judicial<\/p>\n
First Class Magistrate Court, Aluva under section 451<\/p>\n
of Code of Criminal Procedure for interim custody of<\/p>\n
his passport, visa and ticket which were seized by the<\/p>\n
police when he arrived at Nedumbassery Airport from<\/p>\n
Soudhi  Arabia.    Learned  Magistrate  dismissed  the<\/p>\n
application under Annexure 6 order.  This petition is<\/p>\n
filed under section 482 of Code of Criminal Procedure<\/p>\n
to quash Annexure 6 order  and to get interim custody<\/p>\n
of the passport.\n<\/p>\n
    2.    Learned counsel counsel appearing for the<\/p>\n
petitioner  and  the learned  Public  Prosecutor  were<\/p>\n
heard.\n<\/p>\n
    3.   Learned counsel appearing for the petitioner<\/p>\n
submitted  that the correction in the passport is only<\/p>\n
with regard to the year of birth namely 1986      was<\/p>\n
corrected  as  1982 and  it  was  not  done    by  the<\/p>\n
petitioner  but  by  the  travel  agent and   in  such<\/p>\n
circumstance petitioner is entitled to get back the<\/p>\n

passport. Learned counsel submitted that unless he gets<\/p>\n
interim custody of the passport, he cannot return to Soudhi<\/p>\n
Arabia and if so will loose the job and therefore interim<\/p>\n
custody is to be granted.     Learned counsel also pointed out<\/p>\n
that for an offence under section 12(1)(b) (d) of Passport<\/p>\n
Act petitioner could only be sentenced to fine and in such<\/p>\n
circumstance      petitioner may be granted interim custody of<\/p>\n
the passport and he is prepared to abide by the conditions.<\/p>\n
      4.    Learned Public Prosecutor opposed the application<\/p>\n
and submitted that in addition to the offence under the<\/p>\n
Passport Act, case is being investigated      for the offences<\/p>\n
under sections 468,419 and 471 of Indian Penal Code        and<\/p>\n
when it is clear that there is unauthorised correction of<\/p>\n
year of birth in the passport, petitioner cannot be allowed<\/p>\n
to make use of that passport and as the passport is<\/p>\n
necessary as a material object to be proved in the case,<\/p>\n
interim custody cannot be granted.\n<\/p>\n
      5. I find force in the submission of the learned Public<\/p>\n
Prosecutor.      When it is prima facie shown that  correction<\/p>\n
had been effected to in the passport          obtained by the<\/p>\n
petitioner with regard to the year of birth and the case is<\/p>\n
being investigated for the offence under section 468 and<\/p>\n
471, petitioner cannot be granted interim custody of the<\/p>\n
same passport.      In any event petitioner cannot be allowed<\/p>\n

to make use of the passport where correction is made.<\/p>\n
Learned    counsel  then  submitted that    there  may  be  a<\/p>\n
direction to the Magistrate to       dispose the case before<\/p>\n
August,2009.     Learned Public Prosecutor submitted that the<\/p>\n
case is still under investigation and report of the expert<\/p>\n
is awaited.      In such circumstance, no direction could be<\/p>\n
issued to dispose the case as sought for.     The question of<\/p>\n
disposal arises only after taking cognizance on filing the<\/p>\n
final report.      The Investigating Officer is directed to<\/p>\n
expedite the investigation. Petition is dismissed.<\/p>\n
