RAMKUMAR, J.\n                 = = = = = = = = = = = = =\n                   Crl.R.P.No.942 of 2008\n                = = = = = = = = = = = = = =\n                         6.01.2010\n\n                           ORDER\n<\/pre>\n<p>     The complainant in a prosecution under Section 138 of<\/p>\n<p>the Negotiable Instruments Act initiated as C.C.No.334 of<\/p>\n<p>2000 before the Chief Judicial Magistrate, Pathanamthitta<\/p>\n<p>involving a cheque for Rs.1 lakh challenges the sentence<\/p>\n<p>imposed by the Additional Sessions Judge (Adhoc) Fast<\/p>\n<p>Track -II, Pathanamthitta     in Crl.Appeal No.10 of 2003<\/p>\n<p>confirming the sentence of fine of Rs.50,000\/- imposed by<\/p>\n<p>the trial court. According to the revision petitioner, the<\/p>\n<p>courts below ought to have directed the fine amount to be<\/p>\n<p>paid as compensation to the revision petitioner.<\/p>\n<p>     2. I am not inclined to accede to the above submission,<\/p>\n<p>because admittedly the revision petitioner         did not<\/p>\n<p>challenge the sentence imposed by the trial court. It is not<\/p>\n<p>disputed that he was heard by the lower appellate court in<\/p>\n<p>Crl. R.P. No. 942 of 2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>the appeal filed by the accused against the conviction and<\/p>\n<p>sentence. He could have preferred a revision before the<\/p>\n<p>Sessions Court against the sentence passed by the trial<\/p>\n<p>court. Having not done so, he cannot now challenge the<\/p>\n<p>sentence passed by the lower appellate court.       As the<\/p>\n<p>revision petitioner failed to assail the sentence passed by<\/p>\n<p>the trial court, he is precluded from challenging the<\/p>\n<p>sentence passed by the lower Appellate Court. This revision<\/p>\n<p>is accordingly dismissed.\n<\/p>\n<\/p>\n<p>                                     V.
