Examination.\n<\/p>\n<p>The<br \/>\n\tshort facts of the case are as under:-\n<\/p>\n<p>The<br \/>\n\t\tfather of the petitioner Mohanbhai Patel who was serving with<br \/>\n\t\trespondent No.2, expired on 5th October, 2003.\n<\/p>\n<p>The<br \/>\n\t\tpetitioner thereafter on 26th December, 2003 made an<br \/>\n\t\tapplication for compassionate appointment along with all necessary<br \/>\n\t\tdocuments pursuant to death of his father.\n<\/p>\n<p>The<br \/>\n\t\tpetitioner was informed by respondent authority vide its<br \/>\n\t\tcommunication dated 29.9.2005 that his application for<br \/>\n\t\tcompassionate appointment is rejected since he was not having<br \/>\n\t\trequisite qualification of S.S.C. Examination. On 16.2.2006 Gujarat<br \/>\n\t\tSubordinate Services Selection Committee communicated the<br \/>\n\t\tpetitioner intimating about rejection of his application for<br \/>\n\t\tcompassionate appointment.\n<\/p>\n<p>Being<br \/>\n\t\taggrieved by the decision of the respondent authorities the<br \/>\n\t\tpetitioner has approached this Court by filing the present<br \/>\n\t\tpetition.\n<\/p>\n<p>The<br \/>\n\tlearned Counsel for the petitioner has submitted that there is no<br \/>\n\tdelay in preferring the application for compassionate appointment by<br \/>\n\tthe petitioner. The respondent authorities have committed grave<br \/>\n\terror rejecting the application of the applicant for compassionate<br \/>\n\tappointment on the ground that the petitioner was not having passed<br \/>\n\tS.S.C. Examination. The learned counsel for the petitioner has<br \/>\n\tsubmitted that the respondent authorities could not reject the<br \/>\n\tapplication applying the policy of Government Resolution dated<br \/>\n\t16.3.2005 since the petitioner has preferred application for<br \/>\n\tcompassionate appointment on 26.12.2003 and, therefore, the policy<br \/>\n\twhich prevailed at the time of making application for compassionate<br \/>\n\tappointment can only be applicable to the case of the petitioner. In<br \/>\n\tsupport of his submission, the learned counsel for the petitioner<br \/>\n\thas relied upon the decision of the Hon&#8217;ble the Supreme Court<br \/>\n\treported in (2007) 9 SCC 571 in<br \/>\n\tthe case of     State Bank of India<br \/>\n\tand Others v. Jaspal Kaur.   Relying on the aforesaid<br \/>\n\tdecision, the learned counsel for the petitioner has further<br \/>\n\tsubmitted that the petitioner has applied for compassionate<br \/>\n\tappointment on 26th December, 2003 and in view of the<br \/>\n\tabove decision, the respondent authorities are required to consider<br \/>\n\tthe case of the petitioner as per the policy prevailing at the time<br \/>\n\tof petitioner made application for compassionate appointment and as<br \/>\n\tper earlier prevailing policy the requisite qualification for<br \/>\n\tcompassionate appointment was from Standard IV to Std.IX. The<br \/>\n\tlearned Counsel for the petitioner has submitted that at that<br \/>\n\trelevant point of time the petitioner was having S.S.C mark-sheet<br \/>\n\tbut he failed in S.S.C. Exam. and as such he was possessing<br \/>\n\trequisite qualification as per policy prevailed at that point of<br \/>\n\ttime.\n<\/p>\n<p>I<br \/>\n\thave gone through the averments made in the petition and the<br \/>\n\tsubmissions made by the learned counsel for the petitioner. This<br \/>\n\tCourt is in complete agreement with the submissions made by the<br \/>\n\tlearned counsel for the petitioner regarding the decision of the<br \/>\n\tHon&#8217;ble the Supreme Court in the case of State<br \/>\n\tBank of India and Others v. Jaspal Kaur (supra). This<br \/>\n\tCourt is fully abide by the decision of the Hon&#8217;ble the Supreme<br \/>\n\tCourt and in view of the same the previous policy prevailing at the<br \/>\n\ttime of making application by the petitioner for compassionate<br \/>\n\tappointment can only be applicable to the case of the petitioner<br \/>\n\tinstead of the policy followed by Government Resolution dated<br \/>\n\t16.3.2005 relying on which the respondent authorities have rejected<br \/>\n\tthe application of the applicant-present petitioner.\n<\/p>\n<p>In<br \/>\n\tview of the above, the present petition is allowed. The order passed<br \/>\n\tby the respondent authorities is quashed and set aside. The<br \/>\n\trespondent authorities are directed to reconsider the case of the<br \/>\n\tpetitioner in view of the policy prevailing at the relevant point of<br \/>\n\ttime when the petitioner has applied for compassionate appointment<br \/>\n\timmediately after the death of his father.\n<\/p>\n<p>The<br \/>\n\tpetition is entertained only on the aspect following the decision of<br \/>\n\tthe Hon&#8217;ble the Supreme Court that the petitioner is entitled for<br \/>\n\tcompassionate appointment as per the policy prevailing at the time<br \/>\n\twhen the petitioner made application for compassionate appointment.<br \/>\n\tRule is made absolute.\n<\/p>\n<p>Direct<br \/>\n\tService is permitted.\n<\/p>\n<p>(K.S.JHAVERI,<br \/>\nJ.)<\/p>\n<p>Amit\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Ms Krina Calla Agp For &#8230;
