The writ petition has been filed by the petitioner<br \/>\nassailing the constitutional validity of Rule 1.9(1)(c) of M.P.<br \/>\nMedical &amp; Dental Post Graduate Entrance Examination Rules,<br \/>\n2010 {hereinafter referred to as the Rules of 2010}. The rule<br \/>\nprovides      that   in-service    candidates           who    have   done   post<br \/>\ngraduation in one subject {degree\/diploma} will not be eligible<br \/>\nfor admission in another subject. It is submitted in the petition<br \/>\nthat the petitioner completed the                  MBBS course in the year<br \/>\n1999; thereafter he joined the course of diploma in Obstetrics &amp;<br \/>\nGynecology in the year 2004. He has been appointed as<br \/>\nAssistant Surgeon through PSC on 24.9.2003. He joined the<br \/>\nservices on 28.5.2004. He has served in the rural area. The<br \/>\npetitioner was shown to be qualified in                 post graduate entrance<br \/>\ntest    2010,    counselling      started        from    3.4.2010.    The    State<br \/>\nGovernment has issued a sponsorship certificate dated 3.4.2010<br \/>\nwhich restricted the petitioner to opt for only                   Obstetrics &amp;<br \/>\nGynecology on the ground that the petitioner is holding diploma<br \/>\nin     the   same    subject.   The petitioner           has    submitted     that<br \/>\nrestriction imposed is unreasonable &amp; arbitrary. Rule 1.9(1)(c)<br \/>\nof     the   Rules    of   2010     is         unreasonable,     arbitrary    and<br \/>\ndiscriminatory. There is no logic behind it. In cases of other<br \/>\n<span class=\"hidden_text\">                                (2)<\/span><\/p>\n<p>candidates, the rule has been relaxed on earlier occasions. The<br \/>\nsaid rule deserves to be struck down.\n<\/p>\n<p>2.                Shri Arpan Pawar, learned counsel for the<br \/>\npetitioner has submitted that Rule 1.9(1)(c) of the Rules of 2010<br \/>\nimposes unreasonable restriction           by restricting the post<br \/>\ngraduation in the same subject in which diploma or degree is<br \/>\nheld. The rule illegally interferes in right to obtain education in<br \/>\nthe subject of the choice of the petitioner hence, the same is<br \/>\nultra vires. He has also submitted that on earlier occasions, the<br \/>\nrule has been relaxed and permission has been given to certain<br \/>\nincumbents to undertake different course than the diploma or<br \/>\ndegree which was held by them. The petitioner has been<br \/>\ndiscriminated with.\n<\/p>\n<p>3.                After   hearing     learned   counsel   for     the<br \/>\npetitioner, we are of the opinion that there is no merit in the<br \/>\npetition. Rule 1.9(1)(c) of the Rules of 2010 is quoted below:-\n<\/p>\n<blockquote><p>     &#8220;(c) The in-service candidates, who have done Post<br \/>\n     Graduation in one subject (degree\/diploma) will not<br \/>\n     be eligible for admission in another subject.&#8221;\n<\/p><\/blockquote>\n<p>4.                Admittedly, the petitioner holds the diploma in<br \/>\nObstetrics &amp; Gynecology. Thus, as per the aforesaid rule, he can<br \/>\nundertake the MS course in Obstetrics &amp; Gynecology. He cannot<br \/>\nopt for other stream of post graduation course. The rule<br \/>\ncontains reasonable restriction and cannot be said to be<br \/>\nviolative of Article 14 of the Constitution of India, it cannot be<br \/>\nsaid to be arbitrary or unreasonable provision. In case a person<br \/>\nis having degree or diploma in a particular subject, he becomes<br \/>\nthe expert of that subject and he is known for that expertise.<br \/>\nOne cannot be expected to be expert of several subjects. A<br \/>\nperson of medicine cannot claim that he should be permitted to<br \/>\nundertake post graduation course in surgery or vice versa.<br \/>\nSimilar is the case with other subjects. The restriction which has<br \/>\nbeen   imposed   is   considering    the   expertise gained     while<br \/>\nobtaining degree\/diploma. It is open for the petitioner to<br \/>\nundertake the degree course in the same subject in which he<br \/>\n<span class=\"hidden_text\">                                  (3)<\/span><\/p>\n<p>holds the diploma. The restriction imposed is in consonance<br \/>\nwith the requirement of the medical field which requires expert<br \/>\nof a particular field. It is unknown to the medical science that a<br \/>\nperson is having the post graduation degree of medicine and<br \/>\nsurgery or that of Obstetrics &amp; Gynecology at the same time. It<br \/>\nwould defeat the very concept of expertise to be obtained while<br \/>\ndoing degree\/diploma course in a particular subject. The rule<br \/>\nintends that a person should become the expert of the subject<br \/>\nwhich is known to him for which he has already acquired the<br \/>\nskill by pursuing degree\/diploma course.\n<\/p>\n<p>5.                Thus, the restriction which has been imposed<br \/>\ncannot be said to be unconstitutional in any manner. Striving<br \/>\ntowards the excellence in a particular field is the fundamental<br \/>\nduty of incumbent which has found expression under Article 51-<br \/>\nA of the Constitution of India which is the underlying idea of<br \/>\nRule 1.9(1)(c) of the Rules of 2010. Thus, the rule cannot be said<br \/>\nto be violative of any of the right of the petitioner.\n<\/p>\n<p>6.                Coming     to the submission raised by        the<br \/>\npetitioner&#8217;s counsel that the rule has been relaxed in certain<br \/>\nother cases, however, the counsel was unable to point out any<br \/>\nrule providing the relaxation to the extent claimed by the<br \/>\npetitioner. In case there was any violation of the rule earlier, the<br \/>\npetitioner cannot claim that he has been discriminated with. The<br \/>\nplea of discrimination is available     in cases of equality before<br \/>\nlaw not for violating the rule and the provisions of law. Equality<br \/>\ncannot be claimed so as to met out illegal treatment which is<br \/>\nnot permissible under the provisions of law.\n<\/p>\n<p>7.                In view of the aforesaid discussion, we find no<br \/>\nmerit in the writ petition.
