SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\napplication under Section 5 of the Limitation Act has been preferred<br \/>\nby the applicant -appellant Gram Panchayat to condone the delay of<br \/>\n553 days in preferring the First Appeal.\n<\/p>\n<p>2.0.\tHaving heard<br \/>\nShri Vishal Mehta, learned advocate for the applicant and Shri Rajesh<br \/>\nMankad, learned advocate for the original claimant and as the<br \/>\napplication is not seriously opposed by learned advocate for the<br \/>\nrespondent and subject to payment of cost which is quantified at<br \/>\nRs.2500\/- to be deposited by the applicant with the Registry of this<br \/>\nCourt within a period of one week from today, present application is<br \/>\nallowed and the delay caused in preferring the aforesaid First Appeal<br \/>\nis hereby condoned. Rule is made absolute to the aforesaid extent. It<br \/>\nis observed that in case the aforesaid amount of cost is not<br \/>\ndeposited by the applicant within a period of one week from today as<br \/>\nordered, the delay is not treated to have been condoned.
