NO. 3818 OF 2007\n            ==========================\n           Dated this the 23rd day of November, 2007.\n\n                             ORDER\n<\/pre>\n<p>      The revision petitioner, who was the counter petitioner in<\/p>\n<p>M.C. No. 25\/2006 on the file of the Sub Divisional Magistrate,<\/p>\n<p>Muvattupzha, challenges the order dated 03.08.2007 passed by<\/p>\n<p>the Sub Divisional Magistrate purportedly under Section 138(1)<\/p>\n<p>Cr.P.C.\n<\/p>\n<p>      2.    The Sub Divisional Magistrate was moved by<\/p>\n<p>respondents 2 and 3 herein under Section 133 Cr.P.C alleging<\/p>\n<p>that a sluice thodu passing through the property of the revision<\/p>\n<p>petitioner was obstructed by the revision petitioner herein and<\/p>\n<p>thereby causing public nuisance to the applicants before the Sub<\/p>\n<p>Divisional Magistrate.\n<\/p>\n<p>      3. On 23.09.2006 the Sub Divisional Magistrate passed a<\/p>\n<p>conditional order under Section 133(1) Cr.P.C. After receipt of<\/p>\n<p>the conditional order, the revision petitioner herein who was the<\/p>\n<p>counter petitioner filed objections before the Sub Divisional<\/p>\n<p>Magistrate contending inter alia that there was no such thodu as<\/p>\n<p><span class=\"hidden_text\">CRL. R.P. NO. 3818\/2007        : 2 :<\/span><\/p>\n<p>alleged and that there was no obstruction to the public thodu as<\/p>\n<p>alleged. Thereafter the matter drifted aimlessly. Finally, as per<\/p>\n<p>the impugned order dated 03.08.2007 the Sub Divisional<\/p>\n<p>Magistrate, relying on the report of the Village Officer,<\/p>\n<p>Koovappady and the report of the Executive Engineer, PVIP,<\/p>\n<p>Division No.1, Perumbavoor, made the conditional order absolute<\/p>\n<p>directing the revision petitioner to reconstruct the thodu<\/p>\n<p>immediately on receipt of the order. It is the said order which is<\/p>\n<p>assailed in this revision.\n<\/p>\n<p>      4. I heard both sides. The legal position is that when the<\/p>\n<p>opposite party appears and shows cause against the conditional<\/p>\n<p>order, the Magistrate has to conduct an enquiry and record the<\/p>\n<p>evidence as if in a summons case. The burden of proof in an<\/p>\n<p>enquiry under Section 138 Cr.P.C is on the party at whose<\/p>\n<p>instance the      proceedings were initiated. [(1966 KLT 1100)-<\/p>\n<p><a href=\"\/doc\/1138273\/\">Balan v. State of Kerala and<\/a> (1977 KLT 329)-Ayisumma v.<\/p>\n<p>Nabeesa Umma] Even when the opposite party who denies<\/p>\n<p>existence of the public way or public water course fails to appear<\/p>\n<p>at a subsequent stage, the Magistrate cannot automatically make<\/p>\n<p><span class=\"hidden_text\">CRL. R.P. NO. 3818\/2007          : 3 :<\/span><\/p>\n<p>the conditional order absolute. He will have to take evidence on<\/p>\n<p>behalf of the complainant.(See 1968 KLT 889- Ittiathikunjan v.<\/p>\n<p>Lakshmikuttiamma, 1961 KLT 617- <a href=\"\/doc\/641475\/\">Ambi v. State of Kerala,<\/p>\n<p>Sankaran<\/a> v. Kunjukrishnan (1968 KLT 859)] After taking<\/p>\n<p>evidence, the Magistrate should be satisfied that the conditional<\/p>\n<p>order is reasonable and proper. It is thereafter that he has to<\/p>\n<p>pass the final order either making the conditional order absolute<\/p>\n<p>with or without modifications. The impugned order cannot be<\/p>\n<p>supported since the Magistrate did not conduct an enquiry nor did<\/p>\n<p>he take an evidence either in support of the complaint or in<\/p>\n<p>support of the denial.    The impugned order is accordingly set<\/p>\n<p>aside.    The matter is remitted to Sub Divisional Magistrate,<\/p>\n<p>Muvattupuzha for disposal afresh.       The parties shall appear<\/p>\n<p>before the learned Magistrate without any further notice on<\/p>\n<p>18.12.2007.         The Magistrate shall dispose of the M.C. in<\/p>\n<p>accordance with law.\n<\/p>\n<p>     The Crl.R.P is disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                       V.
