Jindal\n\nPresent:     Mr. Manish Bansal, Advocate for the petitioner.\n\nA.N. Jindal, J\n<\/pre>\n<p>             The only ground challenging the partition proceedings is that<br \/>\nthe partition conducted by the Revenue Department is bad for partial<br \/>\npartition. The petitioner could raise such objections before the Revenue<br \/>\nCourt only. The learned counsel for the petitioner has relied upon the<br \/>\njudgment rendered in case <a href=\"\/doc\/1159333\/\">Sri Thimmaiah vs. Shabira and Ors.<\/a> 2008 (2)<br \/>\nCCC 277 (SC), stating that the plaintiff has to establish that he is in<br \/>\npossession in order to entitle him for a decree for permanent injunction, but<br \/>\nthe present case is on different footings. The partition order was passed by<br \/>\nthe Revenue Court which is being executed.\n<\/p>\n<p>             In the circumstances this order apparently does not suffer from<br \/>\nany illegality.\n<\/p>\n<p>             Dismissed.\n<\/p>\n<pre>April 15, 2009                                          (A.N.
