Dadwal, Advocate,<br \/>\n            for the petitioners.\n<\/p>\n<p>            Mr. Parveen Gupta, Advocate,<br \/>\n            for the respondents.\n<\/p>\n<p>\nSATISH KUMAR MITTAL, J (Oral).\n<\/p>\n<p>            The petitioners have filed this petition under Article 226<\/p>\n<p>of the Constitution of India for issuing direction to the respondents<\/p>\n<p>to grant interest to the petitioners on the delayed payment of<\/p>\n<p>Rs.2,69,000\/- released to the petitioners as arrears of          family<\/p>\n<p>pension.\n<\/p>\n<p>            In this case, earlier the petitioners had filed CWP<\/p>\n<p>No.13743 of 2003 for quashing the order dated 31.7.2002,<\/p>\n<p>whereby their claim for family pension was declined. Vide order<\/p>\n<p>dated 8.1.2004, the said petition was allowed by passing the<\/p>\n<p>following order:-\n<\/p>\n<blockquote><p>                    &#8220;The petitioners are the parents of the deceased.<br \/>\n                    Their claim to family pension has been declined<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No.20463 of 2008                             -2-<\/span><\/p>\n<p>                 on the ground that parents are not covered under<br \/>\n                 the definition of family as per paragraph 4 (ii) of<br \/>\n                 the Family Pension Scheme, 1964, which is<br \/>\n                 applicable to the petitioners case. We find from a<br \/>\n                 perusal of the judgment in Hukmi Devi Versus<br \/>\n                 State of Haryana and others, 2003 (2) PLR 771<br \/>\n                 that this Court has struck down the definition of<br \/>\n                 family in so far as it excludes the parents from<br \/>\n                 within its ambit.    The learned counsel for the<br \/>\n                 respondents has however, argued that as the<br \/>\n                 State of Haryana has not been impleaded as a<br \/>\n                 party in the present writ petition, the same was<br \/>\n                 not maintainable.         We find no merit in this<br \/>\n                 submission for the reason that the impugned<br \/>\n                 action\/inaction     has     been   taken   by    the<br \/>\n                 respondent-Nigam. We accordingly allow the writ<br \/>\n                 petition and direct the respondents to pay family<br \/>\n                 pension to the petitioners as per their entitlement<br \/>\n                 within a period of three months from today. Dasti<br \/>\n                 order.&#8221;<\/p><\/blockquote>\n<p>           By the aforesaid order, though the respondents were<\/p>\n<p>directed to pay the arrears of family pension to the petitioners<\/p>\n<p>within a period of three months from the date of order (i.e.<\/p>\n<p>8.1.2004), but actually the arrears of family pension to the tune of<\/p>\n<p>Rs.2,69,000\/- were paid to the petitioners on 3.12.2004. Since the<\/p>\n<p>respondents have released the arrears of family pension after a<\/p>\n<p>delay of about eleven months in violation of the Court&#8217;s order, I am<\/p>\n<p>of the opinion that the petitioners are entitled to interest on the<\/p>\n<p>amount of family pension from 8.1.2004 to 2.12.2004 @ 12% per<\/p>\n<p>annum.\n<\/p>\n<p><span class=\"hidden_text\"> Civil Writ Petition No.20463 of 2008                               -3-<\/span><\/p>\n<p>             Accordingly,   this   petition   is   allowed   and    the<\/p>\n<p>respondents are directed to pay interest to the petitioners on the<\/p>\n<p>delayed payment of Rs.2,69,000\/- released to the petitioners as<\/p>\n<p>arrears of family pension @ 12% per annum from 8.1.2004 to<\/p>\n<p>2.12.2004.\n<\/p>\n<p>\n12th August, 2009.
