SANKARAN, J.\n                   ---------------------------\n                    B.A. No. 5472 of 2009\n               ------------------------------------\n          Dated this the 25th day of September, 2009\n\n\n                           O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure.    Petitioners are accused Nos.2 to<\/p>\n<p>4 in S.C No. 511 of 2007 on the file of the Additional District &amp;<\/p>\n<p>Sessions (Ad- Hoc) Court- 1, Pathanamthitta.<\/p>\n<p>       2. The offences alleged against the petitioners are under<\/p>\n<p>Sections 450 and 436 read with Section 34 of the Indian Penal<\/p>\n<p>Code.\n<\/p>\n<p>       3. It is submitted by the learned counsel for the<\/p>\n<p>petitioners    that during the committal proceedings, the<\/p>\n<p>petitioners were granted bail. After the committal proceedings,<\/p>\n<p>the petitioners were not served summons. Therefore, they<\/p>\n<p>could not appear before the court. A non-bailable warrant was<\/p>\n<p>issued against the petitioners. The petitioners surrendered<\/p>\n<p>before court on 15\/9\/2009. They moved an application for bail,<\/p>\n<p>which was dismissed by the learned Sessions Judge as per the<\/p>\n<p>order dated 16\/9\/2009.\n<\/p>\n<p>B.A. No. 5472\/2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>        4. The learned counsel for the petitioners submitted that<\/p>\n<p>the petitioners undertake to appear before the court on all<\/p>\n<p>posting dates without fail. The petitioners are prepared to comply<\/p>\n<p>with any conditions that may be imposed by the Court for the<\/p>\n<p>grant of bail.\n<\/p>\n<p>        5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioners, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioners on stringent conditions.<\/p>\n<p>        6. The petitioners shall be released on bail on their<\/p>\n<p>executing a bond for Rs.25,000\/- each with two solvent sureties<\/p>\n<p>each for the like amount to the satisfaction of the Court of the<\/p>\n<p>Additional District &amp; Sessions Judge (Ad-Hoc)-1, Pathanamthitta<\/p>\n<p>subject to the following conditions:-<\/p>\n<blockquote><p>              A)   The petitioners shall appear before the<br \/>\n                   Station House Officer, Keezhvayoor on<br \/>\n                   every   Sunday     between   9  A.M.  and<br \/>\n                   11 A.M., until further orders.\n<\/p><\/blockquote>\n<blockquote><p>              B)   The petitioners shall not try to influence<br \/>\n                   the prosecution witnesses or tamper with<br \/>\n                   the evidence.\n<\/p><\/blockquote>\n<p>B.A. No. 5472\/2009<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>              C)   The petitioners shall not commit any<br \/>\n                  offence or indulge in any prejudicial<br \/>\n                  activity while on bail.\n<\/p>\n<p>              D)  In case of breach of any of the conditions<br \/>\n                  mentioned above, the bail shall be liable<br \/>\n                  to be cancelled.\n<\/p>\n<p>        The Bail Application is allowed as above.<\/p>\n<p>                                    K.T.
